It’s been a whirlwind few months for NYPD Commissioner Edward Caban, at least in terms of press coverage. None of it has been positive, though.
A few months ago, reporting from ProPublica exposed Commissioner Caban’s efforts to make the NYPD even less accountable than it always has been. Public records and other information obtained by ProPublica made it clear Caban wasn’t interested in cleaning up a police department that was costing residents millions of dollars a year in the form of lawsuit settlements.
Earlier this month, things went from par-for-the-unaccountable-course to shit hitting the fan. The FBI spent a few days raiding homes and offices of city officials and direct subordinates of Mayor Eric Adams. Adams, a former NYPD officer, claimed to be unaware of any criminal activity happening under this nose — something he buttressed by stating he had repeatedly told staff and app

If you had that Congress was going to take bad “protect the children” bills and make them worse on your bingo card, congratulations, you’ve won this week’s easiest prediction.
This seems like a not great situation. As mentioned, the House Energy & Commerce Committee is holding a markup today for a bunch of bills. Yesterday, they revealed the various amendments being proposed, including three replacement bills (called Amendments in the Nature of a Substitute or “AINS”) for KOSA, COPPA 2.0, and APRA.
COPPA 2.0 is another problematic “protect the children bill” that takes the already problematic COPPA law and makes it way worse. In the Senate, the vote on KOSA (which was approved 91 to 3) was actually a merged version of KOSA and COPPA 2.0, referred to as KOSPA. So, what happens to both bills is important. The inclusion of APRA is a bit strange as it was an attempt at a comprehensive federal privacy bill that I thought was probably about as good as we might otherwise get, though it involved

Some of you may have heard about this. It made all the papers (at least in the United States). Tyreek Hill, wide receiver for the Miami Dolphins, was pulled over about a block away from the stadium by Miami-Dade police officers. What started as a simple situation involving a speeding/seat belt ticket escalated quickly when Hill was dragged out of his car and thrown on the ground by officer Danny Torres.
Now, everyone is going to have an opinion about how Hill handled this traffic stop. What’s tough to explain is why Officer Torres decided it was necessary to drag Hill from his car and throw him on the ground. Even the Miami-Dade government can’t explain it, which is probably why Officer Torres is now on “administrative duty” and has been publicly reprimanded for this needless escalation.
Miami-Dade County Chief of Public Safety James Reyes said the actions in the body camera footage released by the department were “deeply concerning” and “clearly do not meet the standard we expect from law enforcement.”

It’s amazing how many things just don’t look bad until, you know, you actually look at them. I mean, we’ve always known civil asset forfeiture programs are hot garbage, but the government at large was never really interested in this take. Some officials and legislators may have had their suspicions, but the easiest way for agencies like the DEA to prevent confirming these assumptions was to never bother seeing if these assumptions could be confirmed.
Asset forfeiture doesn’t dismantle drug cartels and seizing cash from random travelers doesn’t prevent drug trafficking. That much has been obvious for years. But the DEA liked taking cash, so that’s what it did. It put agents in airports to engage in warrantless searches of passengers and their luggage. It paid TSA agents to look for cash on its behalf. It accesses reams of passenger manifests for the sole purpose of finding people who might be carrying cash.
If the purpose was to stop the flow of cash across the United States (or out of the country), mission accomplished. But the DEA is in the Drug War. And what it’s been doing for years isn’t working.
The DOJ Inspector General released a report last December pointing out multiple flaws in the program — the biggest ones being the constant constitutional violations. The report was damning enough that the DOJ issued a memo that temporarily halted the DEA’s legalized theft program, known officially as the “Transportation Interdiction Program,” or “TIP.”

The Detroit PD has made this sort of thing its unofficial brand. It has even shelled out at least $300,000 to ensure people most often think of the Detroit PD when discussing false arrests aided and abetted by facial recognition tech.
But there are plenty of others in the US law enforcement industrial complex vying for the “Most False Arrests” title. It’s genuinely disheartening that cop shops seem not only incapable, but deliberately unwilling, to learn from the mistakes of others in their field.
A new report from the Washington Post, based on a thorough scouring of public records, shows there are other agencies willing to make the same mistakes — all because it’s so much easier to go with your first digital hunch than it is to do real police

The 2021 infrastructure bill earmarked $42.5 billion in broadband subsidies that will be coming to the states starting this year. But it also tasked the FCC with creating rules surrounding “digital discrimination,” or the practice of big telecoms refusing to evenly deploy next-generation broadband to low income and minority neighborhoods (despite receiving untold billions in taxpayer funds to do exactly that).
Studies have repeatedly found that companies like AT&T routinely refuse to deliver next-generation fiber to marginalized communities, despite billions in subsidies, regulatory favors, tax breaks, merger approvals, and other favors. Reporters have also found that big ISPs routinely charge minority neighborhood residents more money for slower speeds than their less diverse, more affluent neighbors.
So in 2023 the FCC did what Congress asked: it created some very basic new rules governing digital discrimination. I wrote a whole feature for it for The Verge (now paywalled

In 1979 FBI Supervisory Special Agent Dennis O. Williams moved across the country when he was promoted from the FBI’s Los Angeles Division to a supervisory position at FBI Headquarters. Soon after his arrival, Williams discovered that the mover had defrauded the FBI by billing for a higher weight of his household goods than actually existed. As Williams pursued the matter, he discovered a cover-up at FBI HQ; his attempts to expose this conspiracy resulted in his receiving threats and becoming the subject of retaliation. Though an investigation by the FBI Washington Field Office demonstrated that Williams was correct in his suspicions, the cover-ups continued for decades, eventually leading to a conspiracy to deceive the Senate Judiciary Committee regarding an inquiry into the involvement of Thomas J. Pickard.

Pickard was the acting director of the FBI when 9/11 occurred, despite Williams’ repeated warnings to the White House that Pickard did not have the integrity for such a position. The 9/11 Commission report reflects that the Phoenix Division of the FBI produced a memorandum dated July 10, 2001, advising FBI HQ that an inordinate number of supporters of Osama Bin Laden had attended civil aviation universities and colleges and would be in a position to conduct terror activity against civil aviation targets. Williams believes that Pickard’s testimony that no managers at FBI headquarters saw the Phoenix memo before September 11 constitutes a red flag indicating a conspiracy to defraud the 9/11 Commission.
