If I was to guess how many former and retired FBI agents now work
for corporations heading up their security departments or working at the executive level I would say over 50%.
Authors David Burnham and Frank Donner have documented how FBI agents and local law enforcement fix cases and shield corporate executives from prosecution. see
http://www.ucpress.edu/book.php?isbn=9780520080355
http://trac.syr.edu/

It is now well documented that FBI agents have collaborated with the Mafia since at least the 1920's to destroy unions for American corporations. They also used the Mafia in the assassinations of President Kennedy and Martin Luther King. So when reading the next story watch for how the FBI spins it.

John Kinnucan, an independent analyst with a financial services firm, was sitting on his front porch in Portland, Oregon sipping wine on Oct. 25 when two men in business suits emerged from a gray sedan and identified themselves as FBI agents.

They were there to flip him, to have him cooperate and give them an inside look at his clients as part of a wide-ranging investigation of insider trading which has lead to searches of hedge funds in recent days.

Kinnucan's disclosure of the FBI's attempt to flip him in an e-mail to about 20 hedge-fund and mutual-fund clients lead to a Wall Street Journal report over the weekend, which apparently forced the FBI's hand.

How do FBI agents decide when to create a real terror event
or a fake terror event?
I suspect it is based on a operant conditioning re-enforcement schedule.
see http://en.wikipedia.org/wiki/Operant_Conditioning
see http://webspace.ship.edu/cgboer/genpsylearning.html
This means the US Public needs to be moved in a certain direction
like complying and accepting the recent and continuing TSA outrages
implemented by its new Director former FBI agent John Pistole.
FBI agents had to jumpstart the boogeyman called "terrorist" after the
fall of the Berlin Wall in 1989. Communism no longer had the potency it had for the last 40 years.
FBI agents Anticev,Floyd , Fox and other agents in the New York
City FBI office under direction from FBI headquarters, paid Egyptian
Amed Salem close to $1 million dollars to organize the group that bombed the World Trade Center in 1993. Salem not only organized the group but provided technical know how and materials to build the bomb. When the bomb was built and the group was ready to explode the bomb Salem notified his FBI handlers. His FBI handlers fired him and allowed the bomb to be detonated. After the bomb was detonated Salem went to the press and told his story. The FBI denied it until Salem produced tape recordings he made secretly between him and his FBI handlers. The FBI backpedalled and well you can read the rest of the story here

In 2010 FBI agents no longer have to detonate the bomb.

Now we have this story in today's news. It is all about operant conditioning re-enforcement schedules.

Why does the FBI Orchestrate Fake Terror Plots?

The latest one snared Osman Mohamud, a Somali-American teenager in Portland, Oregon. The Associated Press report by William Mall and Nedra Pickler (11-27-10) is headlined in Yahoo News: "Somali-born teen plotted car-bombing in Oregon."

This is a misleading headline as the report makes it clear that it was a plot orchestrated by federal agents. Two sentences into the news report we have this: "The bomb was an elaborate fake supplied by the [FBI] agents and the public was never in danger, authorities said."

The teenager was supplied with a fake bomb and a fake detonator.
Three sentences later the reporters contradict the quoted authorities with a quote from Arthur Balizan, special agent in charge of the FBI in Oregon: "The threat was very real."The reporters then contradict Balizan: "White House spokesman Nick Shapiro said Saturday that president Barack Obama was aware of the FBI operation before Friday's arrest. Shapiro said Obama was assured that the FBI was in full control of the operation and that the public was not in danger."

An FBI agent threatened Annie Mae Aquash in the months before her 1975 murder, a friend of hers testified Friday.

Candy Hamilton, who was called as a prosecution witness in the murder trial of John Graham, said Aquash told her FBI agent David Price had tried to get Aquash to talk about what happened at the Jumping Bull ranch at Oglala on June 26, 1975, when two FBI agents were fatally shot. Aquash - who had been in Iowa the day of the shooting - wouldn't talk to Price, who then became angry.

"He said if she didn't start cooperating that he would see that she died," Hamilton said.

Government reports violations of limits on spying aimed at U.S. citizens

By Spencer S. Hsu
Washington Post Staff Writer
Friday, December 3, 2010; 12:41 AM

The federal government has repeatedly violated legal limits governing the surveillance of U.S. citizens, according to previously secret internal documents obtained through a court battle by the American Civil Liberties Union.

In releasing 900 pages of documents, U.S. government agencies refused to say how many Americans' telephone, e-mail or other communications have been intercepted under the Foreign Intelligence Surveillance Act - or FISA - Amendments Act of 2008, or to discuss any specific abuses, the ACLU said. Most of the documents were heavily redacted.

FBI informant fired his gun that triggered Kent State Massacre

Rumors of a sniper had circulated for at least a day before the fatal confrontation, the documents show. And a memorandum sent to FBI Director J. Edgar Hoover on May 19, 1970, referred to bullet holes found in a tree and a statue — evidence, the report stated, that "indicated that at least two shots had been fired at the National Guard."

Another interviewee told agents that a guardsman had spoken of "a confirmed report of a sniper."

