The man behind the sensational story concerning information the Russian government had supposedly collected about Donald Trump is a former British intelligence operative and was a longtime intelligence source for the U.S. government who had assisted the FBI during an investigation into corruption by FIFA, the world soccer association, according to sources familiar with the matter.

The operative — identified today by the Wall Street Journal as Christopher Steele, a former Russian operations officer for Britain’s MI6 intelligence agency — had worked as a consultant for the FBI’s Eurasian organized crime section, helping to develop information about ties between suspected Russian gangsters and FIFA, said one of the sources, who is directly familiar with Steele’s work.

Steele had been hired originally to investigate Trump by his political opponents, and he decided to share his information with the FBI last year. The preexisting relationship

Move to Give FBI More Warrantless Spying Powers

Congress is backing off from a push to grant the Federal Bureau of Investigations more warrantless surveillance powers.
Lawmakers had been attempting to use the annual intelligence policy bill to allow the FBI to obtain more sensitive digital information from Americans, using only a subpoena.
That effort, however, has been abandoned, this year, according to a recently published Senate Intelligence Committee report on the legislation.
"This expansion of government surveillance authorities was both far-reaching and intrusive, potentially covering records related to Americans' email exchanges as well as their login history, IP addresses, and internet browsing history," said Sen. Ron Wyden (D-Ore).
Wyden said the proposal would have given the FBI such spying authorities "with no court oversight."
In the report, published late last week, on the day of Donald Trump's inauguration, Wyden noted that he would back the legislation, the Intelligence Authorization Act of 2017, with the additional surveillance powers stripped from the bill. He had held up the proposal on the Senate floor, in June 2016, after its authors sought to expand FBI's spying authorities.
Hawkish senators had attempted to grant the FBI such powers, in the wake of the June 12, 2016 shooting at Pulse, a popular gay nightclub in Orlando, Fla. The massacre left 53 people wounded and 49 others dead, including

The Seattle City Council plans to call for the removal of the cameras, which have been operating since at least 2015, Seattle Weekly reports.

Chilean Wildfires are Worst to Ever Strike the Country
Drought in Chile has now lasted for more than a ten years.

Yearly precipitation deficits have ranged from 30-70% for most of central Chile for the last decade. But the ongoing drought’s intensity has increased since 2011. The result has been “an unprecedented drought in terms of intensity, spatial and temporal extent.”


Over recent days, the forests of Central Chile appear to have finally succumbed to the unprecedented and unrelenting punishment. One by one, massive wildfires ignited through Chile’s bone-dry woods — scorching hillsides, decimating more than 100 vineyards, and resulting in the tragic loss of four firefighters. As of today, more than 85 wildfires have burned approximately 190,000 hectares of land — or about 733 square miles.

This charred chunk of Chile more than half the size of Rhode Island represents the worst fire disaster in the state’s history. Now, nations are scrambling to help Chile respond to the crippling disaster as more than 35 large fires continue to rage out of control.

President Michelle Bachelet, visiting the hard-hit Maule region, stated to Reuters:

“We have never seen something of this size, never in Chile’s history. And the truth is the (firefighting) forces are doing everything that is humanly possible and will continue to do so until the fires are contained and controlled.”

These massive fires serve as the most recent book-end to a crippling climate change related situation that has been impacting Chile and larger South America for years. The fire situation has obviously been set in place by current ‘Mega Drought’ conditions. A drought period that “stands out not only in the historical record but also in precipitation and stream flow reconstructions for the last 1000 years.”

It’s a drought situation that’s replete with climate change related signals. Negative Pacific Decadal Oscillation (PDO) values helped to push Chile into a dry phase through 2012 even as drying was considerably stronger than during past negative PDO periods. As PDO flipped to positive from 2013 onward, related El Nino conditions failed to bring expected rainfall to the state and drought conditions worsened. Due to these factors, climate researchers note: “there is an strong suggestion that anthropogenic climate change is [at least in part] responsible for the present Mega Drought.”



(It’s not just wildfire-ravaged Chile. Large regions of South America are also experiencing severe drying which is helping to increase wildfire risk. Such drying is a feature of human-caused climate change in that human-forced warming due to fossil fuel burning increases evaporation rates and related stress to forests even as it drives fundamental alterations to precipitation patterns that can substantially worsen drought and wildfire intensity. Climate change also appears to be driving drying in neighboring South American states like Brazil and Bolivia — where severe droughts and related warming are drying up massive lakes and helping to worsen the wildfire situation in the Amazon Rainforest. In Bolivia, drought has combined with a climate change driven removal of key mountain glaciers that has produced an endemic state of water scarcity. In Brazil, warming and deforestation are combining to remove a large portion of the atmospheric moisture plume that the great Amazon Rainforest provides. So the historic Chilean wildfires should also be considered in the larger context of ongoing South American droughts related to climate change.

This Election is an Encounter with the Force of Destiny
Hi Everyone,

Well, Election Day has finally arrived. Whew. Today in deciding who will be our next President, we are truly casting a vote for which path of destiny this nation will follow, because symbolically that is the significance of this extremely chaotic, ground-shifting, mind-boggling political campaign. Clinton and Trump are symbols – at least from my perspective – of our collective energies, of all we have done wrong as a nation, of all we are losing within a once high functioning society, of hidden desires to return to eras long past, and of fears associated with going into the unknown. This election also represents what we imagine as our potential for a positive future – but the underlying rage and anger that we witness in so many people tells me that few actually trust that anything will change. They know it in their collective gut and their rage gives voice to their hopelessness and their feelings of helplessness. We all know those feelings these days to some extent.

Like all leaders that have arisen in times of great change – from Mahatma Gandhi to Nelson Mandala to Winston Churchill and Franklin Roosevelt to the nightmares of Adolph Hitler and Joseph Stalin – such leaders rise on the wild spinning energies of the collective grace and psychic free radicals in the atmosphere that the societies-at-large generate. We are the engines that give life to those that emerge from the crowds. We are the residents of the societies-at-large. Leaders and candidates – whether from the past or Clinton and Trump – are not apples that randomly fall from trees. They are grand reflections of who we are and our responses to this moment in evolution and how we are handling it. They embody our collective values and morals – or lack thereof. Consider that Gandhi lifted the people of India into a conscious awareness of what their anger represented: They wanted radical change and freedom from British rule. Rather than hate each other and the British, he offered a positive means of channeling that collective energy into a positive transition. But like all transitions, it came at a price in the beginning stages because those who were comfortable in the old way, those who liked being superior to the Indian people (aka the British), did not want the system to change. Rulers never want a system to change and they will fight to the death to hold the high ground. But they always – and I do mean always – end up losing. Evolution itself inevitably defeats them.

We have approached that moment in history at which believing in any expression of superiority flows against the course of evolution. We are in the holistic age now. Your own body pulsates with that truth – and your body is the micro reflection of the macro collective Earth. You body will not heal if you do not approach your health – indeed your entire life – from a holistic template. All life systems are directing us to merge into a conscious community of human beings. Our religions are breaking down, our national boundaries our evaporating, and our technology is serving the creation of an intimate humanity. We have to move forward toward wholeness if for no other reason than all the problems we now face – from having the capacity to destroy ourselves through our own foolish nuclear weaponry – to refugees to food and water distribution to climate change and so many more – require every nation’s participation in creating solutions. This shift is epoch is size and scope. I believe it is greatest challenge in the history of civilization itself – the evolutionary leap to become a global humanity. We do not even have a thought in our head capable of seriously considering that. And we ourselves won’t make it to that Promised Land. But that is the path every molecule in us is on, magnetically, psychically and spiritually. All choices that we make that oppose that holistic map run counter to that archetypal map that now governs our psyche and soul.

No wonder this election has driven people to near madness. Deep in the blood and bones of people, they know that this election is not an ordinary one. It is a choice between paths of destiny – one going backwards and one going forwards. Neither person is popular because no one – absolutely no one – wants to be on this path. No one wants to vote for either because no one wants this election to be an encounter with the force of Destiny. But it is. So we can scream about emails or women’s issues or whatever – but that’s all nonsense. Utter blather. The real power is unfolding in the unseen world. Indeed, the power is unfolding in your very biology.

WASHINGTON, July 4— A Chicago-based agent of the Federal Bureau of Investigation has acknowledged that he and other white colleagues planned a campaign of ''retribution'' against a black agent, Donald Rochon, whose case has prompted a national debate over racism in the bureau.

Newly released F.B.I. documents also show that the white agent, Gary W. Miller, has conceded that in 1985 he forged Mr. Rochon's signature on an application for death and dismemberment insurance for the Rochon family.

Mr. Rochon has described the unsolicited insurance policy as a death threat. Mr. Miller, who was suspended without pay for two weeks as a result of that incident and others aimed at Mr. Rochon, has denied that he was trying to harass the black agent. Agents Admit Harassment

The disclosures, contained in court papers filed here Friday, amount to the first public acknowledgment by the bureau that white agents may have participated in harassment of Mr. Rochon in Chicago, where he was assigned from 1984 to 1986.

The newly released documents are bound to cause further embarrassment for the bureau, which has been criticized by Congress over the Rochon case and over other discrimination claims involving black and Hispanic employees. More than half of the F.B.I.'s Hispanic agents have joined in a separate lawsuit against the bureau, charging that they faced discrimination in hiring and promotion.

Mr. Rochon has said that while he and his family were living in Chicago, their safety was repeatedly threatened in anonymous telephone calls and obscene, racist letters from white F.B.I. agents.

The Justice Department and the Equal Employment Opportunity Commission have found that Mr. Rochon was the victim of ''blatant racial harassment'' in the F.B.I.'s Omaha office in 1983 and 1984. In one incident, someone in the Omaha office taped a picture of an ape's head over a photograph of Mr. Rochon's son.

Mr. Rochon has long contended that the later incidents in Chicago, which are the subject of an investigation by a Federal grand jury, were more serious than the harassment in Omaha. Charges Rights Violations

The newly released documents were made available to Mr. Rochon's lawyer, David Kairys of Philadelphia, in preparation for trial on a civil lawsuit filed by Mr. Rochon in Federal District Court in Washington. The suit charges the bureau and several white F.B.I. officials in Chicago and Omaha with violations of Federal civil rights laws.

''It's quite significant,'' Mr. Kairys said of the F.B.I. documents. ''This corroborates what Don Rochon has been saying all along. It corroborates that there was a conspiracy among F.B.I. agents to racially harass Donald and his family.''

Signals of Climate Change Visible as Record Fires Give Way to Massive Floods in Peru

During September through November, wildfires tore across parts of drought-stricken Peru.

Peru’s Amazon was then experiencing its worst dry period in 20 years. And, at the time, over 100,000 acres of rainforest and farmland was consumed by flash fires. Rainforest species, ill-adapted to fires, were caught unawares. And a tragic tale of charred remains of protected species littering a once-lush, but now smoldering, wood spread in the wake of the odd blazes.

At the time, scientists noted that the after-effects of El Nino had combined with a warmer world to help spur the drought and the fires. And they warned Peru to prepare for more extreme weather in the future as Earth continued to heat up.

Fast forward to 2017 and we find that the moisture regime has taken a hard turn in Peru as the droughts and fires of 2016 gave way to torrential rains. Since January, more than 62 souls have been lost and about 12,000 homes destroyed as flash floods ripped through Peru. Over the past three days, the rains have been particularly intense — turning streets into roaring rivers and causing streams to over-top — devouring roads, bridges and buildings. As of yesterday, 176 districts within the country have declared a state of emergency due to flooding.

The rains come as coastal waters off Peru have seen sky-rocketing temperatures. Sea surface readings over recent months have climbed from an average of 24 degrees Celsius to 29 degrees Celsius. These extremely warm waters are pumping a huge plume of moisture into the local atmosphere. And it’s this extraordinarily heavy moisture loading that is spurring the massive rainstorms now plaguing the state.

Scientists call this phenomena a coastal El Nino. And the last time Peru experienced one was in 1925. Though the coastal El Nino probably helped to spur the extreme rains now plaguing Peru, the peak sea surface temperatures of the very warm waters off Peru have also been increased by the larger human-forced warming of the world (primarily through fossil fuel burning). So many scientists are also now saying that the severe rainfall events now occurring in Peru were likely contributed to by climate change.

New Peru movement leader Verónika Mendoza noted earlier this week:

“We know the ‘coastal El Niño’ comes from time to time. We know we are a country that is extremely vulnerable to the effects of climate change. We should have prepared ourselves better.”

The climate extremes Peru has experienced — flipping from flash drought and wildfires to flash flood in just 5-6 months is exactly the kind wrenched weather we can expect more and more from climate change. For as the Earth warms, the amount of moisture evaporated from lands, oceans, lakes and rivers increases. As a result, the hydrological cycle gets kicked into higher gear. And what this means it that droughts and fires will tend to become more intense even as rains, when they do fall, will tend to be heavier.

In a case that promises to air dirty laundry at the FBI’s Philadelphia office, a woman who once headed the office's computer unit charged Thursday that she was a victim of sexual discrimination when she was demoted and replaced with a male employee.

The civil trial before U.S. District Judge J. Curtis Joyner focused on why computer specialist Megan Lampinski was moved out of her job as a supervisor of the information technology division in 2008.

Lampinski’s civil rights lawsuit charges that FBI officials repeatedly violated the bureau’s policies, first in removing her and then in an effort to cover up the initial policy violations

An NYPD sergeant who raped and sexually abused a 13-year-old girl scored a soft sentence Monday of only three years in prison — one year for each attack.

