Insurance agency sues FBI for damaged Ferrari

American insurance company Motors Insurance has launched a legal battle against the FBI and the Justice Department, suing them for $750,000 in an incredible story of a stolen and damaged Ferrari.

The incident happened in May 2009, when FBI special agent Frederick C. Kingston, accompanied by assistant attorney J. Hamilton Thompson, accidentally crashed the famous Ferrari F50. The car had been declared stolen by a dealer in September 2003, who received compensation from his insurance company, Motors Insurance, to whom ownership of the vehicle was automatically transferred.

BRANDYWINE, Md. - The FBI says it fired an agent accused of a drunk-driving accident here that killed a teenager.

Although no charges have been filed in the Feb. 7 incident, which killed Lawrence Garner Jr., 18, and critically injured a passenger in his car, Garner's family was worried that the agent, whom police have not identified, would receive special treatment because of his job.

"A guy that that's irresponsible doesn't deserve to hold a job of that caliber," Lawrence Garner Sr. said. "It's not going to bring my son back, but it's a start. This is only the beginning of what we're out to do ... to get these people (drunk drivers) off the roads."

BATON ROUGE - Undercover FBI Agent William Miles testified in Federal Court Friday that he took "targets" of the FBI's corruption investigation to Passions Mens' Club in New Orleans in order to gain their trust.

The targets of that investigation included brothers Mario Brown and Maurice Brown of White Castle. Mario was re-elected Police Chief after he was indicted. Maurice is the former mayor of White Castle.

Miles told jurors he offered tickets to sporting events and up to $500 in exchange for official paperwork that would prove the brothers guilty of fraud. His conversations, Miles testified, were in order to form a relationship with the men.

Defense attorney Bruce Craft argued Miles lied to the men and attempted to entrap them by offering them bribes.

A Michigan insurance company is suing to find out more details about a $750,000 Ferrari F50 an FBI agent smashed up while it was being held as evidence, the Detroit News reports.

Motors Insurance filed a federal lawsuit this week in Detroit to get records under the Freedom of Information Act about the incident. The Justice Department has refused to release the information, the suit claims.

The lawsuit says the car was stolen from a dealership in Rosemont, Pa., in September 2003, and that Motors Insurance paid the claim, the News reported.

Five year later, law enforcement recovered the car in Kentucky.

The lawsuit claims the car was stored during an investigation and prosecution of a thief, the News reported.

At some point, while still in the hands of federal authorities, an FBI special agent took it for a ride, lost control and smashed it into a tree in Lexington, Ky., the News reported.

An FBI negotiator's unwillingness to continue talking to two Somali pirate leaders about the release of four Americans being held aboard a yacht may have led to a shootout that killed the hostages, it was reported yesterday.

Citing an unnamed official with the US military, The New York Times disclosed details of the incident, which took place off the coast of Oman on Tuesday. While hijackings by pirates have become a persistent threat in the area, deaths of hostages are unusual.

The FBI negotiator on board a US warship decided he could not take the pirate leaders seriously. The remaining 17 pirates on the yacht were told their leaders were being held in custody on the USS Sterett and an offer was made: release the hostages and the men could go free, either with the yacht or aboard one of the navy's smaller vessels.

AN FBI agent has been caught out lying to gain access to the home of a senior Australian Defence Force officer and his wife, a US citizen who once advised the White House and the Pentagon on Middle Eastern affairs.

The agent went to the Canberra home of the ADF officer and his wife, Gwenyth Todd, and said a recent security incident involving Chinese hackers had compromised the security of some US passports and he was warning local Americans.

When Gary Adams heard a series of "booms" early Thursday, he figured one of the kids had left the TV on overnight. He had no idea, he said Friday, that law enforcement agents were about to flood his Bellevue house, looking for an accused member of the Manchester OGs gang who once lived there.

A few clock ticks later, agents broke open all three doors into his Orchard Avenue home, shattering glass. Then some 15 Federal Bureau of Investigation agents and state and local police entered his home.

"When I hit that bend and turned," he said, pointing toward the staircase that lands near his front door, "there was a laser sight on my head."

An hour later the agents left, without their suspect, Sondra Hunter, who remained at large. An FBI agent apologized and promised the bureau would pay for the damaged doors, he said.

These days, agents don't hesitate to break doors. Several federal agents have been shot in recent years, and some of the 29 accused gangsters whose indictments were unveiled Thursday are accused of gun violations.

The entry to Mr. Adams' house, though, raises the question: Absent a search warrant, when can law enforcement knock in a door?

