These offenses are also covered by articles 34 et seq. of the Convention relating to for the rights of the child adopted in New York on November 20 1989 (Moniteur Belge of September 5, 1991), approved by law Belgian of November 25, 1991 (see Infra).

I. BACKGROUND

1. Abuse issues of children in a psychiatric hospital in Antwerp

The WERKGROEP MORKHOVEN association NATIONAAL is made up of citizens from the municipality of Morkhoven, who came together, first as an association of done then, from 1991, as a non-profit organization, in order to study the problems of child abuse and disappearances.

In 1989, the association was thus interested in the treatment inflicted on minors in a children's hospital in Antwerp (Algemeen Kinderziekenhuis Antwerpen (AKA) Good Engels), following disturbing revelations concerning practices “therapeutics” in the psychiatric section of this hospital, consisting of locking up minors in cells isolated for long periods, sometimes up to 3 months ... ( appendix V, 1 to 5 )

A report drawn up by the gendarmerie of Antwerp reveals that minors suffered ill-treatment and that as a child he would have died in solitary confinement (appendix V, 11).

2. Real and fake societies

It is in this context that MORKHOVEN was led to observe the bizarre behavior people who came and went around this hospital. Among these people, was notably spotted a former policeman from the “DIANE” group, a certain John VL (appendix V, 17 to 21). Their cars had fake plates and these people were supposed to work in firms non-existent (Annex V, 38). Systematic research work was undertaken on addresses, cars and firms concerned.

Three firms were identified as:

1. CV INTERACT :
- the “real” company has its headquarters Amerikalei in Antwerp and sells computers (Annex V, 27);
- the firm identified under the name CV INTERACT is installed Jozef De Bomstraat in Antwerp
and deals with the trafficking of Polish women. In 1990, this firm passed small
advertisements in the daily “Het Nieuwsblad” in order to recruit women
( annexe V, 31, 32, 33 ).


2. R.B.E. :
- Real society: construction company, to Erembodegem
- False society: detective office, the same address as the previous one: Jozef De
Bomstraat in Antwerp (Annex V, 28 - 31).


3. MONDIAL PALLET :
- Real company: MONDIAL PALLETTES: pallet manufacturer ( appendix V, 26 )
- False society: textiles, videos: Jozef De Bomstraat, in Antwerp (Annex V, 29 – 30).

Within the “false” CV INTERACT company, the MORKHOVEN non-profit organization has spotted and followed a certain Harry H., whom she suspected of having kidnapped an Antwerp boy who disappeared at the age of 14, Nicolas P. His disappearance, in the company of a 43-year-old man, was reported in Antwerp on January 28, 1988 ( appendix V, 16 ). The MORKHOVEN non-profit organization suspected that it had been driven to Germany by Harry H. With others associations, MORKHOVEN notified the Munich police. A month later his disappearance, the young boy was found by German police in Munich and returned to his family. He was severely traumatized and died a few years later, in Antwerp.

Harry H. admitted on camera that he had taken the child to Germany; he did claiming that he had authorization from his mother. Despite the latter's denials, it was not concerned (annex V, 38 and annex VI, 2, issue Legs, ultimately).
3. L’a.s.b.l. GANUMEDES

While MORKHOVEN inquired on Harry H., leader of the GANUMEDES non-profit association, Mrs. Patsy SORENSEN (PAYOKE asbl) advised them to take an interest in the Antwerp association GANUMEDES, whose social purpose was to the development of young people, and which seeks in particular, through classified ads, children for filming of films for young people.

The president of GANUMEDES was a certain Jos J. Now, another man called Jos J. was presenter of a children's show the BRTN. This homonym has caused confusion among some parents. Jos J. from BRTN indeed received hundreds of responses of children interested in the organized filming by GANUMEDES. A mother even addressed to Jos J. of the BRTN to inform him that his child had been abused within the GANUMEDES association. Children have reported that Jos J. de GANUMEDES had offered to film in pornographic scenes (appendix V, 38).

MORKHOVEN found a match of Jos J. establishing his contacts, via GANUMEDES, with pedophiles to organize evening debates on pedophilia (Appendix V, 22). The association also discovered that GANUMEDES compiled more than 400 files containing the contact details and the photos of the children candidates for the filming. MORKHOVEN vzw gave these files to the gendarmerie of Herentals.