Vladimir Krull, a 12-year veteran of the department assigned to the Midtown North precinct, first kissed the teen on the mouth in September 2013, prosecutors said.

The victim was the daughter of Krull’s then-girlfriend.


Following a four-week trial in January a Bronx jury found Krull, 39, guilty of having sex with the victim twice — in her home and in his car.

A Texas state representative proposed a satirical anti-choice bill mimicking a 2011 law that ordered women to receive a sonogram while hearing “a detailed description of the fetus before getting an abortion," according to the Dallas News.

Hoping to shed light on the sensitive topic, Jessica Farrar (D-Houston) suggested men be required to pay fines for "unregulated masturbatory emissions.”

If the legislation passes, men would also be subject to a rectal examination in order to be prescribed Viagra or undergo vasectomy and colonoscopy procedures.

Editorial: ATF tobacco investigation scheme needs scrutiny

It’s getting harder and harder to tell the good guys from the bad guys.
First there was the scandal involving federal agents who helped route guns to Mexican drug cartels. Then it was revealed that law enforcement officials nationwide have routinely abused forfeiture laws to seize the property of law-abiding citizens.
Now there are signs that agents from the federal Bureau of Alcohol, Tobacco, Firearms and Explosives used highly questionable — arguably illegal – cigarette sales in order to fund a secret bank account used to pay informants.
And we’re not talking about a handful of rogue agents raising a few thousand dollars. The evidence points to tens of millions of dollars being raised by law enforcement officials through the same schemes used by the criminals they were supposed to be apprehending.
The operation, detailed in a recent report from the New York Times, wasn’t authorized by the Justice Department, the agency under which the ATF operates, and that appears to have been by design. It gave agents access to a bank account that, because it was off the books, wasn’t subject to the usual level of oversight.
The scheme itself was built on a complex series of transactions, some of which involved the sale and shipment of water and snacks disguised as cigarettes.
According to court records, one deal involved a pair of ATF informants, both of whom were supposedly working for the tobacco farmers’ cooperative, secretly buying cigarettes at $15 a carton and then selling them to the cooperative at the inflated price of $17.50 per carton, generating $519,000 in profit. That money was routed to the secret ATF bank account which was used to pay for tens of thousands of dollars’ worth of iPads, flat-screen televisions and other gifts doled out to potential targets of ATF investigations.
One of the most alarming aspects of this scheme is that it wasn’t disclosed by whistleblowers at the ATF or by the Justice Department’s internal watchdogs. It surfaced only because a collective of tobacco farmers became suspicious and filed a lawsuit alleging they had been cheated out of at least $24 million.
In fact, when the tobacco farmers first realized what was up, they didn’t just file a lawsuit, they reported their findings to the Justice Department, which chose not to file any charges.

One of the many pressing stories that remains to be told from the Snowden archive is how western intelligence agencies are attempting to manipulate and control online discourse with extreme tactics of deception and reputation-destruction. It’s time to tell a chunk of that story, complete with the relevant documents.

Over the last several weeks, I worked with NBC News to publish a series of articles about “dirty trick” tactics used by GCHQ’s previously secret unit, JTRIG (Joint Threat Research Intelligence Group). These were based on four classified GCHQ documents presented to the NSA and the other three partners in the English-speaking “Five Eyes” alliance. Today, we at the Intercept are publishing another new JTRIG document, in full, entitled “The Art of Deception: Training for Online Covert Operations.”

By publishing these stories one by one, our NBC reporting highlighted some of the key, discrete revelations: the monitoring of YouTube and Blogger, the targeting of Anonymous with the very same DDoS attacks they accuse “hacktivists” of using, the use of “honey traps” (luring people into compromising situations using sex) and destructive viruses. But, here, I want to focus and elaborate on the overarching point revealed by all of these documents: namely, that these agencies are attempting to control, infiltrate, manipulate, and warp online discourse, and in doing so, are compromising the integrity of the internet itself.

Among the core self-identified purposes of JTRIG are two tactics: (1) to inject all sorts of false material onto the internet in order to destroy the reputation of its targets; and (2) to use social sciences and other techniques to manipulate online discourse and activism to generate outcomes it considers desirable. To see how extremist these programs are, just consider the tactics they boast of using to achieve those ends: “false flag operations” (posting material to the internet and falsely attributing it to someone else), fake victim blog posts (pretending to be a victim of the individual whose reputation they want to destroy), and posting “negative information” on various forums. Here is one illustrative list of tactics from the latest GCHQ document we’re publishing today:

THE FBI'S HISTORY OF SPYING ON JOURNALISTS

While we were all shocked, shocked to discover that the FBI secretly subpoenaed phone records from the Associated Press as part of a leak investigation, it's only the latest in a history of such collisions between the First Amendment and the Bureau's information collection techniques.

The FBI's spying on journalists is a generational problem going back at least to the 1940s -- every generation has its tale. I hate to be the guy who brings up COINTELPRO, but, well, I just did. The scope of the meddling with journalism in that case went beyond simple spying.

The much-vaunted reforms of the post-Watergate era didn't eliminate the tension between the FBI and journalism so much as it bureaucratized it. The FBI created a sensitive informant program that was applied during the 1980s and 1990s to sources within newspapers, television stations, and even extended past that to informants working in the offices of judges and congressmen. That program is currently the subject of a FOIA lawsuit by Jesse Trentadue that journalists interested in this issue would do well to follow. As exhibits in that case, Trentadue has submitted a number of FBI documents related to the program and highly redacted manuals describing its use, which should make for interesting reading.

The FBI's subpoena of Associated Press phone records was sweeping and shocking, but not unprecedented. The bureau, and presumably other U.S. intelligence-gathering agencies, are constantly redefining what's fair game in the world of journalism to fit the public relations demands of a new generation, but this tension has existed for decades without clear resolution. Perhaps it's time to stop treating this issue as if it was born anew every 10 years, but to tackle it with a longer view as a persistent problem, with an eye toward what has worked and what hasn't over the course of generations.

Police and military death squads killed 36 in El Salvador

SAN SALVADOR, El Salvador (AP) — Federal prosecutors in El Salvador say four National Civil Police officers and 15 soldiers participated in death squads that killed 36 people.

Prosecutor Walter Ruiz said Wednesday that arrest warrants were issued for the government agents and nearly three dozen civilians who allegedly participated in the killings. The suspects also allegedly robbed banks.

The killings occurred between 2014 and 2016. Some victims were alleged gang members while other killings appeared to be contract hits.

FBI Budget Request for Fiscal Year 2018
Good morning Chairman Culberson, Ranking Member Serrano, and members of the subcommittee.

Thank you for allowing me to appear before you today and for your continued support of the FBI during this time of transition. The FBI especially thanks this committee for its support of the men and women of the FBI in the fiscal year (FY) 2017 appropriation. As the committee is aware, FBI personnel are the lifeforce of the organization—they work tirelessly to combat some of the most complex and serious national security threats and crime problems challenging the nation’s intelligence and law enforcement communities. Today, I appear before you on behalf of these men and women who step up to these threats and challenges every day. I am extremely proud of their service and commitment to the FBI’s mission and to ensuring the safety and security of communities throughout our nation. On their behalf, I would like to express my appreciation for the support you have given them in the past, ask for your continued support in the future, and pledge to be the best possible stewards of the resources you provide.

I would like to begin by providing a brief overview of the FBI’s FY 2018 budget request, and then follow with a short discussion of key threats and challenges that we face, both as a nation and as an organization.

FY 2018 Budget Request Overview

The FY 2018 budget request proposes a total of $8.77 billion in direct budget authority to carry out the FBI’s national security, criminal law enforcement, and criminal justice services missions. The request includes a total of $8.7 billion for salaries and expenses, which will support 33,533 positions (12,484 special agents, 2,950 intelligence analysts, and 18,099 professional staff), and $51.9 million for construction.

Eight program enhancements totaling $117.6 million are proposed to meet critical requirements and close gaps in operational capabilities, including $41.5 million to enhance cyber investigative capabilities, $19.7 million to mitigate threats from foreign intelligence services and insiders, $21.6 million for operational technology investments related to the “Going Dark” initiative and other investigative technology, $6.8 million to combat transnational organized crime, $3.5 million to support the FBI’s participation in the recently stood-up task force on violent crime and gun-related crime reduction and implementation of the recommendations that will flow from the task force, $8.2 million for physical surveillance capabilities, $8.9 million to improve the timeliness and accuracy of National Instant Criminal Background Check System (NICS) services and enhance the ability to recruit and retain the specialized NICS examiner workforce, and $7.4 million for operation and maintenance costs of the new Biometrics Technology Center.

The FY 2018 request also proposes cancellations, offsets, and reductions totaling $211.5 million, including $195 million from Criminal Justice Information Services (CJIS) surcharge fee fund balances and a permanent program reduction of $16.5 million from the Secure Work Environment (SWE) Program, which, if necessary, can draw upon account balances to provide additional SWE space.

The FY 2018 request represents a decrease of $44.6 million for the salaries and expenses portion of the FBI budget and over 1,600 fewer positions, which is in line with a Department-wide recalibration of personnel levels. The FY 2018 request represents an 83 percent, or $368 million, decrease from the FBI’s construction account reflecting the non-recur of one-time construction project funding.

Key Threats and Challenges

This committee has been imperative in providing critical resources for the FBI to become what it is today—a threat-focused, intelligence-driven organization. Our nation continues to face a multitude of serious and evolving threats ranging from homegrown violent extremists to hostile foreign intelligence services and operatives; from sophisticated cyber-based attacks to Internet-facilitated sexual exploitation of children; from violent gangs and criminal organizations to public corruption and corporate fraud. Keeping pace with these threats is a significant challenge for the FBI. As an organization, we must be able to stay current with constantly changing and new technologies that make our jobs both easier and harder. Our adversaries—terrorists, foreign intelligence services, and criminals—take advantage of modern technology, including the Internet and social media, to facilitate illegal activities, recruit followers, encourage terrorist attacks and other illicit actions, and to disperse information on building improvised explosive devices and other means to attack the U.S. The breadth of these threats and challenges are as complex as any time in our history. And the consequences of not responding to and countering threats and challenges have never been greater.

The support of this committee in helping the FBI to do its part in facing and thwarting these threats and challenges is greatly appreciated. That support is allowing us to establish strong capabilities and capacities for assessing threats, sharing intelligence, leveraging key technologies, and—in some respects, most importantly—hiring some of the best to serve as special agents, intelligence analysts, and professional staff. We have built and are continuously enhancing a workforce that possesses the skills and knowledge to deal with the complex threats and challenges we face today—and tomorrow. We are building a leadership cadre that views change and transformation as a positive tool for keeping the FBI focused on the key threats facing our nation.

Today’s FBI is a national security and law enforcement organization that uses, collects, and shares intelligence in everything we do. Each FBI employee understands that to defeat the key threats facing our nation, we must constantly strive to be more efficient and more effective. Just as our adversaries continue to evolve, so, too, must the FBI. We live in a time of acute and persistent terrorist and criminal threats to our national security, our economy, and our communities. These diverse threats underscore the complexity and breadth of the FBI’s mission: to protect the American people and uphold the Constitution of the United States.

National Security

Counterterrorism

Preventing terrorist attacks remains the FBI’s top priority. The terrorist threat against the United States remains persistent and acute.

From a threat perspective, we are concerned with three areas in particular: (1) those who are inspired by terrorist propaganda and feel empowered to act out in support; (2) those who are enabled to act after gaining inspiration from extremist propaganda and communicating with members of foreign terrorist organizations who provide guidance on operational planning or targets; and (3) those who are directed by members of foreign terrorist organizations to commit specific, directed acts in support of the group’s ideology or cause. Prospective terrorists can fall into any of the above categories or span the spectrum, but in the end the result is the same—innocent men, women, and children killed and families, friends, and whole communities left to struggle in the aftermath

In this endeavor, our main focus is the so-called Islamic State—the group we refer to as ISIS. ISIS has proven relentless in its campaign of violence and has aggressively promoted its hateful message, attracting like-minded extremists, to include Westerners. Though many foreign terrorist organizations use various digital communication platforms to reach individuals they believe may be susceptible and sympathetic to extremist messages, no group has been as successful at drawing people into its perverse ideology as ISIS. ISIS’ extensive reach through the Internet and social media is most concerning as the group continues to aggressively employ the latest technology as part of its nefarious strategy. ISIS’ messaging effectively blends both officially endorsed and informal propaganda to recruit followers via numerous digital communication platforms. Due to many technological advances, the message of radicalization spreads faster than we imagined just a few years ago. Like never before, social media allows foreign terrorists to reach into our local communities—for the purpose of targeting our citizens to radicalize and recruit them.

As the threat to harm the United States and U.S. interests evolves, we must adapt and confront these challenges, relying heavily on the strength of our federal, state, local, and international partnerships. The FBI is using all lawful investigative techniques and methods to combat these terrorist threats to the United States, including both physical and electronic surveillance. Physical surveillance is a critical and essential tool in detecting, disrupting, and preventing acts of terrorism, as well as gathering intelligence on those who are capable of doing harm to the nation. To this end, the FY 2018 request includes 78 positions and $8.2 million to address the increasing demand for physical surveillance support.

