These cases are not tried by juries. We trust juries to decide whether someone lives or dies, whether someone is sentenced to life or parole, but when it comes to the most helpless members of our society, our children, our justice system relies on decisions made by individual judges.<br><br> County court judge is an elected office with a salary that varies with the tax revenue a county collects. Wealthier counties can afford to hire many highly skilled judges and public defenders to serve its citizens, but there are counties -- even in New York State -- where the justice system must get by with a minimal staff and one overbooked judge.<br><br> There are thousands of county court judges in the United States, some of them more skilled than others. Occasionally, there are judges who allow their personal socio-religious beliefs to prejudice their judgments. In a rural county where most people are unable to afford high-quality legal representation, such behavior can run unchecked for years, affecting many child custody cases. This is one such case.<br><br> This was a child custody case that began in1997 when Rachel Knight met Steve Bevilacqua, they fell in love, and she decided to move to Dallas, Texas to marry him. This case spans three states and nine years. One man, the Honorable James P. Punch of Orleans County, NY, has retained jurisdiction of the case the entire time. The child in question, Kohl Jary, has not lived in New York State since 1997 -- nine years ago. Since its inception in 1980, the Church has prophesied that an army of alien invaders would land on the planet Earth and destroy the world of "normals", "pinks", and "glorps," while the members of the Church of the SubGenius would be rescued by the aliens and taken away into space.<br><br>When July 5th, 1998 arrived and no alien fleet appeared in the sky, members of the Church began citing a large number of conspiracy theories to explain why the predicted end of the world did not take place. The ddate program claims that the Church "declared that it had got the year upside down" and that X-Day will actually take place in 8661. The most popular explanation for the failure of the prophecy in the Church is usually summarized with the statement, "the calendar is wrong and July 5th, 1998 has not really arrived yet." Because of this, the Church has held annual gatherings around July 5th of each year since 1998 to celebrate X-day and greet the arrival of the anticipated alien "Sex Goddesses." No flying saucers rendezvous has been confirmed as of 2005, but members of the Church have been undaunted.<br><br>The SubGenius X-Day celebration has become well known in underground culture circles, especially in pagan communities. Of the various X-Day celebrations taking place, the largest and most popular each year has been held at the Brushwood Center in Sherman, New York (which also hosts the annual Starwood festival). Many underground rock bands have performed at X-Day in New York, and the event has evolved into a festival similar to Burning Man (except it doesn't take place in the desert) lasting for three to five days, with rock concerts, artistic events, bonfires, and blasphemous parties taking place day and night.<br><br>Regular events at X-Day include a symbolic effigy burning of J. R. That's being used for character assassination and is another issue, really. The bigger issue raised by this awful incident is the fact that child custody cases are decided by judges, not juries. PLUS: these cases are confidential, so it's hard to know what's going on, esp. in termination of parental rights, which occurs with predictable regularity on poor people. If the children are infants, in particular, they are immediately adopted by middle class women or couples through the state agency, thus negating the need to pay exorbitant sums to private adoption agencies. <br><br>Judges pass judgment on poor people, reasoning that the kids will be "better off" raised up in the middle or upper class. Usually it's middle class, because the rich can easily afford to get a foreign baby. <br><br>I've seen this happen so often it was a factor in making me close my legal practice. It still makes my blood boil.<br><br> <p></p><i></i>