On December 5, 1990, the Minister of Justice Melchior WATHELET replied to the WERKGROEP MORKHOVEN that the investigation by the judicial police of Antwerp did not reveal any suspicious element on GANUMEDES ( appendix V, 23 ).

However, in August 1996, Jos J., president de GANUMEDES, was arrested following a bailiff's seizure of justice (linked to tax debts). Of numerous pedophile films and photos were discovered at him (Annex V, 38). He was arrested again in February 1998 for suspicion of indecent assault and rape of at least two minor boys (appendix V, 35, 38). The prosecutor of King of Antwerp recently requested against a sentence of seven years in prison.

MORKHOVEN noticed certain disturbing coincidences. Several children missing in the region of Antwerp, at the end of the 80s and at the beginning 90s, were AKA patients, such Kim and Ken.
In 1994, GANUMEDES asbl moved for a building located opposite the AKA parking lot. If weapons and fake visas were discovered at John VL's house, the complaint against him linked to child abuse of the AKA was closed without further action (appendix V, 17 – 18).

In 1999, staff members of the AKA would have been condemned for abuse and violence against child patients.

4. Thames Network – Madeira

MORKHOVEN's research around of Harry H. revealed the existence of ramifications with organizations dealing with young people, sex shops, bars and film studios, in Belgium, Holland and Portugal, in Madeira.

A network was thus updated of child pornography called the "Thames Network" (Temse) – Madeira”.
People of various nationalities came together in the framework of organized stays in Madeira in order to engage in sex with children. These antics were filmed and the images sold to other clients.

Among these images, a video cassette, entitled “Madeira”, contains the “film of holidays" of three pedophiles, a Belgian from Thames, Norbert DR, a Portuguese, Agostinho DS, and a Dutchman, Robert VDN These train Portuguese minors in their room for antics, for a few coins... (appendix VI, 1) There is mentions a boy, described quite crudely, intended for a Belgian client with the first name of Philippe. He will be identified as Philippe V., living in Sint-Niklaas.

MORKHOVEN discovered that departure from MONTY and GAYATI cafés in Thames, minors breaking up or running away were taken to the DP studios in Utrecht (Netherlands), to shoot in porn films.
The video cassette “Madeira” was released several times in Belgium, at the MONTY café in Tamise, as of “travel catalog” of the island of Madeira and the “facilities” it offers. The operator of GAYATI, named Bert M., a Dutchman from Hulst, organized these trips.

On January 29, 1992, MORKHOVEN sent to the Minister of Justice related photos and videos to the Thames network. Acknowledgment from the minister's office of January 31, 1992 confirms that all these documents are transmitted to the attorney general at the court of appeal of Ghent (Annex V, 24).
The same year, the president of the association MORKHOVEN, Mr Marcel VERVLOESEM, was the subject of complaints for fraud, blackmail or defamation, on the part of people gravitating around the MONTY and GAYATI cafés, in Thames: Monsieur André L., reinforced by the testimony of Dirk T. and Bruno F., the latter being close to Harry H.

Later, Dirk T. will declare on NOVA TV (Holland) and in a response to the press, that this file was completely fabricated parts by L. because “VERVLOESEM went too far” (Annex V, 53).

Marcel VERVLOESEM was the subject of a fifteen-day detention in 1997, within the framework of this complaint. On this occasion, he was able to read the file repressive concerning the "Thames network" and obtain confirmation that the Dendermonde prosecution was in possession, since 1992, of numerous exhibits, like hundreds of photos of a pedophile nature and 27 videos, including the one filmed by Norbert DR himself, with children from Madeira, as well as many hearings including, in particular, confessions from certain abusers (appendix V, 40 to 51, 96). In February 1992, searches were ordered at Norbert DR, Hans B. and Bert M. (appendix V, 51, 45). Among the material seized from the latter was, in particular, a video cassette (n° 20) marked “Portugal-Madeira » (Annex V, 51, 42). During a search carried out on February 6, 1992 at the home of Casper VM, in Waalre ( Netherlands), the Dutch police found this one in the company of Lothar G, Norbert DR, Robby VDP and Harrold VDP, occupied watching a porn video shot in Madeira with small Portuguese. During his hearing, Lothar G. admits knowing Norbert DR and having already met at home a English, a certain Warwick (appendix V, 40).