Along with our domestic and foreign partners, we are collecting and analyzing intelligence concerning the ongoing threat posed by foreign terrorist organizations and homegrown violent extremists. We continue to encourage information sharing, which is evidenced through our partnerships with many federal, state, local, and tribal agencies assigned to more than 180 Joint Terrorism Task Forces around the country.

Be assured, the FBI continues to strive to work and share information more efficiently, and to utilize the full suite of lawful methods available to help stay ahead of threats to the homeland.

Counterintelligence

The nation faces a continuing threat, both traditional and asymmetric, from hostile foreign intelligence agencies. Traditional espionage, often characterized by career foreign intelligence officers acting as diplomats or ordinary citizens, and asymmetric espionage, typically carried out by students, researchers, or businesspeople operating front companies, is prevalent. Foreign intelligence services not only seek our nation’s state and military secrets, but they also target commercial trade secrets, research and development, and intellectual property, as well as insider information from the federal government, U.S. corporations, and American universities. Foreign intelligence services continue to employ more creative and more sophisticated methods to steal innovative technology, critical research and development data, and intellectual property, in an effort to erode America’s economic leading edge. These illicit activities pose a significant threat to national security and continue to be a priority and focus of the FBI.

A particular focus of our counterintelligence efforts are aimed at the growing scope of the insider threat—that is, when trusted employees and contractors use their legitimate access to steal secrets for personal benefit or to benefit another company or country. This threat has been exacerbated in recent years as businesses have become more global and increasingly exposed to foreign intelligence organizations.

To combat this threat, the FBI has undertaken several initiatives. We developed and deployed the Hybrid Threat Center (HTC) to support Department of Commerce Entity List investigations. The HTC is the first of its kind in the FBI; it has been well-received in the U.S. Intelligence Community and the private sector.

Over the past year, we have strengthened collaboration, coordination, and interaction between our Counterintelligence and Cyber Divisions in an effort to more effectively identify, pursue, and defeat hostile intelligence services using cyber means to penetrate or disrupt U.S. government entities or economic interests.

Finally, we have initiated a media campaign to increase awareness of the threat of economic espionage. As part of this initiative, we have made a threat awareness video available on our public website, which has been shown thousands of times to raise awareness and generate referrals from the private sector.

The FY 2018 request includes 93 positions and $19.7 million to combat these foreign intelligence threats.

Cyber Threats

Virtually every national security threat and crime problem the FBI faces is cyber-based or facilitated. We face sophisticated cyber threats from state-sponsored hackers, hackers for hire, organized cyber syndicates, and terrorists. On a daily basis, cyber-based actors seek our state secrets, our trade secrets, our technology, and our ideas—things of incredible value to all of us and of great importance to the conduct of our government business and our national security. They seek to strike our critical infrastructure and to harm our economy.

FBI agents, analysts, and computer scientists are using technical capabilities and traditional investigative techniques—such as sources, court-authorized electronic surveillance, physical surveillance, and forensics—to fight the full range of cyber threats. As we continue to see an increase in the scale and scope of reporting of malicious cyber activity that can be measured by the amount of corporate data stolen or deleted, personally identifiable information compromised, or remediation costs incurred by U.S. victims, the FBI has actively coordinated with our private and public partners to pierce the veil of anonymity surrounding cyber-based crimes.

As the committee is well aware, the frequency and impact of cyber-attacks on our nation’s private sector and government networks have increased dramatically in the past decade and are expected to continue to grow. We need to be able to move from reacting to cyber attacks after the fact to operationally preventing such attacks. That is a significant challenge, but one we embrace.

The FBI is engaged in a myriad of efforts to combat cyber threats, from efforts focused on threat identification and sharing inside and outside of government, to our internal emphasis on developing and retaining new talent and changing the way we operate to evolve with the cyber threat. The FY 2018 budget request includes an enhancement of 36 positions and $41.5 million to support these efforts.

Going Dark

The rapid pace of advances in mobile and other communication technologies continue to present a significant challenge to conducting court-ordered electronic surveillance of criminals and terrorists. There is a real and growing gap between law enforcement’s legal authority to access digital information and its technical ability to do so. The FBI refers to this growing challenge as “Going Dark,” and it affects the spectrum of our work. In the counterterrorism context, for instance, our agents and analysts are increasingly finding that communications and contacts between groups like ISIS and potential recruits occur in encrypted private messaging platforms. Some of our criminal investigators face the challenge of identifying online pedophiles who hide their crimes and identities behind layers of anonymizing technologies, or drug traffickers who use virtual currencies to obscure their transactions. In other investigations, ranging from white-collar crime to gang activity, FBI agents with court-ordered search warrants seize and attempt to search cellular phones, tablets, and other electronic devices, but are unable to access them due to technical barriers.

In just the first half of this fiscal year, the FBI was unable to access the content of more than 3,000 mobile devices submitted for analysis by FBI field agents and our law enforcement partners using appropriate and available technical tools, even though there was legal authority to do so. This figure represents nearly half of all the mobile devices the FBI attempted to access in that timeframe.

Where at all possible, our agents develop investigative workarounds on a case-by-case basis, including by using physical world techniques and examining non-content sources of digital information (such as metadata). As an organization, the FBI also invests in alternative methods of lawful engineered access.

Ultimately, these efforts, while significant, have severe constraints. Non-content information, such as metadata, is often simply not sufficient to meet the rigorous constitutional burden to prove crimes beyond a reasonable doubt. Developing alternative technical methods is typically a time-consuming, expensive, and uncertain process. Even when possible, such methods are difficult to scale across investigations—and jurisdictions—and may be perishable due to a short technical lifecycle or as a consequence of disclosure through legal proceedings.

Some observers have conceived of this challenge as a trade-off between privacy and security. In our view, the demanding requirements to obtain legal authority to access data—such as by applying to a court for a warrant or a wiretap—necessarily already account for both privacy and security. The FBI is actively engaged with relevant stakeholders, including companies providing technological services, to educate them on the corrosive effects of the Going Dark challenge on both public safety and the rule of law. The FY 2018 request includes 80 positions and $21.6 million for these efforts and to improve investigative technology.

Criminal Threats

We face many criminal threats, from complex white-collar fraud in the financial, health care, and housing sectors to transnational and regional organized criminal enterprises to violent crime and public corruption. Criminal organizations—domestic and international—and individual criminal activity represent a significant threat to our security and safety in communities across the nation.

A key tenet of protecting the nation from those who wish to do us harm is the National Instant Criminal Background Check System, or NICS. The goal of NICS is to ensure that guns don’t fall into the wrong hands and also ensures the timely transfer of firearms to eligible gun buyers. Mandated by the Brady Handgun Violence Prevention Act of 1993 and launched by the FBI on November 30, 1998, NICS is used by Federal Firearms Licensees (FFLs) to instantly determine whether a prospective buyer is eligible to buy firearms. NICS receives information from FFLs and checks to ensure that applicants do not have a criminal record or aren't otherwise prohibited and therefore ineligible to purchase a firearm. In the first complete month of operation in 1998, a total of 892,840 firearm background checks were processed; in 2016, approximately 2.3 million checks were processed per month.

In 2016, NICS processed 27.5 million checks—an increase of 19 percent over 2015. While most checks are completed by electronic searches of the NICS database within minutes, a small number of checks require examiners to review records and resolve missing or incomplete information before an application can be approved or rejected. Ensuring the timely processing of these inquiries is important to ensure law abiding citizens can exercise their right to purchase a firearm and to protect communities from prohibited and therefore ineligible individuals attempting to acquire a firearm. The FBI is currently processing a record number of checks, averaging over 2.1 million a month during the first five months of 2017. The FY 2018 request includes 85 positions and $8.9 million to annualize the salaries of examiners and contractors brought on in FY 2017 to process the increase in NICS checks, enhance the responsiveness of the NICS program, and enhance our ability to recruit and retain the specialized NICS examiner workforce.

Violent Crime

Violent crimes and gang activities exact a high toll on individuals and communities. Many of today’s gangs are sophisticated and well organized and use violence to control neighborhoods and boost their illegal money-making activities, which include robbery, drug and gun trafficking, fraud, extortion, and prostitution rings. These gangs do not limit their illegal activities to single jurisdictions or communities. The FBI is able to work across such lines, which is vital to the fight against violent crime in big cities and small towns across the nation. Every day, FBI special agents work in partnership with federal, state, local, and tribal officers and deputies on joint task forces and individual investigations.

FBI joint task forces—Violent Crime Safe Streets, Violent Gang Safe Streets, and SafeTrails—focus on identifying and targeting major groups operating as criminal enterprises. Much of the FBI criminal intelligence is derived from our state, local, and tribal law enforcement partners, who know their communities inside and out. Joint task forces benefit from FBI surveillance assets, and our sources track these gangs to identify emerging trends. Through these multi-subject and multi-jurisdictional investigations, the FBI concentrates its efforts on high-level groups engaged in patterns of racketeering. This investigative model enables us to target senior gang leadership and to develop enterprise-based prosecutions.

In March of this year, the attorney general issued a memorandum directing federal prosecutors to focus on violent crime offenders. To support this effort, he also established a task force on crime reduction and public safety composed of Department of Justice (the Department) representatives, including all four Department law enforcement agencies. These representatives are being tasked with making recommendations to the attorney general on ways in which the federal government can most effectively combat violent crime. The FY 2018 request includes 33 positions and $3.4 million to support the FBI’s participation and assist with the implementation of recommendations from this task force.

Transnational Organized Crime

More than a decade ago, organized crime was characterized by hierarchical organizations, or families, that exerted influence over criminal activities in neighborhoods, cities, or states. But organized crime has changed dramatically. Today, international criminal enterprises run multi-national, multi-billion-dollar schemes from start to finish. Modern-day criminal enterprises are flat, fluid networks with global reach. While still engaged in many of the “traditional” organized crime activities of loan-sharking, extortion, and murder, modern criminal enterprises are targeting stock market fraud and manipulation, cyber-facilitated bank fraud and embezzlement, identity theft, human trafficking, and other illegal activities. Preventing and combating transnational organized crime demands a concentrated effort by the FBI and federal, state, local, tribal, and international partners.

While the FBI continues to share intelligence about criminal groups with our partners and combines resources and expertise to gain a full understanding of each group, the threat of transnational crime remains a significant and growing threat to national and international security with implications for public safety, public health, democratic institutions, and economic stability across the globe. The FY 2018 budget request includes 65 positions and $6.8 million to work towards disrupting—with the end goal of dismantling—the most culpable and high ranking transnational organized crime syndicates.

Key Cross-Cutting Capabilities and Capacities

I would like to briefly highlight some key cross-cutting capabilities and capacities that are critical to our efforts in each of the threat and crime problems described.

Operational and Information Technology

As criminal and terrorist threats become more diverse and dangerous, the role of technology becomes increasingly important to our efforts. We are using technology to improve the way we collect, analyze, and share information. We have seen significant improvement in capabilities and capacities over the past decade, but keeping pace with technology remains a key concern for the future.

For example, the new Biometrics Technology Center came online recently. This shared facility will enhance collaboration between the FBI’s Biometrics Center of Excellence and the Department of Defense’s (DOD) Biometrics Fusion Center. Together, these centers will advance centralized biometric storage, analysis, and sharing with federal, state, and local law enforcement partners, DOD, and others. The FY 2018 budget request includes $7.4 million to operate and maintain the FBI’s share of this facility.

FBI special agents and intelligence analysts need the best technological tools available to be responsive to the advanced and evolving threats that face our nation. Enterprise information technology must be designed so that it provides information to operational employees rather than forcing employees to conform to the tools available. IT equipment must be reliable and accessible, thus decreasing the time between information collection and dissemination.

Conclusion

In closing, the FBI cannot be content to just work what is directly in front of us. We must also be able to look beyond the horizon and build toward the future so that we are prepared to deal with the threats we will face at home and abroad and understand how those threats may be connected. Toward that end, intelligence is gathered, consistent with our authorities, to help us understand and prioritize identified threats and to determine where there are gaps. We then try to fill those gaps and continue to learn as much as we can about the threats we are addressing and those we may need to address. We do this for national security and criminal threats, on both a national and local field office level. We then compare the national and local perspectives to develop a threat prioritization ranking for each of the FBI’s 56 field offices. By creating this ranking, we strive to actively pursue our highest threats where they are occurring. This gives us a better assessment of what the dangers are, what’s being done about them, and what we should spend time and valuable resources on.

Being expected to respond to a wide range of complex and ever-changing threats and crime problems is not new to the FBI. Our success in meeting these challenges is, however, directly tied to the resources provided to the FBI. The resources the committee provides each year are critical for the FBI’s ability to address existing and emerging national security and criminal threats.

