The Emergency Use Authorization for Covid-19 vaccines: Ignorance is Bliss


If you are an FDA official charged with approving a Covid-19 vaccine, ignorance is bliss.  FDA is being asked to approve vaccines that will be injected into many millions of people, all using new methods of vaccination that have never before been approved for human use.  That puts them at great risk of making the wrong decision.

However, the lawyers who wrote the Emergency Use Authorization (EUA) legislation understood the FDA bureaucracy and its risk aversion. They probably also worked for, or consulted with, the pandemic vaccine industry.
And so they came up with a standard that practically mandates the most minimal collection of information from clinical trials of vaccines for which emergency use authorization will be sought.  Instead of requiring specific information, the standard simply says that in order to receive an EUA, a product's known and potential benefits should outweigh its known and potential risks. So, the more its sponsor knows about adverse effects, the more trouble the vaccine is likely to have getting approved.  Accordingly, it is better for the adverse effects to be as unknown as possible.
This standard also explains what might be considered oddities in trial design:  for example, why the vaccine sponsors/developers did not collect data on whether the vaccines prevented transmission of disease. Nor were vaccine sponsors required to show statistically significant data on whether hospitalizations (severe illness) and deaths were prevented.
Basically, the FDA was given the statutory green light to approve anything it wanted to approve, with minimal actual data.  That is how Operation Warp Speed could even be conceived.
Most important, from the standpoint of FDA, it gave the agency cover.  FDA is not being asked to act as a regulator. All it needs to be able to say is that the potential for benefit exceeds the potential risks, and as long as little is actually known about the vaccines, they can say their approval was based on the best evidence available at the time. This is of course another reason for speed:  the vaccines need to be approved before meaningful safety and efficacy data accrue that could hurt them.
FDA Commissioner Stephen Hahn and CBER director Peter Marks have tiptoed around and obfuscated this.
"Look at the process that we're following," Dr. Peter Marks said. "We're going to have a very open process."
But the FDA only said it would publicly disclose reviews of the scientific data used to authorize drugs and vaccines after being criticized for hiding information. The Government Accountability Office noted that the FDA had not been sufficiently transparent in disclosing the data used to grant or revoke authorizations involving coronavirus treatments.
Dr. Hahn told USA Today "The standard that’s used for an EUA is that it must be effective..." But that is not the actual standard, which is that a vaccine's known and potential benefits should outweigh its known and potential risks.  In other words, FDA is only required to guess at its safety and effectiveness. Hahn also told USAT that the standards for EUA approval "are very similar" to the standards for issuing a license, which is far from true. 
Here is what the FDA advised Covid vaccine developers on applying for an Emergency Use Authorization:
"Based on this declaration and determination, FDA may issue an EUA after FDA has determined that the following statutory requirements are met (section 564 of the FD&C Act (21 U.S.C. 360bbb-3)) (Ref. 3): 
* Based on the totality of scientific evidence available, including data from adequate and well- controlled trials, if available, it is reasonable to believe that the product may be effective to prevent, diagnose, or treat such serious or life-threatening disease or condition that can be caused by SARS-CoV-2.
* The known and potential benefits of the product, when used to diagnose, prevent, or treat the identified serious or life-threatening disease or condition, outweigh the known and potential risks of the product.
* There is no adequate, approved, and available alternative to the product for diagnosing, preventing, or treating the disease or condition."
The glue that holds this sham of a regulatory process together is the extraordinarily broad liability protection afforded to everyone with any responsibility for the medical products used under an EUA.  You don't learn about this in the EUA declarations. Instead, you must read the Prep Act and its amendments. The following "Public Readiness and Emergency Preparedness Act for Medical Countermeasures Against COVID–19," was published in the August 24, 2020 Federal Register. Everyone who has anything do with Covid vaccines has had all liability waived (with the sliver of an exception for willful misconduct).
And recently pharmacists and pharmacy interns had their liability waived for administering any recommended childhood vaccine to any child over age 3!  The justification is that since Covid-19 has reduced routine childhood vaccinations, any pharmacy employee can now administer any of those vaccinations, while facing no potential liability, via a Covid PREP Act declaration.
Prep Act Quotes:
The Public Readiness and Emergency Preparedness Act (PREP Act) authorizes the Secretary of Health and Human Services (the Secretary) to issue a Declaration to provide liability immunity to certain individuals and entities (Covered Persons) against any claim of loss caused by, arising out of, relating to, or resulting from the manufacture, distribution, administration, or use of medical countermeasures (Covered Countermeasures), except for claims involving ‘‘willful misconduct’’ as defined in the PREP Act.  https://www.govinfo.gov/content/pkg/FR- ... -18542.pdf
V.  Covered Persons 42 U.S.C. 247d–6d(i)(2), (3), (4), (6), (8)(A) and (B) Covered Persons who are afforded liability immunity under this Declaration are ‘‘manufacturers,’’ ‘‘distributors,’’ ‘‘program planners,’’ [read this as "government officials who approved the vaccines"--Nass] ‘‘qualified persons,’’ and their officials, agents, and employees, as those terms are defined in the PREP Act, and the United States. In addition, I have determined that the following additional persons are qualified persons: (a) Any person authorized in accordance with the public health and medical emergency response of the Authority Having Jurisdiction, as described in Section VII below, to prescribe, administer, deliver, distribute or dispense the Covered Countermeasures, and their officials, agents, employees, contractors and volunteers, following a Declaration of an emergency; (b) any person authorized to prescribe, administer, or dispense the Covered Countermeasures or who is otherwise authorized to perform an activity under an Emergency Use Authorization in accordance with Section 564 of the FD&C Act; (c) any person authorized to prescribe, administer, or dispense Covered Countermeasures in accordance with Section 564A of the FD&C Act; and (d) a State-licensed pharmacist who orders and administers, and pharmacy interns who administer (if the pharmacy intern acts under the supervision of such pharmacist and the pharmacy intern is licensed or registered by his or her State board of pharmacy), vaccines that the Advisory Committee on Immunization Practices (ACIP) recommends to persons ages three through 18 according to ACIP’s standard immunization schedule.