The prosecution therefore had elements enabling prosecutions to be initiated in 1992.

MORKHOVEN denounced the slow pace of justice in this case. She's the MP Nelly MAES (VU) who will publicly relay these accusations, which will make several headlines in the press (appendix V, 74 – 76). Interrogated in November 1997, the Minister of Justice DE CLERCK affirmed that the investigation did not uncover a pornography network childish! (Annex V, 73, 78, 81). Less than a year later, July 1998, this same minister will recognize the effectiveness of the work of MORKHOVEN, who had just revealed the existence of the Zandvoort network, and addresses the Dutch press in these terms: “everyone knew these things were happening for a long time, but we closed our eyes too long » (annex V, 79) …

Marcel VERVLOESEM also had noted in the Tamise file the names of accomplices. Thus, a Interpol-Lisbon fax of September 18, 1992 mentions the discovery of a network of sexual abuse of Portuguese children and filming of pedophile films, which involves the five people following:
- Norbert D.R.
- Lothar G.
- Casper V.M.
- Robbie V.D.P.
- Robert VDN (appendix V, 54)

Furthermore, the photo of a man had been extracted from the film “Madeira” and this one was mentioned in a PV as “no one identified”. He was also cited in the Interpol fax and reported to the Beveren gendarmerie from 1992 by Dirk T. and Norbert DR (appendix V, 95, 46, 48, 51 ). Marcel VERVLOESEM was able to quickly identify Dutch Robert VDN, find him and contact him.

Around October 1997, during a meeting in Amsterdam, he was able to convince Robert VDN to give him the “Madeira” cassette. Marcel VERVLOESEM immediately went to Madeira and handed over this cassette at the PJ of Funchal (Portugal) (annex V, 95 ). Marcel VERVLOESEM then meets Robert VDN again in Hulst in the presence of the television team Dutch NOVA. On this occasion, VDN hands over four pedophile tapes, brought back by Bert M. from Madeira. A copy of these tapes is immediately handed over to the Funchal police. Informed by MORKHOVEN, the Attorney General of Funchal then launches an international arrest warrant against all identified perpetrators on the tapes. Based on this warrant, the Dutch police arrest Bert M. in Hulst.

International arrest warrants issued by Portugal go at the same time – and therefore in 1997 only – allowing the arrest of Norbert DR and his acolytes, Robert VDN and Agostinho DS (annex V, 59 at 65, 82 – 83).

Philippe V., identified as a Belgian customer on the “Madeira” cassette is arrested in December 1997, following a search of the Aalst BSR which made it possible to discover 300 pedophile videos his domicile (appendix V, 84 to 86). Other contacts are arrested in the Philippines.

Norbert DR was sentenced in 1999 by the Criminal Court of Dendermonde to 5 years in prison firm and 10 years of forfeiture of his civil rights and policies (appendix V, 87, 88). In degree of appeal, this sentence was increased, in February 2001, to eight years of prison closed by the Court of Appeal of Ghent (annex V, 89). Ten children and their parents became civil parties and obtained damages.
Agostinho DS was sentenced to two years in prison prison in Portugal. Robert VDN was sentenced in 1998 to two years in prison in the Netherlands (Annex V, 98).

In September 2000, the Netherlands extradited their national, Bert M., to Portugal to be tried there (appendix V, 97, 98). Marcel VERVLOESEM is invited as a witness in the trial taking place in Funchal (Portugal ).

5. Zandvoort Network

Another network was made public brought to light by MORKHOVEN in July 1998.

Using pedophile material coming from the Thames-Madeira network, the association has relaunched its search to find a missing young Berliner in Berlin in 1993, at the age of 12, Manuel S., as well as two other German children.

MORKHOVEN thus discovered that the Belgian Robbie VDP, whose name already appeared in the legal file of the case "Thames-Madeira “, was involved in a network of trafficking of children leaving Berlin for Amsterdam or Rotterdam. Under the cover of a computer company "Cube Hardware “, located in the Dutch seaside resort of Zandvoort, the Netherlands, VDP and his companion, the German Gerrit U., exploited child pornography. System equipped BBS computer, they were selling pedophile pictures and movies from their “APOLLO” website.