Chairman Culberson, Ranking Member Serrano, and members of the subcommittee, I would like to close by thanking you for this opportunity to discuss the FBI’s FY 2018 budget request and the key threats and challenges that we are facing, both as a nation and as an organization. We are grateful for the leadership that you and this subcommittee have provided to the FBI. We would not possess the capabilities and capacities to deal with these threats and challenges today without your support. Federal Law Enforcement Arrested for Trading in Child Rape


From the US Mint Police to the Amtrack Police, there are far more federal law enforcement agencies than most people realize. At last count, by the US Bureau of Justice Statistics in 2008, there were 73 federal law enforcement agencies employing approximately 120,000 full-time law enforcement officers, 84.5 percent of whom are men, with legal authority to make arrests and carry firearms. The Department of Homeland Security (DHS) and Department of Justice (DOJ) employed four out of every five federal law enforcement officers.
Because the US government is not keeping statistics on child pornography arrests and prosecutions, in particular of their own employees, to gather comprehensive data on all arrests of federal law enforcement officers is difficult. It would require examining annual Inspector General reports for every agency, filing numerous freedom of information requests, and reading, case by case, through thousands of federal child pornography prosecution documents available on PACER. Without institutional support, I haven’t been able to conduct this kind of necessary research. Instead, I’ve profile only 43 federal law enforcement employees arrested on child pornography related charges. It was noticeably more difficult to locate photographs of federal law enforcement officers than of local and state police or professors.
Department of Justice (DOJ)
In 2015, DOJ released, “The Handling of Sexual Harassment and Misconduct by the Department’s Law Enforcement Components,” detailing cases from 2009–2012 among federal law enforcement agencies under DOJ’s supervision.
The report begins with this disclaimer:
“The OIG’s ability to conduct this review was significantly impacted and delayed by the repeated difficulties we had in obtaining relevant information from both the FBI and DEA…. Initially, the FBI and DEA refused to provide the OIG with unredacted information that was responsive to our requests… despite the fact that the OIG is authorized under the Inspector General Act to receive such information. After months of protracted discussions with management at both agencies, the DEA and FBI provided the information without extensive redactions; but we found that the information was still incomplete. Ultimately, based on a review of information in the OIG Investigations Division databases, we determined that a material number of allegations from both DEA and FBI were not included in the original responses to our request for the information. We were also concerned by an apparent decision by DEA to withhold information regarding a particular open misconduct case. The OIG was not given access to this case file information until several months after our request, and only after the misconduct case was closed. Once we became aware of the information, we interviewed DEA employees who said that they were given the impression that they were not to discuss this case with the OIG while the case remained open. The OIG was entitled to receive all such information from the outset, and the failure to provide it unnecessarily delayed our work. Therefore, we cannot be completely confident that the FBI and DEA provided us with all information relevant to this review. As a result, our report reflects the findings and conclusions we reached based on the information made available to us.”
DOJ supervises the United States Marshals Service (USMS), the Federal Bureau of Investigation (FBI), the Drug Enforcement Administration (DEA), the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), and Federal Bureau of Prisons (BOP). Arrests of federal law enforcement under DOJ’s supervision, on child pornography related charges, include:
Federal Bureau of Investigation (FBI)
John Kenoyer, the late former FBI Bureau Chief in Augusta, Maine was

indicted, March 1986, on child sex abuse charges. Kenoyer had been raping, his children’s ten year old babysitter for over a year. He broke bond and went into hiding after his indictment. Kenoyer was located February 1987, and pleaded guilty to nine charges in June 1987 and was sentenced, September 1987, to nine months in jail followed by two years of house arrest. Kenoyer requested, and was approved by Maine Judge Donald Alexander, to spend his house arrest at Villa Apartments in Coeur D’Alene, Idaho; a complex with a swimming pool, jacuzzi and tennis court. Idaho; however, refused to accept Maine’s sex offender.
Keith Dietterle, a 28 year old FBI Analyst, was arrested, 23 November 2012,

on child pornography charges. He pleaded guilty and was sentenced, 11 September 2013, to more than three years in prison. Dietterle was caught when he sent child sex abuse images/videos to an undercover Washington DC Metro Police (MPD). The MPD officer was posing as a man sexually abusing his 3 year old nephew and 12 year old daughter. Dietterle described the rape of the children as “So hot man … how’d it start?” and discussed meeting the detective to abuse the three year old boy. Upon his arrest, the FBI terminated Dietterle’s employment. Dietterle is a registered sex offender.
Brian Haller, a 40 year old cyber-security expert contractor with the FBI,

was arrested, 13 April 2015, on child pornography charges. He was sentenced, 8 April 2016, to two days and one night in jail followed by ten years of supervised release.
Haller was caught in the FBI’s bust of a child rape website called PlayPen. At the time of his arrest he had over 600 files of child sex abuse. His on-line name was “jb” short for “jailbait.” Haller told investigators he liked to watch the abuse of children 12 to 14 years old and also younger children, including a 40-minute video in his possession showing the sexual abuse of an 11 year old girl. Haller was lead for the Seattle, Washington FBI/private-sector cyber-security group. He had access to a secure FBI on-line platform and email system.
Donald Sachtleben, a 54 year old former FBI Agent was arrested, 14 May

2012, and charged on child pornography charges. He pleaded guilty to distribution and possession and was sentenced, 14 November 2013, to eight years in prison. He was also sentenced to charges of disclosing and possessing classified information. At the time of his arrest, Sachtleben was Director of Training at the Center for Improvised Explosives at Oklahoma State University. He was employed with the FBI from 1983 to 2008, as a bomb technician and counter-terrorism investigator. Sachtleben had been using the handle pedodave69@yahoo.com when he was caught sending images of child sex abuse. He wrote, “Saw your profile on (a file sharing network). Hope you like these and can send me some of ours (sic). I have even better ones if you like.”
Samuel Kaplan, a 64 year old FBI information technology program manager, was arrested and pleaded guilty, 3 June 2010, to child pornography possession. Kaplan was sentenced, 27 August 2010, to just under four years in jail followed by 15 years of supervised release. Kaplan worked in the FBI’s Chantilly, Virginia office and used “the FBI’s network to facilitate sexually explicit communications.” He was also trading in child rape from his home computer.
Michael Peluso, a 44 year old FBI Civilian Analyst with an undercover unit in

Critical Incident Response Group, was arrested, 9 January 2015, on child pornography charges. He pleaded guilty and was sentenced, 27 May 2016, to no jail time and supervised parole for life.
Peluso was caught trading child rape on-line by an Internet Crimes Against Children (ICAC) Taskforce investigation.
United States Marshals Service (USMS)
Christopher W. McKee, a 37 year old intelligence analyst with the US

Marshals, was arrested on three counts of child pornography. McKee pleaded guilty, April 2013, and was sentenced, 15 August 2013, to five years probation with no jail time. McKee maintained a collection of child sex abuse on CDs labelled “teens” and “teen sluts” in his Arlington, Virginia office and also

Michael D. Rivera, a 29 year old Deputy US Marshal, was arrested on more than 20 charges including child pornography charges. He pleaded guilty,

Rivera is being held in custody, pending sentencing, currently set in the state case for 13 June 2017, and 17 May 2017, for the federal charges. Rivera was caught for trading in child rape when he was discovered pushing his cell phone under dressing rooms in clothing store changing rooms where

Matthew Barnes, a 34 year old DEA Agent, was arrested, March 2012, on

child pornography charges. He pleaded guilty, June 2015, and was sentenced, August 2015, to just over 5 years in jail followed by five years of supervised release. Barnes was using his government computer to trade in child rape. Barnes was also a member of the Missouri National Guard. Barnes must register as a sex offender.
Darren Argento, a 47 year old, DEA Agent, was arrested, August 2010, for

child pornography possession and distribution. He was sentenced, 17 August 2011, to 7 months in jail followed by five months of supervised release. At the time of his arrest, Argento had over 73,000 images and over 723 videos of child rape, including of children as young as seven years old. He was caught when he brought his personal laptop, filled with child rape, to the DEA office and asked an IT employee for help backing up files. The IT expert reported the child pornography. Argento is listed as a registered sex offender.
James Patrick Burke, a 39 year old DEA Agent, was arrested, 14 August 2015, on child pornography charges. He pleaded guilty, 2 June 2016, and was sentenced, 6 April 2017, to seven years in jail followed by 15 years of supervised release. At the time of his arrest, Burke had over 2,760 images/videos of the rape and torture of children, including infants and toddlers and children being raped when bound and gagged. Burke must register as a sex offender.
Scott Whitcomb, a 48 year old DEA Agent, was arrested, December 2011,

on child pornography production charges. He was sentenced, July 2011, to 25 years in jail. Whitcomb had been producing and distributing sex abuse of boys under sixteen years old since 2007. He lured boys to his house with video games and pornography magazines and then, often violently, sexually abused the boys. He had been an Air Marshal, a police officer and a prison guard before joining the DEA.
Department of Homeland Security
Homeland has refused to maintain, and make public, records of employee misconduct. No one knows how many Homeland Security employees have been arrested on child pornography charges. In response to Senator Grassley’s constant requests for information, Homeland’s Inspect General, in 2014, reported that five employees under Homeland’s supervision had been arrested between 1 April 2014–30 September 2014. That information, without any details of the arrests, is listed here.

Former FBI agent arrested on child pornography charges
INDIANAPOLIS, Indiana - Federal investigators have arrested 54-year-old Donald Sachtleben, an Oklahoma State University visiting professor with an FBI career spanning 25 years, for child pornography charges.

Investigators said they were led to Sachtleben last fall when they found a computer of an Illinois man who was arrested for trading child porn. Data from that computer were traced back to Sachtleben, who allegedly had 30 images and video files of child pornography.

His attorney, Kathleen Sweeney, told The Associated Press that a not guilty plea was entered Monday. According to his LinkedIn profile, Sachtleben served as a bomb technician for the FBI between 1983 and 2008. Sweeney said he was involved in the Oklahoma City bombing and Unabomber investigations. He had a distinguished career with no suggestion of any inappropriate behavior.

Sachtleben is jailed and awaiting a hearing on Thursday. If convicted, he could face up to 30 years in prison for possessing and distributing child pornography.

Starting this week, Film Forum is presenting “Ford to City: Drop Dead — New York in the ’70s,” a series devoted to the classic, history-making movies made during some of the city’s darkest years. To go with the retrospective, we will be sharing some of the stories and reviews that ran in the Village Voice during this time.

Al Pacino and Sidney Lumet’s hit 1973 film, Serpico, about the undercover cop who exposed police corruption and criminality in the NYPD in the late Sixties and Seventies, was one of the seminal movies of this era. And in its February 3, 1975, issue, the Voice ran a lengthy letter from Frank Serpico himself, who at that time was living in the Netherlands. In the letter, written with the help of the Voice’s Lucian K. Truscott IV, Serpico offers his thoughts on the film, the politics of the day, his fellow cops’ response to him, and the issues of police brutality and racism that continued to plague the force, and in many ways still do so today.

The piece also included a sidebar by Truscott about the circumstances that led to the Serpico letter. It also featured some of the correspondence Serpico had himself received, including a threatening one, filled with racist invective, from an “Ex-policeman in New York.”

ArizonaWatch.org, is the primary website for The Arizona Center for Investigative Journalism, Inc.

The Center is a 501(c)3 nonprofit Arizona corporation and will not engage in any form of political advocacy. The Center received formal approval from the IRS in January 2014 and all contributions are fully tax deductible.

The Center’s mission is to conduct independent investigative reporting on matters of the highest public interest and disseminate the information to the general public through the ArizonaWatch.org website, documentary films and published reports.

A recent example of investigative reporting supported by the Center is InvestigativeMEDIA’s investigation of the Yarnell Hill Fire that killed 19 members of the Granite Mountain Hotshots on June 30, 2013.

The Center will help fill the increasing void of investigative reporting resulting from the collapse of the traditional newspaper industry.

The Center may enter into agreements with major media outlets and university journalism schools to conduct joint investigative reporting projects for publication on the Center’s website and with media and university partners.

The Center will also provide an important training ground for young journalists on state and federal public records laws, open meetings laws and access to business information.

The Center will focus on major investigative reporting projects and will not cover day-to-day events. However, the Center will report on the underlying issues that shape much of the daily news coverage.

Energy production and distribution, natural resource exploitation, water supplies and distribution, environmental issues, urban growth and development, transportation, international trade, immigration policies, criminal justice issues, public and private education and campaign finance are among the topics the Center will

Assistant Sheriff in Orange County Says the System Failed

SANTA ANA, Calif. (CN) — For years, the sheriff’s department in Orange County, California, had a “failed system” that allowed deputies to use jail informants to violate the constitutional rights of criminal suspects, an assistant sheriff testified Thursday.

“During that period of time, we had a failed system,” Assistant Sheriff Adam Powell told Superior Court Judge Thomas Goethals. “We had no policy and worse protocols.”

Powell’s testimony came in an evidentiary hearing to determine whether convicted mass murderer Scott DeKraai should be spared the death penalty for killing his ex-wife and seven others at a beauty parlor in 2011.

DeKraai’s attorney, Assistant Public Defender Scott Sanders, says the sheriff department’s improper use of informants to obtain incriminating statements justifies the restriction on sentencing.

Sanders’ allegations against the sheriff’s and the Orange County district attorney’s offices — which he first laid out in a 505-page motion in January 2014 — set off a continuing controversy in the county and led Judge Goethals to remove the district attorney as DeKraai’s prosecutor in November last year. The California Attorney General’s Office has taken over the case.

Powell’s testimony in some ways contradicted that of his boss, Sheriff Sandra Hutchens, who testified Wednesday that while “a few” deputies in the jails may have violated the law, the practice was not widespread.

“There is no jailhouse informant program … that is not in accordance with the rules,” Hutchens testified.

But Powell told Goethals that the department’s “whole process [for informants] was failed.”

He said the deputies in the jails’ Special Handling Unit, who cultivated and developed informants, were doing what their supervisors wanted them to do.

“Deputies were working on their assigned duties and doing their job, and, as you very well know, they received accolades,” he told Sanders in court.

The most dangerous man in the Trump administration isn't Steve Bannon or Jeff Sessions or even the President himself.

Instead, it's a sleazy, creepy lawyer who died 30 years ago, and his name is Roy Cohn.