It is projected that by 2030, one-third of all incarcerated individuals will be older adults. An already overcrowded and underserved prison system is straining to manage the needs of incarcerated older adults with growing frailty and health concerns. In Aging Behind Prison Walls, Tina Maschi and Keith Morgen offer a data-driven and compassionate analysis of the lives of incarcerated older people. Dear friends, my wife, Pauline who is the co-founder of CURE, was instrumental back in the nineties to have Congress pass the Family Unity Demonstration Project (FUDP). Mothers (& fathers) would be able to serve their non-violent sentences in alternative settings with their young children. The people incarcerated called it the 7-7 program. The sentence had to be less than seven years and the children had to be less than seven years old.

 However, Pauline was not getting support for the funding of FUDP. Once, when we were sitting on a bench near the Senate, one of the key Senators walked by, and Pauline took off after him. When she returned I asked her what he thought of FUDP. Pauline said that he thought it was "a good program".

The funding never did come since by then others were in charge, but that Senator is still around. His name is Joe Biden.

FUDP is an example of what the video talks about below. And these alternatives are needed more than ever in the COVID-19 crisis. Charlie

On 28 April 2020, Andrea C. B., a 30-year-old Native American woman and mother of a new-born baby, died after contracting the coronavirus and giving birth. She had given birth just a few weeks earlier while on a ventilator. She contracted COVID-19 in prison, where she had just started serving a two-year sentence for selling methamphetamine.

Andrea should not have ended up in prison in the first place. And she is not the only one.

Like her, many women incarcerated around the world have committed minor offences. Many have a history of victimisation, poverty, discrimination and mental health problems. Many are mothers or carers. For them, prison is not the right response.