Robbie VDP agreed to meet Marcel VERVLOESEM. Several meetings took place in May and June 1998 in Amsterdam, on the terrace of a café on the Rembrandplein.
On June 4, 1998, he agreed to have the interview filmed by the RTBF Miscellaneous Facts team ( appendix VI, 1 ).

At the end of this meeting, Gerrit U. will join Robbie VDP and, unbeknownst to him, will arrange a meeting with Marcel VERVLOESEM (see audition dated 05/30/2000 from Marcel VERVLOESEM on French rogatory commission : appendix X, 1 ). Suffering from a serious illness, and clearly worried, Gerrit U. organized a meeting on June 11, 1998 with Marcel VERVLOESEM in his apartment in Zandvoort. On this occasion, he handed over 8,000 photos stored on disk from hand to hand JAZ (1 gigabyte), children and adolescents, mostly males, in pornographic situations. Among the material Also included are diaries and address books. The same day, Marcel VERVLOESEM informed the BSR of Aalst.

A few days later, Gerrit U. was assassinated in Italy and his companion, the Belgian Robby VDP was arrested for this murder. Just before his death, Gerrit U. had again telephoned from Lyon to Marcel VERVLOESEM to tell him the place of his secret hiding place, under the floor. When he learned of his death on June 19, 1998, Marcel VERVLOESEM contacted the family of U. whose he communicated the information received. These documents were eventually seized by the Dutch police. Many children's clothes children were also found there.

In July 1998, MORKHOVEN publicized the discovery of this “Zandvoort network” (Annex V, 93 et ​​seq.).

On July 20, 1998, the Turnhout police, accompanied by a Dutch policeman, searched Marcel VERVLOESEM's home and found nothing there. THE next day, the BSR of Geel arrested Marcel VERVLOESEM during a few hours. After a discussion, the person concerned gave them, in duplicate, the diskettes in his possession. THE Geel gendarmes, however, did not provide a copy of this material to the Dutch police. In August 1998, the investigating judge let it be known that he might consider handing over certain documents to the Dutch justice when the investigation would be closed or when certain parts are no longer needed. Not before. (Appendix V, 101).

On August 24, 1998, it was Marcel VERVLOESEM himself, under the eyes of the cameras, who will finally deliver a new copy of the diskettes to the Dutch font.

Dutch investigators have could seize at the home of U. a CD-Rom containing 90,000 photos, diaries and address books. These documents showed contacts between individuals and banking establishments many countries, including the Netherlands, France, Great Britain, Spain, Sweden, Poland, Ukraine, Latvia, the United States… At first, the Dutch police in Kennemerland attempted to minimize the scope of this discovery, leaving to hear that it was a dead end.

In June 1999, the MORKHOVEN association announced to the Dutch press that she was in possession of a research album from the Kennemerland police including 570 photos of children's faces taken on the computer equipment of the “APOLLO” site, as well as that 17 photos of adult pedophiles appear on this same material (Annex V, 128, 129). The Kennemerland police reportedly started by denying the reality of this information, while the album had been released to intended for the Dutch police services ( appendix V, 109 ).

Dutch journalists were able verify that this documentation actually existed. In fact, the album had been given to MORKHOVEN by senior Dutch police officials, apparently convinced the effectiveness of the work of this association. Unfortunately, this album remains - or has remained - confidential, if not untapped by the competent judicial authorities. It would not be May 5, 2000 that was launched a notice of search (BCS) to identify child abusers who appear on the CD-Rom (appendix V, 135).

6. Links between people and pedo-criminal organizations

In a confidential note from September 1992, not very complacent towards MORKHOVEN asbl, the Minister of Justice WATHELET confirmed the existence of a “pornotour” organized in Belgium at destination of Hulst and Utrecht (Netherlands) (Annex V, 25, p. 14). In response to a parliamentary question, the Minister of Justice VAN PARIJS declared, in April 1999, that the investigations had not could demonstrate a link between the Madeira file and the file from Zandvoort. He further clarified that all information provided by the MORKHOVEN non-profit organization had been taken seriously (Appendix V, 126).

a) Among the addresses and numbers telephones included in the Zandvoort material, were the references of people including MORKHOVEN had spotted criminal activity since 1992 :
- Lothar G.
- Robbie V.D.P.
- Karel VM (alias Alex PRIVE)
- Bert M.
- Warwick S.