It's not nice to criticize the dead, but in Cohn's case, I'll make an exception.

Back in the 1950s, Cohn was chief counsel for Senator Joe McCarthy, when McCarthy was destroying the lives of thousands by claiming they were Communists.

Cohn's next stop was the espionage trial of Julius and Ethel Rosenberg.

Were they spies? Probably. Did they deserve the death penalty? Historians say it's an open question, but most agree that Roy Cohn's improper actions during the trial led the Rosenbergs to their electrocution.

At parties in Manhattan, Cohn would tell people that when he was a kid, he used to swim in the Hudson River.

"But it's so disgusting and dirty!" his listeners would exclaim.

To this out-of-towner, NYC pedestrians seem almost suicidal
He would reply with a sly grin, "How do you think it got that way?"

Fast-forward two decades and this same sleazeball becomes the attorney for none other than a young Donald Trump.

In 1973, the Justice Department accused the Trump Organization of violating the Fair Housing Act by denying African Americans the opportunity to rent apartments.

Roy Cohn, Trump's attorney and a notorious counterpuncher, sued the government for $100 million, claiming the charges were baseless.

The lawsuit failed, but the strategy won.

Trump skated.

He also learned a tremendous lesson — if somebody hits you, hit him back ten times harder, even when you're wrong.

Especially when you're wrong.

Sound familiar?

When Trump was just a businessman, how he behaved didn't matter — except, of course, to the businesses he fleeced while alternating between growing his empire and going bankrupt.

We saw vestiges of Roy Cohn in Trump's presidential campaign, where he would ignore potential opponents until they attacked him, and then he would attack them with endless brutality.

We're seeing the same thing today — the same brutal counterpunching tactics Trump learned at Roy Cohn's feet.

The biggest victim in all of this?

Civility.

We are turning into a nation of Roy Cohns, snarling first and asking questions later.

It's not just celebrities, like the alleged comedienne who tweeted a photo of a decapitated Trump, or the Public Theater, turning Julius Caesar into a play about wishful thinking of the death of the President.

It's in the way regular people treat each other.

And it's not just one deranged gunman trying to mow down Republican Congressmen on a baseball diamond.

It's all of us.

It just feels like civility is vanishing from society.

It seems like wherever you go, on the highway, on Manhattan sidewalks, everywhere, people have less patience for each other.

Trump recently described the House bill to replace Obamacare as "mean."

But what's really become mean is we, the people.

It's just ugly out there.

I can't point to statistics and surveys. I can just tell you what I'm seeing.

People are emulating our President.

They're getting nasty.

They're getting short with each other.

As the President himself would tweet, sad.

Alex Fitzsimmons was Manager of Policy and Public Affairs at the Institute for Energy Research (IER) and its advocacy arm, the American Energy Alliance (AEA), while also working as a “spokesman” and communications director for Fueling US Forward (FUSF), the Koch-funded campaign to bolster public opinion of fossil fuels.

Fitzsimmons will be joining former IER colleagues Daniel Simmons and Travis Fisher at the DOE.

Dakota Access Security Firm’s Top Adviser Led Military Intelligence Efforts for 1992 LA Riots

Retired Major General James “Spider” Marks chairs the advisory board for TigerSwan, a private security firm hired by Energy Transfer Partners to help police protests of the Dakota Access pipeline — an approach for which Marks has shown vocal support.

DeSmog has found that Marks also headed up intelligence efforts for the task force which brought over 10,000 U.S. military troops to police the 1992 riots following the acquittal of Los Angeles Police Department members involved in beating Rodney King. In addition, Marks, a long-time military analyst for CNN, led intelligence-gathering efforts for the U.S.military’s 2003 “shock and awe” campaign in Iraq, which was dubbed “Operation Iraqi Liberation.”

In recent months, Marks has endorsed Dakota Access and its southern leg, the Bayou Bridge pipeline. He has shown this support by writing op-ed pieces published in various newspapers and on the website of a pro-Dakota Access coalition run by a PR firm funded by Energy Transfer Partners.

“I spent a good portion of my adult life in Iraq, and I must tell you that the similarities are stark,” Marks said in November of the anti-Dakota Access encampment set up by the Standing Rock Sioux Tribe.

Marks, according to The Washington Times, traveled to Standing Rock “as an adviser to the Midwest Alliance for Infrastructure Now” (MAIN), a pro-pipeline front group run by the Republican Party public relations firm, DCI Group.

“General Marks is still an adviser to the coalition. He is given a modest stipend for his time and expertise,” DCI Group’s Craig Stevens told DeSmog of Marks’ relationship with MAIN. “TigerSwan is not a member of the Coalition nor does the Coalition receive any funding from them.” Stevens manages public relations efforts for MAIN and is the crisis management lead for DCI.

In February, Marks traveled to Louisiana to speak in favor of the Bayou Bridge pipeline at a Louisiana Department of Natural Resources hearing.

Neither Marks nor TigerSwan responded to requests for comment for this story. TigerSwan has recently come under fire by the North Dakota Private Investigative and Security Board for operating in the state without a permit, with the Board filing a legal complaint about the matter. Energy Transfer Partners says TigerSwan is no longer working on its behalf in North Dakota.

Pentagon Pundits

Among his numerous public appearances, writings, and television pit stops, Marks has failed to disclose his advisory board position for TigerSwan. Failure to disclose affiliations, though, is not unusual for Marks.

As a military pundit for CNN, both The New York Times and the watchdog group Public Accountability Initiative (PAI) have documented that Marks has often appeared on cable TV while not disclosing his ties to military weapons companies. The 2008 New York Times Pulitzer Prize-winning investigation — “Behind TV Analysts, Pentagon’s Hidden Hand” — covered Marks and explained that he and over 75 others were paid by the George W. Bush administration to give seemingly independent, pro-Iraq War analyses on cable TV outlets beginning in early 2002.

The catch: The public was never informed that these pro-war pundits were on the Pentagon’s payroll and often on the payroll of military weapons companies as well.

“To the public, these men are members of a familiar fraternity, presented tens of thousands of times on television and radio as ‘military analysts’ whose long service has equipped them to give authoritative and unfettered judgments about the most pressing issues of the post-Sept. 11 world,” wrote The Times. “Hidden behind that appearance of objectivity, though, is a Pentagon information apparatus that has used those analysts in a campaign to generate favorable news coverage of the administration’s wartime performance.”

The thousands of documents obtained for The New York Times investigation were organized and published online in a searchable format by the Center for Media and Democracy. Those memoranda, emails, and other materials offer an insightful window into the cozy relationships among the upper echelons of the U.S. media, the U.S. military, and the U.S.government. General Marks fits neatly in the intersection of these three entities.

In an email to Major General Donald Shepperd, Joy DiBenedetto, then Vice President of Network Booking and Research at CNN Worldwide, thanked Shepperd for putting her in contact with General Marks. She wrote, “you can always contact me for any CNN reason, and if I’m not the right person, I can certainly get you to the right person.”

In 2006 Marks traveled on a pro-Iraq War trip during his capacity as a Pentagon pundit. That trip was convened by the U.S.Department of Defense, and the Pentagon tried to have Marks ask CNN to foot his bill for travel expenses. Along with other retired military men-turned-analysts, Marks was part of a roundtable meeting with General David Petraeus in 2007, and participated in conference call discussions with Defense Department officials. Marks had his media appearances reviewed by the Office of the Secretary of Defense.

In PAI’s 2013 report, “Conflicts of interest in the Syria debate,” the watchdog group named 22 people serving as commentators on the issue of whether or not the U.S. should attack Syria for using chemical weapons on its own citizens. That report, paralleling The New York Times’ findings on the Iraq War, found numerous cases of undocumented conflicts of interest. The group of men, which once again included Marks, landed mainstream media pundit gigs on CNN, MSNBC, and FOX and wrote op-eds for Bloomberg and The Washington Post.

PAI noted in its report that out of 111 total appearances by the pundits in October 2013 alone, only 13 had mentioned their relationships to the defense industry. Marks appears on the list identified as the former Commander of the U.S. Army Intelligence Center. The list ties him into the defense sector by noting his position at Willowdale Services, a boutique consulting firm for the energy and national security industries.

In the documents obtained by The New York Times, a picture emerges of Marks’ advocacy for military intervention in Syria long before 2013. When asked by CNN in February 2007 to speak about the failed bombing attempt on Vice President Cheney, he told the network to “bear in mind you have Syria, which is to the west of Iraq, which is a safe haven for the introduction of new ideas and an opportunity for insurgents to go across that border, and refit, regroup, and reintroduce themselves into the fight.”

And just hours later on another CNN show, Marks made similar remarks about Pakistan, telling CNN’s Brian Todd that “what is significant is the proximity of Bagram Air Base to Pakistan, which is as the crow flies only 70 miles, as you can see right here from Bagram to Pakistan. The region right here is Waziristan. This is the root of the challenge.”

Marks also serves as a source for the private security firm Stratfor (Strategic Forecasting Inc.), according to a roster leaked to and published by Wikileaks. Stratfor’s past client list has included the American Petroleum Institute.

1992 LA Riots

Marks also headed up the Joint Task Force Los Angeles, assigned with cracking down on the violent 1992 riots which erupted in the aftermath of the Rodney King verdict. The task force operated under the authority of an executive order issued by then-President George H.W. Bush.

The mother of a man who was shot and killed in March during an encounter with Los Angeles County sheriff’s deputies has sued the county and the Sheriff’s Department, saying that deputies lacked proper training and used unnecessary force against her son, who suffered from a mental illness.

The civil rights lawsuit was filed Monday in U.S. District Court. It follows another federal lawsuit filed by the children of Dennis “Todd” Rogers, 41, who was shot by deputies the night of March 7 outside a 24 Hour Fitness gym in Ladera Heights.

Peter Morris, an attorney representing Rogers’ mother, said that Rogers had been asked to leave the gym, where he was a member. Rogers complied, but returned a few hours later and was shot and killed by one or more deputies, Morris said.

The lawsuit alleges that deputies attempted to shock Rogers with stun guns, and that Rogers was “unarmed and made no offensive moves towards the deputies when they killed him.”


“The sheriff’s deputies did not handle this situation in the proper way and as a result Todd is dead,” Morris said.

Rogers graduated from the University of Houston with a degree in accounting and finance, and he moved to Los Angeles from Houston around November 2015 to pursue a career in acting.

Janet Williams, Rogers’ mother, told reporters at a news conference outside the federal courthouse downtown that Rogers had called her every day, telling her about his auditions. Williams recalled that after she saw an audition video in which he played the role of a villain, she told him, “You’re not going to make it — you’re smiling too much.”

Rogers had bipolar disorder, which he managed with medication, his mother had previously told The Times.

She said Monday that at the time of the incident Rogers was off his medication.

We Are Suing for Roger Ailes' FBI File


This morning, Gizmodo filed a lawsuit against the FBI seeking access to any files it holds on Roger Ailes, the one-time chief executive of Fox News.

Gizmodo sought access to the records under the Freedom of Information Act on May 18, the day Ailes was found dead in his Palm Beach home due to a traumatic brain injury aggravated by his hemophilia. As one the most influential and controversial political figures of his era, we believe these files are likely to exist. The FBI failed to provide or formally deny access to the records within the time period allowed under the federal statute. Needless to say, we’d really like to read them.

Depending on whom you ask, Ailes either cultivated or destroyed American conservative politics. After humble beginnings in an abusive blue-collar home in Warren, Ohio, he grew to become a fixture in the White House by lending his media expertise to presidents Richard Nixon, Ronald Reagan, and George H. W. Bush. For more than a decade, he reigned over what became the most-watched network in cable news history, serving to more than 2 million Americans daily his own brand of divisive, vitriolic and often racially-charged commentary.

As the story goes, President Obama once addressed him as “the most powerful man in the world.” Ailes replied back coolly: “Don’t believe what you read, Mr. President. I started those rumors myself.”

But his achievements will forever be overshadowed by the accusations of sexual harassment, coercion, psychological torture, blackmail, and surveillance of his employees that ultimately led to his downfall. Given the seriousness of the allegations raised by more than a half dozen women, he naturally found a home on the presidential campaign of Donald Trump, whom he’d gifted years before with a weekly segment on the Fox and Friends morning show.

An Arizona congressman is calling for the resignation of special counsel Robert Mueller, suggesting he had two conflicts of interest.

U.S. Rep. Trent Franks, R-Ariz., joined President Trump’s claims that Mueller should be disqualified to investigate Russian interference in the 2016 presidential election because at least four people on the special counsel’s staff donated to Hillary Clinton’s campaign.

Persistent FBI surveillance put no damper on I.F. Stone’s incisive pen
Thousands of pages track the free speech principles of one of the agency’s earliest and longest agitators

Isidor Feinstein Stone - popularly known as I.F. Stone and to the Federal Bureau of Investigation by a variety of alternate spellings - had one of the longest journalistic careers as a critic of federal operations, and, accordingly, his FBI file is thousands of pages long. Born before the First World War, by the time WWII was eminent, Mr. Stone was already an editor at The Nation and his writing career carried through the engagement, the early Cold War years, and much of the Vietnam era before his health required retirement.



In his November 9, 1959 edition of I.F. Stone’s Weekly, Mr. Stone highlighted the agency and its collusion with the House Un-American Activities in identifying communist sympathizers. By that point, they had already been following him for nearly two decades - he had piqued their interest during the discussion over the Smith Act - and as recently as four days prior, they had been in attendance at a rally of a reported three hundred-ish people gathered under the curious cause - almost certainly a Communist cabal in the Bureau’s consideration - of “First Amendment Defendents.”