However, we are locking up more women than ever. The number of women imprisoned globally has grown by 50% in the past ten years.

When women are imprisoned, their rights and needs are often neglected.

They are often detained far from home, isolated from family and support. 

Behind bars, they can face violence and harassment. Trans women are especially vulnerable.

Ten years ago, the UN Bangkok Rules were adopted. They set out a better world for all women in contact with the law.

To mark their 10th anniversary, we are launching a year-long campaign.

Our goal: to help create a world where there are alternatives to prison for women like Andrea.

And if detention is the only option, a world where prisons meet the needs of all women.

We will support and mobilise independent oversight bodies - and especially national preventive mechanisms - to drive changes at the national level.
National preventive mechanisms are genuine drivers of change.

• Unrestricted access to places of detention
• Review prison records
• Private interviews with women detainees, staff and relatives
• Make concrete recommendations based on their findings

They contribute to changes in laws, policies and practices by engaging in sustained dialogue with the authorities.

These bodies are uniquely placed to drive reforms to policies and procedures to improve how women in prison are treated. They can also promote the use of non-custodial measures.

We will provide practical support across all aspects of their work – monitoring, reporting and advocacy – as well as share good practices to inspire new approaches and collaboration.

Lasting change happens when we all work together.

“A police informant furnished information to the effect that Bud Abbott, the well-known motion picture and television star, is a collector of pornography, and alleged he has 1,500 reels of obscene motion pictures which he shows in his home where he has a projector of his own.”

An FBI agent who lives in Carroll County has been convicted of sexually abusing his daughters over a 14-year period.

John Kenoyer, the late former FBI Bureau Chief in Augusta, Maine was

indicted, March 1986, on child sex abuse charges. Kenoyer had been raping, his children’s ten year old babysitter for over a year. He broke bond and went into hiding after his indictment. Kenoyer was located February 1987, and pleaded guilty to nine charges in June 1987 and was sentenced, September 1987, to nine months in jail followed by two years of house arrest. Kenoyer requested, and was approved by Maine Judge Donald Alexander, to spend his house arrest at Villa Apartments in Coeur D’Alene, Idaho; a complex with a swimming pool, jacuzzi and tennis court. Idaho; however, refused to accept Maine’s sex offender.


Keith Dietterle, a 28 year old FBI Analyst, was arrested, 23 November 2012,

on child pornography charges. He pleaded guilty and was sentenced, 11 September 2013, to more than three years in prison. Dietterle was caught when he sent child sex abuse images/videos to an undercover Washington DC Metro Police (MPD). The MPD officer was posing as a man sexually abusing his 3 year old nephew and 12 year old daughter. Dietterle described the rape of the children as “So hot man … how’d it start?” and discussed meeting the detective to abuse the three year old boy. Upon his arrest, the FBI terminated Dietterle’s employment. Dietterle is a registered sex offender.




Brian Haller, a 40 year old cyber-security expert contractor with the FBI,

was arrested, 13 April 2015, on child pornography charges. He was sentenced, 8 April 2016, to two days and one night in jail followed by ten years of supervised release.
Haller was caught in the FBI’s bust of a child rape website called PlayPen. At the time of his arrest he had over 600 files of child sex abuse. His on-line name was “jb” short for “jailbait.” Haller told investigators he liked to watch the abuse of children 12 to 14 years old and also younger children, including a 40-minute video in his possession showing the sexual abuse of an 11 year old girl. Haller was lead for the Seattle, Washington FBI/private-sector cyber-security group. He had access to a secure FBI on-line platform and email system.





Samuel Kaplan, a 64 year old FBI information technology program manager, was arrested and pleaded guilty, 3 June 2010, to child pornography possession. Kaplan was sentenced, 27 August 2010, to just under four years in jail followed by 15 years of supervised release. Kaplan worked in the FBI’s Chantilly, Virginia office and used “the FBI’s network to facilitate sexually explicit communications.” He was also trading in child rape from his home computer.