Lothar G., pimp young boys in Rotterdam, is accused by Robbie VDP of the kidnapping of German children, including Manuel S.

Robbie VDP and Lothar G. were partners in the operation of bars in Rotterdam, where many minor prostitutes were found. During the interview filmed by the Facts team Miscellaneous (RTBF), June 4, 1998, Robbie VDP testifies to having attended meeting Lothar G. and Manuel S. in a bar near from Berlin station, in July 1993. They then left together in Hamburg. Manuel was then aged of 12 and a half years (appendix V, 94). Manuel would have been seen later in Lothar G.'s bars in Rotterdam (annex VI, 1 ).

In 1994, Lothar G. was arrested following searches by German police in Rotterdam. Many miners were extracted bars of Lothar G., but to this day, Manuel S. has still not not been found. Lothar G. was sentenced in October 1995 in Rotterdam to a six-year prison sentence, of human trafficking, debauchery of minors under 16 years of age and employment of boys under 16 18 in a brothel. The second operator, Henk S., was sentenced to five years in prison. Many of their clients, including a Frenchman, an Englishman and two Americans, were also sentenced to prison terms
( annexe V, 111, 112 ).

In June 1998, Robby VDP claimed that Manuel S. would still be alive. During the interview, VDP recognizes his links with Norbert DR, Lothar G. and Warwick S. and confirms that these men are in close business relationship. Robbie VDP was imprisoned and, in November 1999, Marcel VERVLOESEM is invited as a witness in the trial opened in Pisa for the murder of his ex-companion Gerrit U. (appendix V, 130, 131). He was sentenced to fifteen years of prison, which was confirmed on appeal in February 2001 (Annex V, 134).

Although his lawyer claimed that the investigation in the Netherlands was closed (Annex V, 132), it seems that the Dutch authorities have Furthermore, he was charged with the following charges: : production and dissemination of rape of minors on the Internet; kidnapping from Manuel S. from Germany to the Netherlands on August 24, 1993 ; participation in a criminal organization. ( appendix V, 133 ).

So there are clearly connections between the different people involved, as well that there are links between the Thames-Madeira network and the Zandvoort network. Remember that the request from Interpol-La Haye to Interpol-Lisbon on September 18, 1992 already confirmed that there were relations between Lothar G., Norbert DR, Casper VM and Robbie VDP

Karel VM, alias Alex PRIVE, was arrested during the discovery of the Zandvoort network. He was sentenced to three years in prison in February 1999 (Annex V, 113).

Bert M., the operator of GAYATI in Thames, notably took miners from Thames to Utrecht, at DP Studios, run by Dutchman Rudy VD Involved in the Madeira sector, he is arrested in the Netherlands and extradited to Portugal to stand trial.

Warwick S., was imprisoned in 1994 in Britain and sentenced to seven years in prison – reduced to five years on appeal – for kidnapping, taking indecent photos and assault serious sexual assault of a 14-year-old boy (appendix V, 117). scotland Yard and Dutch police said they were shocked by his release anticipated in June 1997 (Annex V, 117). This Englishman, who stayed in several cities in Europe, was involved in the kidnapping, rape and prostitution of young boys. He is involved in the Tamise-Madeira case and is among those charged in the Funchal trial (Portugal) (annex V, 125, 127). His references appeared in particular in Zandvoort equipment. His name would also have been cited in the Namur investigation into the disappearance of Elisabeth B. (Appendix V, 125).