The collection of honored attendees was something of a lightning rod for federal attention at the time, comprised of educators, authors, labor organizers, and others who had already been called before or proved of interest to the HUAC.



Among them was Lloyd Barenblatt, whose case before the Supreme Court had been decided against him at the beginning of the summer, finding that he had been in contempt of Congress when he refused to answer its questions about his political and religious leanings.



Mr. Stone took the opportunity to direct attention to the G-Men who might be in the audience, calling out their alliance with tyranny …



and their camaraderie with a particular noted Biblical backstabber …



The event is but one in the long-standing saga between Mr. Stone’s staunch First Amendment advocacy and the Feds’ Soviet suspicions.

Longtime Clinton ally Lanny Davis is due to release a book in October that excoriates former FBI Director James Comey for his role in the 2016 election.

Davis' work aims to trace Hillary Clinton's email controversy and the timeline from Comey's July 2016 congressional testimony in which he declared the end of an investigation into her emails to his bombshell announcement just before the November election that the investigation had been reopened.




"In 'The Unmaking of the President 2016,' attorney Lanny J. Davis shows how Comey's misguided announcement — just eleven days before the election — swung a significant number of voters toward Trump, winning him an Electoral College victory — and the presidency," the book's publisher, Simon and Schuster, said.

Davis argues that state-by-state polling data shows that had the election been held on Oct. 27, Hillary Clinton would not only have won the popular vote but also the Electoral College by a substantial margin.

He further contends that despite Trump's behavior, Russian interference, and reports of Clinton's gaining traction in states like Georgia, Arizona, and even Texas, it was Comey's Oct. 28 letter about the Clinton investigation that completely reshaped the landscape of the election in favor of Trump.

"Davis proves with raw, indisputable data how Comey's October surprise changed American history in the blink of an eye and cost Hillary Clinton the presidency," Simon and Schuster said.

The book is scheduled to be released Oct. 24.

Background

Marc Morano is the executive director and chief correspondent of ClimateDepot.com, a project of the Committee for a Constructive Tomorrow (CFACT). Morano is also the Communications Director at CFACT, a conservative think-tank in Washington D.C. that has received funding from ExxonMobil, Chevron, as well as hundreds of thousands of dollars from foundations associated with Richard Mellon Scaife. According to 2011 IRS Forms (PDF), Morano was the highest paid staff member with a salary of $150,000 per year. Morano's blog Climate Depot regularly publishes articles questioning man-made global warming. [12], [13], [6], [37]

Although he has no scientific expertise in the area, Morano has become a prominent climate change denier. He has been called “the Matt Drudge of climate denial,” the “King of the skeptics,” and a “central cell of the climate-denial machine.” He was also listed as one of 17 top “climate killers” by Rolling Stone Magazine. He has accused climate scientists of “fear mongering,” and has claimed that proponents of man-made global warming are “funded to the tune of $50 billion.” [15], [16]

From 2006 to 2009, Morano was the communications director for Senator James Inhofe (R-Okla.), the minority chair of the Senate Environment and Public Works Committee. Prior to the last election, Inhofe was the majority chair of the EPW committee. In the 2002 election cycle, Senator Inhofe received more in donations from the oil and gas sector than any other Senator. Sen. Inhofe is known for his infamous quote that the threat of catastrophic global warming is the “greatest hoax ever perpetrated on the American people,” and as his communications director, Mornano has spent his recent years propagating this message. [3]

According to Marc Morano's archived profile at the Heartland Institute, “Morano joined the Senate Environment and Public Works Committee as the majority Communications Director in June 2006 after a decade and a half as a working journalist, documentary maker, radio talk show host, and national television correspondent.” Apart from being a regular speaker at the Heartland Institute's International Conference on Climate Change, Morano is also listed on their website as a “global warming expert.” [2], [17]

Prior to working for Senator Inhofe, Morano was a journalist with Cybercast News Service, which is owned and operated by the Media Research Center (MRC). The MRC is supported in part by right-wing foundations and funding from industry, including over $200,000 from ExxonMobil. From 1992 to 1996, Morano also worked as a producer for the Rush Limbaugh Television Show and was known as “Limbaugh's man in Washington.” Morano often appears on Fox news to promote his ideas regarding climate change. Before the film's Australian debut, Climate scientist Professor Will Steffen reviewed portions of the film for DeSmog. [85]

Steffen is an emeritus professor at Australian National University and a member of the not-for-profit Climate Council. He said: “This is just the usual rubbish from the usual suspects - a re-hash of misleading and downright incorrect arguments that denialists have trotted out for a long time.” [85]

Reviewing a section that downplays the role of carbon dioxide as a greenhouse gas in the atmosphere, Steffen noted it “misrepresents how the carbon cycle works” by ignoring how oceans and land absorb CO2 – a very basic and well-known mechanism in the carbon cycle. [85]

Steffen added, “What the film didn't say is that both oxygen and nitrogen, which comprise about 99 per cent of the atmospheric gases, are transparent to UV, visible and heat radiation. They don't play a role in the energy balance at the Earth's surface.” [85]

Dr. Andrew King, a climate scientist at Monash University in Melbourne, also had an opportunity to look at the film. He described the section on carbon dioxide's role as “muddled.” [85]

“Whilst there are certainly other potential drivers of changes in the climate we know that over the last century we have greatly increased the CO2 concentration in the atmosphere and, through detection and attribution analyses, we know that the rising levels of atmospheric CO2 and other greenhouse gases have driven the rise in global temperature,” King said. “Changes in other potential drivers, like solar activity, simply can't explain the 1C rise in global temperature we have observed.” [85]

Craig Rucker said: “CFACT has a lot of fans and followers in Australia who have long wanted us to make a trip. We were beckoned to come and are excited to premiere our film Climate Hustle.” [85]

Marc Morano was an attendee at a private meeting also attended by Trump's EPA Transition team lead Myron Ebell on Capitol Hill. E&E News reported that the event was not open to the public or to the press and Ebell refused to give any details. The event was hosted by the Competitive Enterprise Institute (CEI) and held in the hearing room of the Senate Environment and Public Works (EPW) Committee. The EPW committee is chaired by Senator James Inhofe who, like Trump, has described human-caused climate change as a hoax. [78]

DeSmog reported that the event featured the “Who's Who of Climate Science Deniers.” Australian Senator Malcolm Roberts, who spoke at the event, also wrote that the meeting was a gathering of the Cooler Heads Coalition and listed some of the participants on Facebook: [79], [80]

DeSmog also noted that three of the attendees—Myron Ebell, Randy Randol, and Steve Milloy—had all been part of the Global Climate Science Communications Team in the late 1990s, a group organized by the American Petroleum Institute. According to an early memo, the group said “victory will be achieved when […] Average citizens 'understand' (recognize) uncertainties in climate science; recognition of uncertainties becomes part of the 'conventional wisdom'.” [81]

Marc Morano spoke at the Uintah Basin Energy Summit, which has prompted some controversy from environmental groups: [75]

“I could see it if an oil and gas association brought him in to speak to their skepticsim about the climate change argument,” Sat Matt Pacenza, executive director of HEAL Utah. “But this is a government-sponsored event, and he is being paid with taxpayer money.” [75]

The state Office of Energy Development, which is also sponsoring the conference, noted in a statement: “our views on climate change do not align with those of Mr. Morano” reports KUER News.

Others, including Utah State University physicist, Rob Davies, have doubted Marno's message. Davies described Morano as a “paid confusionist.” Davis describes it as a missed opportunity for eastern Utah and the energy industry: [76]

“They deserve really good information as to what the potential changes are and why,” says Davies. “And I just can’t see someone like Marc Morano bringing constructive, good information to those communities on this topic.” [76]

Barry Bickmore, a Brigham Young University geologist, shares Davis's view:

“They’re just bringing in somebody who can give them a really good sales pitch for what they want to hear,” says Bickmore. “In a way, though, it’s sad because they could be preparing for the inevitable transition away from fossil fuels.” [76]

Joshua Murdock provides coverage of the Energy Summit in an article at UB Media where he notes that a number of climate experts dispute claims made by Morano. He comments on Morano's presentation: “Morano said that extreme weather is declining around the globe and that the link between climate change, which he says is a myth, and extreme weather is fabricated. Morano then said that the oft-touted 97 percent consensus on climate change being real and anthropogenic (meaning human-caused) was illegitimate because less than 100 scientists were polled to arrive at the 97 percent value.” [77]

He notes that Gavin Schmidt, the director of NASA's Goddard Institute for Space Science, offers evidence contrary to Morano's claims:”There’s different kinds of extreme weather, some of which is increasing because of climate change, some of which is decreasing, some of which we’re not quite sure what the impacts are,” Schmidt said. Pennsylvania State University Evan Pugh Geoscience Professor Richard Alley, Ph.D. also counters a number of Morano's statements. While Morano made claims that increasing polar bear populations and a growth of Arctic sea ice rebut evidence of climate change, Alley and Schmidt note that polar bear populations have increased largely due to new restrictions on hunting, and that sea ice continues to decrease: [77]

“We’re looking at unprecedented levels of low sea ice,” said Schmidt, adding that 2016 would likely feature the second-lowest amount of ice in recorded history and that ice amounts are trending sharply downward. “The statistically significant long-term trend shows Arctic sea ice is shrinking, especially in late summer, with high confidence,” said Alley. “There are year-to-year variations, but the climate is for shrinkage.” Schmidt added that polar bear populations are not evidence of climate change, but rather something that could be impacted by climate change.

“The data are very strong that the planet is warming, as shown by analyses by NASA, NOAA, the Berkeley Earth group and others, by data from thermometers in the air including those well away from cities, thermometers in the ocean and in the ground, taken up by balloons and looking down from space, and changes in temperature-sensitive snow and ice and plants and animals,” said Alley. “There is year-to-year variability, but averaging across that 'weather,' the signal of climatic warming is very clear.” [77]

Marc Morano is the vice president of a group titled Climate Exit (Clexit), and a member of the “Clexit Committee.” According to Clexit's founding statement (PDF), “The world must abandon this suicidal Global Warming crusade. Man does not and cannot control the climate.” [71], [72]

As Desmog reports, another key member of Clexit's “60 well-informed science, business and economic leaders” is Hugh Morgan, a former board member of the Reserve Bank of Australia and former CEO of Western Mining Corporation with close ties to Australia's Liberal party. [73], [74]

“If the Paris climate accord is ratified, or enforced locally by compliant governments, it will strangle the leading economies of the world with pointless carbon taxes and costly climate and energy policies, all with no sound basis in evidence or science […]” [72]

After a Massachusetts court sided with a group of teenagers by ruling the state had failed to reduce greenhouse gas emissions, [57] Marc Morano claimed that today's youth are being indoctrinated by the environmental movement: [58]

“It’s a brilliant tactic by the environmental left,” Morano said. “It gives the kids something tangible they can hold on to and it radicalizes them about the environment early on. However, kids are being spoon-fed a version of science that does not comport with reality.

“The environmental left carefully censors or bans opposing ideas, like in Portland, Oregon, where you now can’t even mention in school textbooks climate change may not be as bad as we thought,” Morano said.

“Accurate climate science is being suppressed, meaning the kids don’t get to hear opposing views,” said Morano. “It’s narrative-crafting, the same kind of thing you would expect from any partisan campaign group.

“And then you add in the media, with people like Leonardo DiCaprio and Laurie David telling kids if you’re a global warming skeptic, you are not cool,” said Morano. “I guess they’re afraid the kids will instantly become skeptics if they hear any opposing ideas.”

Marc Morano's Climate Hustle was released in U.S. theatres. The Washington Times reports John Coleman defended the film after Bill Nye described it as “not in our national interest and the world’s interest.” Anthony Watts (who is listed among the film's “key scientists”) also gave the film a positive review. [65]

“I have always been amazed that anyone would pay attention to Bill Nye, a pretend scientist in a bow tie,” Coleman said on Climate Depot.

“As a man who has studied the science of meteorology for over 60 years and received the [American Meteorological Society] Meteorologist of the Year award, I am totally offended that Nye gets the press and media attention he does,” Coleman said. “And I am rooting for the ‘Climate Hustle’ film to become a huge hit — bigger than ‘An Inconvenient Truth’ by Al Gore.” [65]

The film was produced by the Committee for Constructive Tomorrow (CFACT) and CDR Communications. As noted at Desmog's project, ClimateHustler.org, CFACT has received funding from ExxonMobil, Chevron, as well as hundreds of thousands of dollars from foundations associated with Richard Mellon Scaife. CFACT has also received at least $7.8 million in “dark money” through DonorsTrust and Donors Capital Fund. [66], [67]

CDR Communications was behind the 2010 video by the Cornwall Alliance titled Resisting the Green Dragon, which claimed environmentalism was a “false religion” and a “global government” power grab. Chris Rogers of CDR Communictions is also chairman of The James Partnership, the umbrella arm that includes the Cornwall Alliance as one of its projects and pays the salary of Calvin Beisner, Cornwall’s founder and spokesperson. Morano turned down both bets, telling DeSmog it was “silly” to take a bet when it was “obvious” the official records would show more global warming. [70]

“We are putting together what I think is the most comprehensive, unique, entertaining and humorous climate documentary that has ever been done or attempted,” Morano had said before the film was released. [63]

“The reason that this is a unique film,” Morano has said, “is that we are going for a pop culture-friendly… sarcastic approach and we actually give both sides in this movie.”