Michael Peluso, a 44 year old FBI Civilian Analyst with an undercover unit in

Critical Incident Response Group, was arrested, 9 January 2015, on child pornography charges. He pleaded guilty and was sentenced, 27 May 2016, to no jail time and supervised parole for life.
Peluso was caught trading child rape on-line by an Internet Crimes Against Children (ICAC) Taskforce investigation.

Earlier this month Criminologist Francesca Vianello’s (University of Padua) and my co-authored edited book Convict Criminology for the Future was published by Routledge. Tracing its origins to a conference that was held May 31/June 1 last year, the book, consists of sixteen chapters (and a foreword by Shadd Maruna) written by a team of international scholars on the subject of Convict Criminology.
For those of you who are unfamiliar with Convict Criminology, it is basically a network of individuals who hold a Ph.D. or are on their way to earning a doctorate in Criminology/Criminal Justice or an allied field, and united around the idea that the convict voice is typically ignored in scholarly research and public policy debates. Additionally, scholars who are part of CC represent a diverse group, including those who have been formerly incarcerated, justice impacted, justice-free allies, and/or prison activists.
Since its origins in the 1990s the CC network has participated in public policy debates, taught and mentored scores of students behind bars and those who have been released, and published a considerable amount of scholarly and popular work. Part of this tragectory includes the establishment of the official Division of Convict Criminology (DCC) of the American Society of Criminology during the spring this year. And this new book is now part of development of this field and network.
Why is this book important? Francesca and I had numerous objectives when we held the conference and organized the book. One of them stemmed from our realization that very first book on the subject, Convict Criminology (Ross & Richards, 2003), was increasingly out of date, unnecessarily expensive, and there was a necessity for another edited book that reflected not only a stockkeeping of where CC has been, what it is currently doing, what the future may hold, but the increasing diversity of the people who make up Convict Criminology. Safe to say, Convict Criminology for the Future fulfills these complementary objectives.
In terms of content, what subjects does the book cover? Seven major areas are included:
• Historical underpinnings of Convict Criminology
• Adaptations to prison life
• Longstanding challenges for prisoners and formerly incarcerated people
• Post-secondary education behind bars
• The expansion of CC beyond North America
• Challenges to conducting research in correctional facilities
• Future directions in CC
The book is interdisciplinary in the sense that the contributors have training and experience working in different kinds of social sciencefields. Like the original edited book, many of the contributors who are formerly incarcerated or are justice impacted are presenting their work alongside supportive justice free colleagues who are allied with Convict Criminology. They bring this wealth of knowledge to the pages of this book and to the readers so they can make sense of the complicated world of corrections and to shed light on a viable way forward.
It’s always great to have a project that you and others worked so hard on come to fruition. It presents another opportunity to share what we know with others, address issues we have perhaps ignored, or failed to pay enough attention to, to gauge our progress, to make connections, and to assist others in the quest of making the field of corrections less brutal and more humane.
Doing edited books can be both rewarding and also an anxiety-ridden undertaking. This project had elements of both. More importantly it was a chance to work with people we always wanted to work with and to learn from them. It was also another opportunity to influence, to create, and to share.
The field of Convict Criminology has been all that to me. As the network has grown and matured it has provided fresh opportunities for more experienced members to share what they know, and to attract new people, with new and different ideas and energy, willing to tackle subjects of import to people behind bars, and those who have been recently released, those who study the subject of corrections, and those who want to reform the carceral enterprise. Things that we once thought were impossible and not attainable are all now part of the CC ethos.

