It sounds absolutely batty that there is a strong, bipartisan push to lock up aspects of our law behind copyright. But it’s happening. Even worse, the push is on to include this effort to lock up the law in the “must pass” National Defense Authorization Act (NDAA). This is the bill that Congress lights up like a Christmas tree with the various bills they know they can’t pass normally, every year.
And this year, they’re pushing the Pro Codes Act, a dangerous bill to lock up the law that has bipartisan support. The House bill is being pushed by Darrell Issa (who was once, long ago, good on copyright law) and in the Senate by Chris Coons (who has always been terrible on copyright law). We wrote about the many problems of the Pro Codes Act back in April, but Issa has still submitted it as an amendment for the NDAA (it’s Amendment 1082, so you have a b

Apparently the only time Congress can get together to agree to something, it’s to give whoever is President the power to censor speech online. That’s the only conclusion I can come to regarding the widespread support for KOSA (the Kids Online Safety Act), which Senator Chuck Schumer has announced will be coming to the floor for a vote.
Our elected officials have been told again and again why KOSA is a dangerous bill that will enable targeted censorship of protected speech. They continue to push it forward and insist that it would never be abused. And, yes, the “updated” version of KOSA from earlier this year is better than earlier versions of KOSA, but it’s still a censorship bill.
The bill still retains its “duty of care” section, which the FTC can enforce. It requires websites to “exercise reasonable care” in the design of features to avoid harm. But harm remains

Good news for phone owners. Perhaps a little less great for law enforcement, which presumably still doesn’t have the capability to crack the latest cell phones.
Not that it’s all bad news for law enforcement. Whether or not compelled password production is a constitutional violation is still an open question. Those whose phones are secured with biometrics are definitely less protected by the Constitution than those using passcodes. And, despite all the crying you might hear from officials (like, say, consecutive FBI directors), law enforcement still has plenty of options to obtain evidence that don’t involve cracking encrypted devices but rather serving warrants to service providers to obtain stuff stored in the cloud.

For years we’ve talked about the growing threat of SIM hijacking, which involves a criminal covertly porting out your phone number from right underneath your nose (quite often with the help of bribed or conned wireless carrier employees).
Once they have your phone identity, they have access to most of your personal accounts secured by two-factor SMS authentication, opening the door to the theft of social media accounts or the draining of your cryptocurrency account. If you’re really unlucky, the hackers will harass the hell out of you in a bid to extort you even further.
It’s a huge mess, and the both the criminal complaints and lawsuits against wireless carriers for not doing more to protect their users have been piling