In an interview with Ezra Levant, Morano said:

“I am not interviewing a lot of the main climate sceptical scientists because I feel like they have been interviewed by many other people and their stories have been told. I am trying to find another layer of scientist whose stories have not been out there yet. You will see a lot of new names in this.” [63]

At the event, Greenpeace investigator Connor Gibson questioned Marc Morano's role in the national climate discussion, illustrating his role in attacking the science, attacking anyone who questions his relevance in conversations around climate change.[53]

At minute 2:48 of Greenpeace's interview with Morano, he aggressively rejects documentation that 2014 was the hottest year on record.

2014 was the hottest year of global temperatures recorded in human history, as studied and published by the National Aeronautics and Space Administration (NASA), the National Oceanic and Atmospheric Association (NOAA), and reported worldwide (BBC, TIME, Scientific American). The AP clarification statement (not a retraction) that Morano mentions did not alter the conclusion of the NASA study, nor the wide body of evidence published by scientists since the 1970s.[54]

Marc Morano signed an open letter to Pope Francis on climate change inviting the Pope to reconsider his views on climate change before his encyclical letter on the environment. [45]

The open letter was coordinated and signed by Calvin Beisner of the Cornwall Alliance. According to the letter, “Good climate policy must recognize human exceptionalism, the God-given call for human persons to 'have dominion' in the natural world (Genesis 1:28), and the need to protect the poor from harm, including actions that hinder their ascent out of poverty.” [45]

Marc Morano travels to Vatican City, Italy, with Christopher Monckton and Calvin Beisner of the Cornwall Alliance, for a press event hosted by the Heartland Institute in order to “dissuade Pope Francis from lending his moral authority to the politicized and unscientific climate agenda of the United Nations,” according to a Heartland Institute press release. Marc Morano is one of several climate change skeptics cc'd on an email from S. Fred Singer in hopes of countering the documentary film “Merchants of Doubt,” which exposes the network of climate change skeptics and deniers trying to delay legislative action on climate change. [49]

The October, 2014 email was leaked to journalists before the documentary was released. “Can I sue for damages?” Singer asked in the email. “Can we get an injunction against the documentary?”

Marc Morano is quoted in the Heartland Institute's press release, “Heartland Institute Climate Experts Comment on 18 Straight Years of No Global Warming,” which states “the global mean surface temperature has not risen for 18 consecutive years. This extends the so-called 'pause' in global warming to a new record, one not predicted by the climate models of the United Nations' International Panel on Climate Change (IPCC).” [42] Morano writes:

“As the global temperature standstill hits 18 years beyond what the models predicted the climate activists are left with more than 50 excuses to explain why temperatures are not rising.

“The ‘pause’ reveals that it is scientifically obvious that carbon dioxide is not the overriding driver of the climate. The global warming movement has morphed into a coalition of ‘climate cause deniers.’ They deny the hundreds of causes and variables of climate change and pretend CO2 is the ‘control knob’ overriding all the others.” [42]

Marc Morano, James Taylor, William O’Keefe, Tim Phillips, and S. Fred Singer were all featured in the film Merchants of Doubt, based on the 2010 non-fiction book by Naomi Oreskes and Erik Conway. According to the film's synopsis on its website, Merchants of Doubt “lifts the curtain on a secretive group of highly charismatic, silver- tongued pundits-for-hire who present themselves in the media as scientific authorities – yet have the contrary aim of spreading maximum confusion about well-studied public threats ranging from toxic chemicals to pharmaceuticals to climate change.” [49]
In the film, Morano talks about how he has posted climate scientists' email addresses on his website, including a former IPCC lead author Ben Santer, which incited hate mail and death threats asThe Washington Post reported: [60], [61]
“[Morano] attacked me in a very unjust way on his website and posted my email address, and in my view such behavior is basically an incitement to hatred,” Santer said

“Those [emails] are of concern, particularly when you have loved ones and it's clear that some of these people out there are not very rational.” [61]

Earlier in the documentary, Morano describes how he intentionally goes after climate change scientists:

“You can't be afraid of the absolute hand-to-hand combat, metaphorically, and you've got to name names and you've got to go after individuals. You can't just go after a system. And that's what I think I enjoy the most; is going after the individuals. Because that's where something lives or dies.” [49:49]

He also discussed Santer's email:

“I'd say it's possible I posted Ben Santer's email in the early days of Climate Depot, maybe the first six months. He's far from the only one I've done that to.” [49] - [50:54]

Katharine Hayhoe (another climate scientist) talking about hate emails and death threats she receives, says that “sometimes it's one a week. Sometimes when your email address gets posted on [Marc] Morano's website, it's 200 or more in a day.” [49] - [51:13]

Ben Santer: “I think the most disturbing emails or letters were ones that suggest there will be direct physical harm to you and to your family.” [49] - [51:31]

Morano's response: “I don't know what his complaint is. But I'll give you the philosophy behind it […] I think people should be thanking me. I was doing a service. And people go like 'oh, they're death threats.' Well, I get death threats. I enjoy them. I usually email back. So I think it was one of the healthiest things that could have happened in the climate debate. I make no apologies for it. I still do it and I enjoy doing it.”

Morano also discussed his early days working with Senator John Inhofe and how that influenced the formation of Climate Depot:

“I got a call from Senator James Inhofe's office to be the new communications director. It was probably at the lowest point, when I started in June 2006, for global warming skeptics.”

“[After the release of Al Gore's film] we decided for Inhofe to go on the offensive. […] We went after James Hansen and Michael Oppenheimer and had a lot of fun with it. We mocked and ridiculed James Hansen.

I was authorized—I couldn't believe they let me do this—I did a two-part, probably ten thousand word, unbelievably scathing critique on James Hansen. I'm not going to question his scientific work, but in terms of influencing the public. And actually, his scientific work isn't really in question. It's more of his public claims and publicity and interviews.

I still felt restrained, so I started doing what I called 'the underground newsletters' which went much further than anything else, we had a lot more fun, a lot more humour, wit, sarcasm, and sometimes nastiness. That went out, and that became the basis for ClimateDepot.” [49] - [47:14]

CNN did not disclose that Morano doesn't have a scientific background in the area, and that he has received funding from an organization linked to industry interests. During the segman, Morano cliams that “we've gone 16 years without global warming according to UN data.” [18]

November 26, 2012

As one of five appearances in 2012, Marc Morano spoke on the Fox News program your World with Neil Cavuto to discuss his views on climate change. On this date, Morano suggests that there is no link between extreme weather and climate change, saying that “every time there's a bad weather event the global warming activists think we need more taxes and regulations to somehow stop bad weather. This is a primitive form of science.” [14]

He also compares climate models to end-of-the-world predictions, saying that “This has now reached the level of the Mayan calendar and Nostradamus when it comes to science.”

In an appearance on the Fox News program Your World with Neil Cavuto, Morano clamed that modern climate change predictions are failing and that they are akin to “medieval witchcraft, where we used to blame witches for controlling the weather.”

He also said that climate change has been supposedly proven to be based on “subprime science,” and that the “whole movement has collapsed.” [14]

Morano appeared on the Fox News program Your World with Neil Cavuto and claimed that the goal of UN climate negotiations is “global governance” and the redistribution of wealth. “It`s very Orwellian,” he said. “This is stuff Orwell couldn't conceive of, your home energy use, your travel, your train travel, airline travel all monitored by international agencies. It`s not the stuff of science fiction.” [14]

Marc Morano was a speaker at the Heartland Institute's 7th International Conference on Climate Change (ICCC7). In his speech, Morano raised “concerns” over the fact that some of Mitt Romney's advisors accepted the mainstream science of climate change. He added that “It's very frustrating for global warming skeptics when you realize who is the Republican standard bearer right now and how far we've come […] We need a president who actually can stand up to this whole global warming brigade.” [26]

DeSmogBlog researched the co-sponsors behind Heartland's ICCC7 and found that they had collectively received over $67 million from ExxonMobil, the Koch Brothers and the conservative Scaife family foundations.

Marc Morano defended the Heartland Institute's unsuccessful billboard campaign that compared those who believe in man-made climate change to individuals associated with mass murder and terrorism. The billboards featured pictures of Ted Kaczynski, Charles Manson and Fidel Castro next to the text “I still believe in Global Warming. Do you?” The Heartland Institute was forced to take down the controversial billboards shortly after they were unveiled. [21], [22]

Morano described the billboard campaign as “edgy”:

“This is so silly. Every day now, skeptics are compared to Holocaust deniers and the media yawns. But Heartland does an edgy billboard accurately reflecting the views of those featured in it and the media acts as though they are offended?” [23]

The report was debunked, and found to contain at least 84 individuals who took industry money, 49 retirees, 44 television weathermen, 20 economists, and 70 with no expertise in climate science. [9]

While working for CNS news, Morano broke the “Swift Boat” story that suggested that senator John Kerry did not deserve the Purple Heart award he earned in Vietnam. FactCheck.org notes that “the veterans who accuse Kerry [of lying to receive his war medals] are contradicted by Kerry's former crewmen, and by Navy records.” [27], [28]

Climate Scientist Michael Mann has since accused Morano of using “Climategate” to “Swift Boat” climate scientists. Morano's ClimateDepot claimed to have uncovered “collusion” and “deliberate manipulation of facts and data” by UN scientists. Michal Mann, who has been a subject of the accusations of ClimateDepot, said that Morano is funded by “vested interests to 'swiftboat' climate scientists, to try to distort our work, to try to undermine the public's credibility in the science.” [29]

According to SourceWatch, Cybercast News Service and Morano were the first sources of the “Swift Boat Veterans for Truth” campaign against presidential nominee Senator John Kerry.

In the run up to the official launch of the Swiftboat campaign, Morano wrote, “hundreds of former commanders and military colleagues of presumptive Democratic nominee John Kerry are set to declare in a signed letter that he is 'unfit to be commander-in-chief.'”

In July of 1955, Lewis Strauss, chairman of the Atomic Energy Commission, wrote to CIA director Allen Dulles over matters of mutual interest. In one of those letters, uncovered in the Agency’s archives, Strauss thanked Dulles for a package he had sent him, using deliberately vague terms to describe its contents as to “avoid classifying this letter.” Strauss’ efforts were in vain however. Not only was the letter classified for just shy of 50 years, but the vague descriptor itself remains classified to this day.

Portland Copwatch, as a project of Peace and Justice Works, adheres to principles of non-violence. We are very aware that efforts by the President and members of Congress to label Antifa as a criminal and/or "terrorist" organization are unfounded and can only lead to criminalization of free speech and association. Antifa is a term which is short-hand for anti-fascists, covering an entire movement, not a specific organization.
As Rose City Antifa pointed out in their statement condemning the government's stated intentions, the government is not taking such steps to criminalize or label as terrorists the right wing groups who promote and engage in violence, racism, and anti-immigrant organizing. Here are a few examples. Although the government did arrest people who took over a federal wildlife refuge while openly carrying guns in Oregon in 2016, they were unsuccessful in prosecuting them. When a law enforcement official suggested that the FBI had labeled the "Proud Boys" or "Patriot Prayer" as hate groups, the FBI denied that was the case. Similarly, the Portland Police did not alert the media or the community right away nor did they make any arrests when people associated with Patriot Prayer were found on top of a downtown parking structure with guns.
Portland Copwatch and its members stand against fascism. We support other groups who oppose fascism. We have documented how the Portland Police visibly favor right-wing protestors while facing down and/or attacking anti-fascists who confront them.
We as an organization remain committed to nonviolence as we seek to end the use of violence by the state to enforce its policies. The threatened criminalization of an entire movement is itself a form of state violence and must be stopped.

Ben & Jerry’s Takes on Criminal Justice Reform with New Flavor, Justice Remix’d

In a world in which the trappings of allyship have devolved into Instagram likes or tawdry photo ops, premium ice cream company Ben & Jerry’s has quietly ignored fanfare in favor of doing the actual work.
It’s not uncommon to find posts admonishing the criminal justice system or systemic racism on their website, and since May 2018 they’ve spent over a million dollars on Facebook ads denouncing mass incarceration, advocating for mental health funding and demanding criminal justice reform. And according to the revered ice cream manufacturer, they’re just getting started.
On Tuesday, they partnered with Color of Change and the Advancement Project to unveil their latest flavor, Justice Remix’d, as part of their three-year initiative “to address the destructive cycle of mass incarceration in our country,” according to a statement from Ben & Jerry’s.
Prior to this unveiling, The Root spoke with Jabari Paul, the company’s assistant U.S. activism manager, who explained B&J’s mission further.
“Justice Remix’d is our fan-facing advocacy campaign that focuses on front-end criminal justice reform,” Paul told The Root. “Front-end meaning how do you divert and deflect people from going into the incarceration system in the first place? Many of which have no legitimate reason for being there.”
Paul added, “On a national level, we’ve really focused on three issues: ending money bail, stopping unnecessary prosecutions and disrupting the school to prison pipeline.”
In doing so, Ben & Jerry’s became partners in Color of Change’s Winning Justice campaign, which seeks to transform the criminal justice system by championing reform-minded prosecutors for election. But the company has a local strategy as well, which includes the involvement of the Advancement Project to work towards shutting down jails like Workhouse in St. Louis.
“90 percent of the people there are on pre-trial detention,” Paul said. “They’re just too poor to bond themselves out. You can be rich and guilty and not go to jail pre-trial or you can be poor and innocent and you have to sit in jail.”
Criminal justice reform is long overdue, and with the arrival of Justice Remix’d, Ben & Jerry’s seeks to be a part of the solution instead of resting on their laurels.
“The reason that we believe in social impact is because social impact goes beyond this idea of corporate giving. It’s about really influencing fan behavior,” Paul said. “Our goal is to drive them to increase awareness around the issues that we care about, like criminal justice reform, drive engagement, engage them around those issues and then ultimately inspire them to take action.”
Justice Remix’d is available for pre-order on their website and arrives in stores this week.