Executive Summary

I. Introduction
In May 2000, the Federal Bureau of Investigation (FBI) received credible information that Katrina Leung, one of the FBI's most highly paid assets, was actively spying for the People's Republic of China (PRC) against the United States.1 A year later, the FBI began an investigation that led to the discovery that Leung had been involved in an intimate romantic relationship with her handler of 18 years, Special Agent James J. Smith, who retired from the FBI in November 2000. The investigation also revealed that Leung had been involved in a sporadic affair with William Cleveland, another highly regarded FBI Special Agent, who retired from the FBI in 1993. The FBI's investigation further established that over the years, FBI officials had learned of several incidents indicating that Leung had provided classified U.S. government information to the PRC without FBI authorization. During the 18 years Leung was an asset, the FBI paid her over $1.7 million in services and expenses.
In April 2003, Smith and Leung were arrested. FBI Director Robert Mueller asked the Office of the Inspector General (OIG) to review the FBI's handling of Leung and the performance and management issues relating to her case, and to recommend changes to improve FBI procedures and practices where necessary. The OIG's investigation revealed that the FBI did little or nothing to resolve the numerous counterintelligence concerns that arose during Smith's handling of Leung. This report describes the OIG's investigation and provides recommendations designed to address the flaws we identified, including the FBI's failure to consistently document concerns about Leung, its failure to follow up when concerns arose, and its willingness to exempt Smith from the rules governing asset handling.

An F.B.I. whistle-blower testified Wednesday at the state murder trial of Terry L. Nichols that a government scientist lied when he said ammonium nitrate crystals found on debris from the Oklahoma City bombing had been embedded by the force of the blast.
The whistle-blower, Frederic Whitehurst, testifying for the defense, said an F.B.I. forensic scientist he had trained, Steven Burmeister, also lied when he testified that the crystals came from the kind of fertilizer believed to have been used in the bombing.
Mr. Whitehurst said there was not enough evidence to support either of Mr. Burmeister's conclusions.

Travesties. Government breaking the law, pulling out all the stops to vaccinate our children. Disgusting. We have to stop this.

In the past day, I heard that 12 year olds in Massachusetts are being vaccinated without parental consent.  Last year, the City Council and Mayor of Washington, D.C. signed off on a law that would allow 11 year olds to be vaccinated without parental permission. Now I see that was a prelude to taking Covid vaccine permissions away from parents.
I became aware over the past several weeks that children down to age 12 were being vaccinated in Kings County, WA (Seattle), Philadelphia and San Francisco without parental permission.  Generally this was by order of the local public health official.
Surprisingly, this happened in states that had much higher ages of consent.  So it is illegal.  Since local public health doctors are not the most likely group to risk their careers going out on a limb--to give children experimental vaccines without informed parental consent--the order or guidance to do so must have come from on high.  On high would be the CDC.

Another way the government is pushing to get kids vaccinated is through a chatbot:

It was trained on a dataset created by Johns Hopkins’ International Vaccine Access Center in collaboration with frontline healthcare workers in cities across the U.S...



All three of the aforementioned questions, for example, are met with a friendly but definitive “no” from Vira. When asked whether the vaccine can alter a person’s DNA, Vira replies, “None of the COVID-19 vaccines will change or interact with your DNA. Pinky swear!” Vira, which can be accessed at VaxChat.org, will be continually updated as more people use the tool. After each interaction, Vira prompts users to rate how well the bot answered their question with a thumbs up or down; a thumbs-down response prompts a list of other popular and potentially related questions.



A recent CDC study of people between the ages of 18 and 39 found that those 24 and younger were the least likely in the study group to have reported getting or planning to get the vaccine. Other groups expressing hesitancy included Black participants and those who were less educated, uninsured and had lower household incomes.


More than half of those who expressed some level of hesitancy (56.5%) cited a lack of trust in the vaccines, while almost as many also said they were concerned about possible side effects of the jab.


For the record, when Vira is asked about potential side effects, the chatbot quips, “While you may experience some short-term side effects from the COVID-19 vaccine, like fatigue & nausea, it is a small price to pay to protect your loved ones.”