"If they have an arrest warrant for John Doe ... that is not authority to go into [Doe's] friend's house," said David Harris, a professor of law at the University of Pittsburgh School of Law, and a specialist in search and seizure. "Otherwise, a warrant for anyone could allow you to go anywhere that person could be."

"In this day and age, police are given quite a bit of leeway," said Alexander H. Lindsay Jr., a defense attorney and former federal prosecutor. "Whenever law enforcement is executing a warrant, the safety of the officers in question is always a primary consideration."

The FBI, which coordinated the multi-agency raid on the OGs that netted 25 drug and gun suspects, declined comment.

Mr. Adams said his family moved from Manchester to Bellevue in June. There they rented a house that, some time before, had been occupied by Ms. Hunter, 35, whose family Mr. Adams knows.

"We have no association whatsoever with [Sondra Hunter]," said Mr. Adams, a 57-year-old who scalps tickets.

Law enforcement monitoring of his street apparently began some time before the raid. Mr. Adams said family members noticed people sitting in cars on the block during the week before the Manchester OGs take down.

It was sometime before 6 a.m. Thursday, and Mr. Adams was in bed, when he heard the booms, and then amplified speech. "I heard the loudspeaker say, 'Sondra Hunter, come out with your hands up,' " he said.

He looked out his window and saw a SWAT truck parked a few doors down, its light shining in his window.

His wife, Denise Adams, 58, went downstairs, as someone from outside broke the glass in the front door. Agents outside ordered her to freeze, and to open the door. She said she had to go upstairs and get the key to unlock the deadbolt, but as she took a step toward the stairs, the door was broken in.

Agents flooded in, Mr. Adams said, ordering the family of 11 -- he and his wife, their three children, and six grandchildren ages 2 to 16 -- to the porch.

He said they pointed guns at everyone. "How are you pointing those guns on those kids?" he said Friday. "My granddaughter came home from school yesterday, [and] said she couldn't even concentrate."

He refused to leave during the search and said his requests to see a search warrant were ignored.

Tapes Depict Proposal to Thwart Bomb Used in Trade Center Blast

Law-enforcement officials were told that terrorists were building a bomb that was eventually used to blow up the World Trade Center, and they planned to thwart the plotters by secretly substituting harmless powder for the explosives, an informer said after the blast.

The informer was to have helped the plotters build the bomb and supply the fake powder, but the plan was called off by an F.B.I. supervisor who had other ideas about how the informer, Emad A. Salem, should be used, the informer said.

The account, which is given in the transcript of hundreds of hours of tape recordings Mr. Salem secretly made of his talks with law-enforcement agents, portrays the authorities as in a far better position than previously known to foil the Feb. 26 bombing of New York City's tallest towers. The explosion left six people dead, more than 1,000 injured and damages in excess of half a billion dollars. Four men are now on trial in Manhattan Federal Court in that attack.

Mr. Salem, a 43-year-old former Egyptian army officer, was used by the Government to penetrate a circle of Muslim extremists now charged in two bombing cases: the World Trade Center attack and a foiled plot to destroy the United Nations, the Hudson River tunnels and other New York City landmarks. He is the crucial witness in the second bombing case, but his work for the Government was erratic, and for months before the trade center blast, he was feuding with the F.B.I. Supervisor 'Messed It Up'

After the bombing, he resumed his undercover work. In an undated transcript of a conversation from that period, Mr. Salem recounts a talk he had had earlier with an agent about an unnamed F.B.I. supervisor who, he said, "came and messed it up."

"He requested to meet me in the hotel," Mr. Salem says of the supervisor. "He requested to make me to testify and if he didn't push for that, we'll be going building the bomb with a phony powder and grabbing the people who was involved in it. But since you, we didn't do that."

The transcript quotes Mr. Salem as saying that he wanted to complain to F.B.I. headquarters in Washington about the bureau's failure to stop the bombing, but was dissuaded by an agent identified as John Anticev.

"He said, I don't think that the New York people would like the things out of the New York office to go to Washington, D.C.," Mr. Salem said Mr. Anticev had told him.

Another agent, identified as Nancy Floyd, does not dispute Mr. Salem's account, but rather, appears to agree with it, saying of the New York people: "Well, of course not, because they don't want to get their butts chewed."

Mary Jo White, who, as the United States Attorney for the Southern District of New York is prosecuting defendants in two related bombing cases, declined yesterday to comment on the Salem allegations or any other aspect of the cases. An investigator close to the case who refused to be identified further said, "We wish he would have saved the world," but called Mr. Salem's claims "figments of his imagination."