Why Confronting Israel Is Important

The Jewish state is no friend

I am often asked why I have this “thing” about Israel, with friends suggesting that I would be much more respected as a pundit if I were to instead concentrate on national security and political corruption. The problem with that formulation is that the so-called “special relationship” with Israel is itself the result of terrible national security and foreign policy choices that is sustained by pervasive political and media corruption, so any honest attempt to examine the one inevitably leads to the other. Most talking heads in the media avoid that dilemma by choosing to completely ignore the dark side of Israel.
Israel – not Russia – is the one foreign country that can interfere with impunity with the political processes in the United States yet it is immune from criticism. It is also the single most significant threat to genuine national security as it and its powerful domestic lobby have been major advocates for the continuation of America’s interventionist warfare state. The decision to go to war on false pretenses against Iraq, largely promoted by a cabal of prominent American Jews in the Pentagon and in the media, killed 4,424 Americans as well as hundreds of thousands Iraqis and will wind up costing the American taxpayer $7 trillion dollars when all the bills are paid. That same group of mostly Jewish neocons more-or-less is now agitating to go to war with Iran using a game plan for escalation prepared by Israel which will, if anything, prove even more catastrophic.
And I can go on from there. According to the FBI, Israel runs the most aggressive spying operations against the U.S. among ostensibly “friendly” nations, frequently stealing our military technology for resale by its own arms merchants. Its notable successes in espionage have included the most devastating spy in U.S. history Jonathan Pollard, while it has also penetrated American communications systems and illegally obtained both the fuel and the triggers for its own secret nuclear weapons arsenal.
Israel cares little for American sovereignty. It’s prime ministers Ariel Sharon and Benjamin Netanyahu have both boasted how they control the United States. In 2001, Israel was running a massive secret spying operation directed against Arabs in the U.S. Many in the intelligence and law enforcement communities suspect that it had considerable prior intelligence regarding the 9/11 plot but did not share it with Washington. There was the spectacle of the “dancing Shlomos,” Israeli “movers” from a company in New Jersey who apparently had advanced knowledge of the terrorist attack and danced and celebrated as they watched the Twin Towers go down.
Jewish power, both in terms of money and of access to people and mechanisms that really matter, is what allows Israel to act with impunity, making the United States both poorer and more insecure. A well-funded massive lobbying effort involving hundreds of groups and thousands of individuals in the U.S. has worked to the detriment of actual American interests, in part by creating a permanent annual gift of billions of dollars to Israel for no other reason but that it is Israel and can get anything it wants from a servile Congress and White House without any objection from a controlled media.
Israel has also obtained carte blanche political protection from the U.S. in fora like the United Nations, which is damaging to America’s reputation and its actual interests. This protection now extends to the basing of U.S. troops in Israel to serve as a tripwire, guaranteeing that Washington will become involved if Israel is ever attacked or even if Israel itself starts a war. The current U.S. Ambassador to the U.N. Nikki Haley is little more than a shill for Israel while America’s Ambassador in Israel David Friedman is an open supporter of Israel’s illegal settlements, which the U.S. opposes, who spends much of his time defending Israeli war crimes.
And here on the home front Israel is doing damage that might be viewed as even more grave in Senator Ben Cardin’s attempt to destroy First Amendment rights by making any criticism of Israel illegal. The non-violent Israel Boycott movement (BDS) has already been sanctioned in many states, the result of intensive and successful lobbying by the Israeli government and its powerful friends.
So if there is a real enemy of the United States in terms of the actual damage being inflicted by a foreign power, it is Israel. In the recent Russiagate investigations it was revealed that it was Israel, not Russia, that sought favors from Michael Flynn and the incoming Trump Administration yet Special Counsel Robert Mueller has evidently not chosen to go down that road with his investigations, which should surprise no one.
Noam Chomsky, iconic progressive intellectual, has finally come around on the issue of Israel and what it means. He has always argued somewhat incoherently that Israeli misbehavior has been due to its role as a tool of American imperialism and capitalism. At age 89, he has finally figured out that it is actually all about what a parasitic Israel wants without any regard for its American host, observing on “Democracy Now” that
..take, say, the huge issue of interference in our pristine elections. Did the Russians interfere in our elections? An issue of overwhelming concern in the media. I mean, in most of the world, that’s almost a joke. First of all, if you’re interested in foreign interference in our elections, whatever the Russians may have done barely counts or weighs in the balance as compared with what another state does, openly, brazenly and with enormous support. Israeli intervention in U.S. elections vastly overwhelms anything the Russians may have done… I mean, even to the point where the prime minister of Israel, Netanyahu, goes directly to Congress, without even informing the president, and speaks to Congress, with overwhelming applause, to try to undermine the president’s policies – what happened with Obama and Netanyahu in 2015….
Politicians are terrified of crossing the Jewish lobby by saying anything negative about Israel, which means that Prime Minister Benjamin Netanyahu always gets a pass from the American government, even when he starves civilians and bombs hospitals and schools. Netanyahu uses snipers to shoot dead scores of unarmed demonstrators and the snipers themselves joke about their kills without a peep from Washington, which styles itself the “leader of the free world.”
Just recently, Israel has declared itself a Jewish State with all that implies. To be sure, Israeli Christians and Muslims were already subject to a battery of laws and regulations that empowered Jews at their expense but now it is the guiding principle that Israel will be run for the benefit of Jews and Jews alone. And it still likes to call itself a “democracy.”
A recent television program illustrates just how far the subjugation of America’s elected leaders by Israel has gone. British comedian Sacha Baron Cohen is featured on a new show called “Who is America?” in which he uses disguises and aliases to engage politicians and other luminaries in unscripted interviews that reveal just how ignorant or mendacious they actually are. Several recent episodes remind one of a February 2013 Saturday Night Live skit on the impending confirmation of Chuck Hagel as Secretary of Defense. A Senator asks Hagel. “It is vital to Israel’s security for you to go on national television and perform oral sex on a donkey… Would you do THAT for Israel?” A “yes” answer was, of course, expected from Hagel. The skit was never aired after objections from the usual suspects.
Baron Cohen, who confronted several GOP notables in the guise of Colonel Erran Morad, an Israeli security specialist, provided a number of clues that his interview was a sham but none of the victims were smart enough to pick up on them. Cohen, wearing an Israeli military uniform and calling himself a colonel, clearly displayed sergeant’s stripes. Hinting that he might actually be a Mossad agent, Cohen also sported a T-shirt on which the Hebrew text was printed backwards and he claimed that the Israeli spy agency’s motto was “if you want to win, show some skin.”
Cohen set up Dick Cheney by complimenting him on being the “the king of terrorist killers” before commenting that “my neighbor in Tel Aviv is in jail for murder, or, as we call it, enhanced tickling.” Morad went on to tell Cheney that he once waterboarded his wife to check for infidelity and then convinced the former Vice President to sign a “waterboarding kit” that “already had” the signatures of Benjamin Netanyahu, Ariel Sharon and Demi Lovato.
Another more spectacular sketch included a Georgia state senator Jason Spencer who was convinced to shout out the n-word as part of an alleged video being made to fight terrorism. After Cohen told Spencer that it was necessary to incite fear in homophobic jihadists, Spencer dropped his pants and underwear, before backing up with his exposed rear end while shouting “USA!” and “America!” Spencer also spoke with a phony Asian accent while simulating using a selfie-stick to secretly insert a camera phone inside a Muslim woman’s burqa.
In another series of encounters, Cohen as Morad managed to convince current and ex-Republican members of Congress — to include former Senate majority leader Trent Lott — to endorse a fictional Israeli program to arm grade school children for self-defense.
Cohen’s footage included a former Illinois congressman and talk radio host named Joe Walsh saying: “The intensive three-week ‘Kinderguardian’ course introduces specially selected children from 12 to 4 years old to pistols, rifles, semiautomatics and a rudimentary knowledge of mortars. In less than a month — less than a month — a first-grader can become a first grenade-er.”
Both controversial Alabama judge Roy Moore and Walsh were fooled into meeting Cohen to attend a non-existent pro-Israel conference to accept an award for “significant contributions to the state of Israel.” Representative Dana Rohrabacher, meanwhile, also was interviewed and he commented that, “Maybe having young people trained and understand how to defend themselves and their school might actually make us safer here.” And Congressman Joe Wilson observed that “A 3-year-old cannot defend itself from an assault rifle by throwing a ‘Hello Kitty’ pencil case at it.”
Cohen’s performance is instructive. A man shows up in Israeli uniform, claims to be a terrorism expert or even a Mossad agent, and he gains access to powerful Americans who are willing to do anything he says. How Cohen did it says a lot about the reflexive and completely uncritical support for Israel that many American politicians — particularly Republicans — now embrace. This, in a nutshell, is the damage that Israel and its Lobby have done to the United States. Israel is always right for many policymakers and even palpably phony Jews like Colonel Morad are instantly perceived as smarter than the rest of us so we’d better do what they say. That kind of thinking has brought us Iraq, Libya, Syria and the possibility of something far worse with Iran.
Israel routinely interferes in American politics and corrupts our institutions without any cost to itself and that is why I write and speak frequently regarding the danger to our Republic that it poses. It is past time to change the essentially phony narrative. Israel is nothing but trouble. It has the right to defend itself and protect its interests but that should not involve the United States. One can only hope that eventually a majority of my fellow American citizens will also figure things out. It might take a while, but the ruthless way Israel openly operates with no concern for anyone but itself provides a measure of optimism that that day is surely coming.

Today, Mitchell filed an affidavit by a former FBI informant in Atlanta, claiming there was an "unofficial policy" of the FBI in the late 1970s and early 1980s to investigate "prominent elected and appointed black officials in major metropolitan areas throughout the United States."
The affidavit, signed by Hirsch Friedman, 45, now a lawyer and businessman in Atlanta, said the policy was referred to in the Atlanta FBI field office as the "fruhmenschen policy." Fruhmenschen is a German word meaning "early man" or "Stone Age man," according to the affidavit.
The term was used, Friedman said, because the FBI assumed that "black officials were intellectually and socially incapable of governing major governmental organizations and institutions."

The FBI has no numbers to show its investigations have been balanced racially, because it doesn’t keep such statistics, he said.

″There is no way the FBI could differentiate by race the number of individuals we’ve investigated,″ Jones said. ″I think it would be ludicrous to. I don’t think the public would stand for it.″

A congressional source said he has seen details from black officials on the allegations, but he has never seen Stern’s name connected with any of them.

In addition, he said, there had never been mention of any roving task force and he added that such a force ″is not a concept that I know of in the FBI.″

One of the most prominent cases has been that of Birmingham, Ala., Mayor Richard Arrington, a former college professor who says he has been the subject of FBI scrutiny since the early 1970s and was the target of several sting operations from 1987 through 1989.

Arrington’s attorney Donald V. Watkins, compiled a report detailing operations against other black officials, and submitted that report to the Justice Department’s Office of Professional Responsibility.

The report includes details from affidavits submitted by Atlanta attorney and former FBI undercover operative Hirsch Friedman. He testified in 1987 that the FBI had a policy called Fruhmenschen - a German term for ″primitive man″ - that selectively targeted African-American elected and appointed officials for investigation, according to the report.

The Friedman affidavits said the policy was based on ″the assumption by the FBI that black officials were intellectually and socially incapable of governing major governmental operations and institutions.″

The Collateral Consequences Resource Center is pleased to announce that the Association of Prosecuting Attorneys (APA) has joined as a partner in our Restoration of Rights Project (RRP).  The APA is a membership organization of elected and appointed prosecutors whose mission is to provide training and technical assistance to prosecutors in the United States,  and to facilitate collaboration with criminal justice partners on emerging issues related to the administration of justice.  APA President and CEO David LaBahn participated in the roundtable on non-conviction records held in August at the University of Michigan Law School, a project that relies heavily on the state law research in the RRP.  The RRP’s other partner organizations are the National Association of Criminal Defense Lawyers, National Legal Aid & Defender Association, and National HIRE Network.
The RRP describes current U.S. law and practice concerning restoration of rights and record relief following arrest or conviction in the 50 states, D.C., Puerto Rico, Virgin Islands, and federal system, in three formats: summaries of every jurisdiction, detailed profiles of each jurisdiction, and 50-state comparison charts.  Topics include sealing and expungement, employment and licensing, pardons, voting, jury service, public office, and firearms rights.   People visit the RRP more than 1,000 times every day looking for information about ways to alleviate the burdens of a criminal record.
We are very excited to have this respected national prosecutor organization as a partner in the RRP enterprise, to help bring the RRP’s resources to the prosecutor community, along with a greater awareness of the need for and availability of mechanisms to mitigate the collateral consequences of arrest and conviction.  We look forward to the new perspectives the APA can bring to bear as we work to expand the RRP and make it more useful to all those interested in restoration of rights and record relief.