It also turned out that the FBI had its own informant and agent-provocateur roaming the crowd, a part-time Kent State student named Terry Norman, who had a camera. Mr. Norman also was armed with a snub-nosed revolver that FBI ballistics tests, first declassified in 1977, concluded had indeed been discharged on that day.

DOJ's "hotwatch" real-time surveillance of credit card transactions

A 10 page Powerpoint presentation (pdf) that I recently obtained through a Freedom of Information Act Request to the Department of Justice, reveals that law enforcement agencies routinely seek and obtain real-time surveillance of credit card transaction. The government's guidelines reveal that this surveillance often occurs with a simple subpoena, thus sidestepping any Fourth Amendment protections.

Background

On October 11, 2005, the US Attorney from the Eastern District of New York submitted a court filing in the case of In re Application For Pen Register and Trap and Trace Device With Cell Site Location Authority (Magistrate's Docket No. 05-1093), which related to the use of pen register requests for mobile phone location records.

In that case, the US Attorney’s office relied on authority they believed was contained in the All Writs Act to justify their request for customer location information. In support of its claim, the office stated that:

Currently, the government routinely applies for and upon a showing of relevance to an ongoing investigation receives “hotwatch” orders issued pursuant to the All Writs Act. Such orders direct a credit card issuer to disclose to law enforcement each subsequent credit card transaction effected by a subject of investigation immediately after the issuer records that transaction.

A search of Google, Lexisnexis and Westlaw revealed nothing related to "hotwatch" orders, and so I filed a FOIA request to find out more. If the government "routinely" applies for and obtains hotwatch orders, why wasn't there more information about these.

It took a year and a half to learn anything. The Executive office of US Attorneys at the Department of Justice located 10 pages of relevant information, but decided to withhold them in full. I filed my first ever FOIA appeal, which was successful, albeit very slow, and finally received those 10 pages this week.

As the document makes clear, Federal law enforcement agencies do not limit their surveillance of US residents to phone calls, emails and geo-location information. They are also interested in calling cards, credit cards, rental cars and airline reservations, as well as retail shopping clubs.

The document also reveals that DOJ's preferred method of obtaining this information is via an administrative subpoena. The only role that courts play in this process is in issuing non-disclosure orders to the banks, preventing them from telling their customers that the government has spied on their financial transactions. No Fourth Amendment analysis is conducted by judges when issuing such non-disclosure orders.

While Congress has required that the courts compile and publish detailed statistical reports on the degree to which law enforcement agencies engage in wiretapping, we currently have no idea how often law enforcement agencies engage in real-time surveillance of financial transactions.

The Akron Beacon-Journal interviewed a lone National Guardsman on the scene after the shooting and when asked where the rest of his unit was, he said they were "inside one of the buildings trying to come up with a story and I didn't want to be part of that." It was not legal for them to come on the campus with loaded weapons in the first place. Other National Guardsmen were ordered in the weeks prior to the shooting to travel to and open up 18 internment camps designated and preserved under the McCarren Act, turning on heat and water in these abandoned military bases and some of the WWII Japanese relocation centers in preparation for a nationwide revolt that might have followed the massacres. A more deadly National Guard and state police shooting that riddled the walls of a dorm at Jackson State, a Black college in Orangeburg, MS the same month got almost no press attention. The walls were physically confiscated to hide the evidence, but the State Police saved the shell casings to prove that the Guard did the shooting. Vice-President Spiro Agnew, Governor Saxbe in Ohio and Atty. Gen. Mitchell organized and approved the shootings at Kent State. I.F. Stone wrote a good early book, The Killings At Kent State. The sniper story was pre-arranged and the FBI informant served as provocateur.

Former FBI agent warns of government spying abuse

by: Rick Nagin
December 7 2010

CLEVELAND - Surveillance policies now used by the FBI and other domestic intelligence agencies are "totally un-American and against the values Americans hold dear," Michael German, a former undercover agent, told a forum sponsored by the Cleveland Council on American Islamic Relations here Saturday.

Speaking to 150 at the Islamic Center of Cleveland, German said current guidelines allow federal agencies to spy, obtain private records and recruit informants against virtually all Americans even when "there is no factual basis to suspect they are engaged in illegal activity."

The FBI Arbitrarily Covers Up Evidence of Misconduct: Is This the Transparency Obama Promised?
Commentary by Jennifer Lynch

EFF recently received documents in response to one of our Freedom of Information Act (FOIA) requests that demonstrate a disturbing trend: the FBI's arbitrary application of FOIA exemptions to hide, or in some instances, reveal, its unlawful activities.

Through a careful comparison of thousands of pages of documents we received from this FOIA request with the same documents we received from an earlier FOIA request, we found that redactions in many of these duplicated documents were strikingly different. In several cases, the FBI redacted more information in later-produced documents than it did in earlier-produced documents. In other cases, the FBI redacted differing amounts of information when it produced two copies of the same report in response to the same FOIA request. Sometimes the agency blocked out whole paragraphs, while at other times it blocked out only the key words that explain the details of its acts. What is interesting is that the FBI claimed the same FOIA exemptions in each version; it just applied them differently.