The transcripts, which are stamped "draft" and compiled from 70 tapes recorded secretly during the last two years by Mr. Salem, were turned over to defense lawyers in the second bombing case by the Government on Tuesday under a judge's order barring lawyers from disseminating them. A large portion of the material was made available to The New York Times.

In a letter to Federal Judge Michael B. Mukasey, Andrew C. McCarthy, an assistant United States attorney, said that he had learned of the tapes while debriefing Mr. Salem and that the informer had then voluntarily turned them over. Other Salem tapes and transcripts were being withheld pending Government review, of "security and other issues," Mr. McCarthy said.

William M. Kunstler, a defense lawyer in the case, accused the Government this week of improper delay in handing over all the material. The transcripts he had seen, he said, "were filled with all sorts of Government misconduct." But citing the judge's order, he said he could not provide any details.

The transcripts do not make clear the extent to which Federal authorities knew that there was a plan to bomb the World Trade Center, merely that they knew that a bombing of some sort was being discussed. But Mr. Salem's evident anguish at not being able to thwart the trade center blast is a recurrent theme in the transcripts. In one of the first numbered tapes, Mr. Salem is quoted as telling agent Floyd: "Since the bomb went off I feel terrible. I feel bad. I feel here is people who don't listen."

Ms. Floyd seems to commiserate, saying, "hey, I mean it wasn't like you didn't try and I didn't try."

In an apparent reference to Mr. Salem's complaints about the supervisor, Agent Floyd adds, "You can't force people to do the right thing."

The investigator involved in the case who would not be quoted by name said that Mr. Salem may have been led to believe by the agents that they were blameless for any mistakes. It was a classic agent's tactic, he said, to "blame the boss for all that's bad and take credit for all the good things."

In another point in the transcripts, Mr. Salem recounts a conversation he said he had with Mr. Anticev, saying, "I said, 'Guys, now you saw this bomb went off and you both know that we could avoid that.' " At another point, Mr. Salem says, "You get paid, guys, to prevent problems like this from happening."

Army reprimands 9 officers in Fort Hood shooting

WASHINGTON (AP) -- Nine Army officers are being reprimanded for leadership failures in connection with the shooting rampage at Fort Hood, Texas, and their failure to detect and report problems with the accused shooter, Maj. Nidal Malik Hasan, as he moved along in his medical career.


The review, however, found that no one in Hasan's chain of command blocked his ability to hold a secret security clearance or stop his continued assignments, including his move to Fort Hood.

Earlier this year a Senate review came to similar conclusions, saying the Defense Department and the FBI had sufficient information to detect that Hasan had been radicalized to violent extremism, but they failed to act on it.

John J. "Zip" Connolly, Jr. is a former FBI agent, currently incarcerated in a federal penitentiary for racketeering and obstruction of justice convictions stemming from his relationship with James J. "Whitey" Bulger, Steve Flemmi, and the Winter Hill Gang. He is the brother-in-law of Arthur Gianelli who is married to Mary Ann Moore, the sister of Connolly's wife Elizabeth.

State police and other federal officers had been trying to imprison Whitey Bulger for years, but somehow Bulger always avoided getting caught. As the FBI handler for Bulger and Flemmi, Connolly (who had grown up in the Old Harbor Housing Project with Bulger) had been protecting them from prosecution by feeding him information about possible attempts to catch them.

Connolly was indicted on December 22, 1999 on charges of alerting Bulger and Flemmi to investigations, falsifying FBI reports to cover their crimes, and accepting bribes. In 2000, he was charged with additional racketeering related offenses. He was convicted on the racketeering charges in 2002 and sentenced to 10 years in prison.[1]

This scandal was the basis for the book Black Mass and is alluded to in the 2006 crime thriller film, The Departed, written by William Monahan and directed by Martin Scorsese. The Departed is mainly based on the Chinese film Infernal Affairs, though it takes its setting, situations and other details from the scandal.[2]

John Joseph Connolly Jr. was the namesake and son of an Irish immigrant John Connolly Sr. known as "Galway John" by friends and neighbours. His father was a Gillette (brand) employee for 50 years, his mother Bridget T. Kelly was a housewife. They lived in the Old Colony housing project on O'Callahan Way until John Jr. was twelve when in 1952 his family moved to the City Point neighbourhood of South Boston, Massachusetts. John was the father of three and somehow was able to afford to send John to Columbus High School, a Catholic high school in the Italian North End, Boston neighbourhood. John Sr. earned the moniker 'Galway John' because he was a second-generation Irish-American from Galway, Ireland in South Boston, Massachusetts. He has a sister, Mary Ann, and one younger brother named James, who would later follow John's footsteps and seek a career in law enforcement, joining the Boston DEA.

As a young boy, Connolly would later tell reporters his first memory of James J. Bulger, using his illicit earnings to buy ice cream cones for all the boys that swarmed around him in adoration. He would later answer to the nickname 'Elvis' because of his thick black hair and also to 'Neighbor,' because of his early years of growing up in the projects. He was a neighbor of the Bulger family, Joseph Moakley and Francis 'Buddy' Leonard who would later be murdered by Bulger in 1975 during his battle for power over the rackets.

Connolly graduated from Boston College and attended law class and then briefly, unhappily, attended Suffolk University Law School for a Bachelor of Law in the same class at John Martorano's brother James Martorano. He later withdrew from Suffolk University and went on to earn a graduate degree in Public Administration from Harvard University's John F. Kennedy School of Government. In 1968 he met with H. Paul Rico's FBI partner Special Agent Dennis Condon, and Boston Police Department Detective Edward Walsh, an old friend of the Connolly family. Both Condon and Walsh would later brag that they had 'recruited' Connolly. Then he stopped by his old neighbor and state representative Billy Bulger to discuss career opportunities in law enforcement. On August 1, 1968 U.S. House Speaker John William McCormack wrote a personal note to J. Edgar Hoover on behalf of a constituent. The letter began, "Dear Edgar, It has come to my attention that the son of a lifelong personal friend has applied to become a special agent of the Federal Bureau of Investigation..." He was appointed to the FBI in October of 1968. FBI Supervisor John M. Morris, who would also face charges of corruption, was Connolly's supervisor during much of his time working for the FBI.

As an agent he was also one of the primary agents involved in developing the Top Echelon Criminal Informants Program in New England. He began his FBI career in Baltimore, Maryland field office and then San Francisco, California field office before he was transferred back to New York, New York where he helped break up a child pornography ring. But he wanted to return to Boston to be closer to his ailing father. In 1980 he moved into the neighbourhood of Dorchester Heights across the street from South Boston High School, at 48 Thomas Park. During his career in the FBI, Connolly investigated organized crime and over the span of his career received eight commendations from every Director of the Federal Bureau of Investigation from J. Edgar Hoover through L. Patrick Gray, William Ruckelshaus, Clarence M. Kelley, James B. Adams, William H. Webster, John Otto and William S. Sessions. In 1973 he was the first agent assigned to the FBI office in Boston and maintained an office at One Centre Plaza in Government Center, Boston. He is the brother-in-law of Arthur Gianelli who was later indicted with Joe (Joey Y) Yerardi who oversaw John Martorano's criminal operations when he was a federal fugitive in Florida between 1978 and 1995. In 1989 the DEA was probing the Winter Hill Gang for suspected drug trafficking. The DEA was well aware that John's brother James, and a former room mate of his worked for both worked for the DEA. An FBI supervisor later noted in a memo, the head of the DEA's Boston office, "quietly changed the duties of both these DEA special agents so they would not become aware of this matter." Boston FBI Special Agent Robert Fitzpatrick said in Black Mass, "Connolly just became a force unto himself, a vortex in a constantly changing system. He stayed put as new agents in charge came and went. And he could take care of other agents. He became the guy who could get you sports tickets. He could help you get a day off through the secretaries. He made no secret that he could help you get a job after retirement through Billy Bulger. But he wasn't that much of an agent. He couldn't write a report. He was no administrator. He was just this brassy bullshit artist. We enabled him to some extent. No one had the stomach for examining what he was up to. We just never came to grip with that guy."

Connolly married his first wife, Mary Ann Foley, his childhood sweetheart after he neared graduation from Boston College Law School but they divorced after Mary Ann cited an "irretrievable breakdown" after a four year separation, filing for divorce in January 1982. Mary Ann was a registered nurse and neither protested the separation that became official a few months later. He married again to 23-year-old Elizabeth L. Moore a court stenographer who worked at the John Joseph Moakley United States Courthouse. At the time of Connolly's incarceration she stayed by his side and remained married to him. His wife Elizabeth is the webmaster for the website www.justicforjohn.com who states in the website mission that it, "represents the collective voices of the many friends and supporters of retired FBI Special Agent John J. Connolly Jr. We come from all walks of life, including the law enforcement community. We have come together to seek justice for a highly decorated FBI Special Agent who was convicted and sentenced to lengthy imprisonment largely on the testimony of gangland murderers, all of whom obtained sentencing “deals” from prosecutors in return for their testimony against Mr. Connolly... It is our hope that you will review these documents, and join with us in our quest for justice for John, beginning with a new trial". John had no children with his first wife and would later father three sons to his second wife Elizabeth. When John and Elizabeth first married he bought a $80,000 condominium for them in Brewster, Massachusetts and took regular vacations to Cape Cod. His sister-in-law Mary Ann Moore, is married to Arthur Gianelli. Gianelli and Connolly purchased adjoining property in Lynnfield, Massachusetts from Patriarca mob family extortionist Rocco Botta.
[edit] Meeting Flemmi and Bulger

He first met FBI informants Steven Flemmi and James J. Bulger at a coffee shop in Newton, Massachusetts. He occasionally lectured FBI agents at the FBI Academy in Quantico, Virginia on informant development tactics and techniques and was a member of the Boston FBI's Organized Crime Squad. Retired FBI Special Agent Joseph Pistone wrote in his book, The Ceremony, "The reign of the Patriarca crime family is ended. A substantial amount of the credit for the demise of that mob family must be given to one man, Special Agent John Conolly." Louis Litif, one of the top bookmakers and Winter Hill Gang mob associate was one of Connolly's handball partners at the Boston Athletic Club. He retired from the FBI honorably in 1990 and accepted the position of Director of Affairs for Consolidated Edison, from former Boston FBI Special Agent John Kehoe.
[edit] Murder trial

In 2005, Connolly was indicted on murder and conspiracy to commit murder charges in the 1982 slaying of John B. Callahan. He stood trial in 2008 in Miami.[3] Callahan was murdered by John Martorano who shot Callahan and left his body in the trunk of his Cadillac in a parking lot at Miami International Airport.[4] Prosecutors alleged that Callahan was killed on the orders of Whitey Bulger and Stephen Flemmi after Connolly told them that the FBI was investigating his ties to the Winter Hill Gang in their on going investigation into the death of World Jai Alai owner Roger Wheeler. Wheeler had also been killed by Martorano in Tulsa, Oklahoma in May 1981.

During the trial, Bulger associates Stephen Flemmi, Kevin Weeks and John Martorano testified for the prosecution detailing Connolly's ties to Bulger and Flemmi. Long time Bulger girlfriend Teresa Stanley testified for the defense about her travels with Bulger. Flemmi testified that Connolly warned them that the FBI wanted to question Callahan in the death of Wheeler, telling them that Callahan "wouldn't hold up" and would probably implicate them.[5]

Also testifying against Connolly was his former FBI boss, John Morris, who admitted that he accepted $7,000 in bribes from Bulger and Flemmi. He stated he began leaking information to them after Connolly delivered a case of wine and an envelope stuffed with $1000 cash from the pair.[6]

Testifying for Connolly was former U.S. Attorney and current U.S. District Senior Judge Edward F. Harrington who testified that Connolly was a star agent who was credited with using informants to help destroy the New England Mafia.[7]

On November 6, 2008, a jury convicted Connolly of second-degree murder. According to the prosecutors, Connolly faced a possible sentence of 30 years to life in prison.[8] Connolly was due to be sentenced on December 4, 2008 but sentencing was postponed until January while the judge in the case, Circuit Judge Stanford Blake, considered a motion by the defense to dismiss the case. The defense argued that in Florida, the statute of limitations had expired for second-degree murder when Connolly was convicted.[9]

On January 15, 2009, Blake sentenced Connolly to 40 years in prison, saying that Connolly "crossed over to the dark side." The judge agreed with the defense's argument involving the statute of limitations, but noted that their motion was past the deadline for such motions.[10] He accepted prosecutors' argument that Connolly abused his badge and deserved more than the 30-year minimum. The sentence will run consecutively with his 10-year sentence for racketeering, meaning that Connolly will spend the rest of his life in prison.[1]

Portland Oregon based Media Monarchy recently tweeted a video of We Are Change activists taking to their local city hall demanding that their city remain out of the FBI's Joint Terrorist Task Force (JTTF). In 2005, Portland became the first city in the United States to opt-out of the FBI's JTTF over concerns it would threaten civil liberties.A Portland representative talking with We Are Change says e-mails
regarding the JTTF have been nearly 100% against joining the FBI's scheme.