The testimonies to his subject are worrying (appendix V, 114, 115, 116, 119). In a British television report entitled “ Boy Business”, the journalists were able to interview a former companion of Warwick S., named Edward, who came out of this milieu. He implies Warwick S. in the murder of several young boys at the occasion of the filming in Amsterdam of "snuff-movies » either video films showing children whose abuse resulted in a death sentence. He admits to having seen such films and describes in particular one of them in which a child died of suffocation in the genitals of his abuser. This scene took place on a boat ( annex V, 116 and annex VI, 2).

b) Just like their website was called APOLLO, Robbie VDP and Gerrit U. also organized cruises on the luxury sailboat of the same name, “APOLLO”, owned of a Dutch businessman, Léo VG. Pedophile photos discovered in material of Zandvoort, show this yacht in the background.

c) In a signed declaration on March 31, 1998 at the Berliner Morgenpost, a former associate of Lothar G., the Berliner Peter G., admits to having been involved, from 1990 to 1993, in child trafficking from Germany (Berlin and Hamburg) and Poland to Holland
(Amsterdam and Rotterdam) via Belgium (Antwerp). According to him, 200 children would thus have been delivered during this period (appendix V, 120, 121, 122, 123).

d) Links also appear between the Zandvoort network and the discovered network in 1993 by John S., who edited the homosexual guide SPARTACUS. The SPARTACUS guide affair highlighted the existence of a child pedophilia network, but the trial of former pastor John S. could not be carried out eventually following his death.

According to a Belgian policeman, Robby VDP would appear in the early 1990s in the survey SPARTACUS (Appendix V, 96).

John S. was a good friend and a business relationship of Lothar G., Karel VM and Rob C. (Annex V, 124).

In John S.'s file is the declaration of Rob C. of the agency "Opera Tour Thailand Travel" which specifies: "I was in contact commercial with John S. of the SPARTACUS guide. Location: Pattaya. Gold, Rob C. is part of the firm "Dusedo" in which Karel VM, alias Alex PRIVE, provided equipment (appendix XI).
On the death of Dutch senator B., the Foundation BRONGERSMA, dealing with helping children, discovered that the senator had 90,000 photos of pornography childish. These photos were handed over to the authorities. The senator B. wrote in the pedophile journal PAN, published by SPARTACUS (see Appendix X, 8). The Foundation was disqualification. The hardware inquiry would always be in progress.

e) It is interesting to compare photos from the Kennemerland police research album with photos of minors appearing in pedophile magazines.

For example :
Photo no. 130 from the first research album of the Kennemerland police represents the face of a little blond boy. This same photo and other photos of the same child are found :
in the French pedophile magazine L'enfant impossible, under the signatures of A. WOOD, JACQUEMARD SENECAL and JM VUILLAUME and in the Dutch magazine OK Magazine (MARTIJN) of May 1997, as being published by POJKART (Lübeck - Germany) (appendix X, 3, 5, 6).

Photo no. 223 from the first album search of the Kennemerland police represents another boy of which we find photos in the French pedophile magazine The impossible child, under the signatures of A. WOOD, JACQUEMARD SENECAL and JM VUILLAUME and in the Dutch magazine OK Magazine
(MARTIJN) from May 1997, as published by POJKART ( Lübeck - Germany ). One of the photos titled Sleeping beauty: archief MARTIJN, illustrates an eloquent text: “ Leven als pedofiel in België”…(annex X, 4, 5, 6).

7. Locating, meeting and inducing the confession of Robert Jan W.

In February 2001, MORKHOVEN met a 28-year-old Dutchman, who said he lived near of 15 years in the sadomasochistic milieu of Amsterdam, first as victim then as actor. On February 27, 2001, he surrendered to the police in Haarlem (Netherlands) accusing himself of having killed 13-year-old boy after abuse sexual acts that were filmed. Robert Jan W. would have notably known Robby VDP He claims that Marc D. was part of the network that he denounces and which revolved around a sadomasochistic bar from Amsterdam and an address where children were brought in to be abused and photographed: Admiraal de Ruijterweg, 111 in Amsterdam. Robert Jan W. seems unaware that this is one of the commercial contact addresses from “Roxanne”, alias Didier P. “Mistress Roxanne » gives this address himself after a sequence of demonstration of his talents on the cassette video “Belgium submitted”, a sort of illustrated catalog sadomasochistic meetings in the country (appendix V, 137, 138, 139). Robert Jan W. gave MORKHOVEN his address books and diaries as well as his computer and quantity of floppy disks. This material still needs to be examined MORKHOVEN of course issues any reservations about the credibility of this witness, which has yet to be established.

8. Method used

The MORKHOVEN association has put developed a working method which essentially consists of :
- scouting, especially via the Internet
- identifications and creation of files
- spinning mills
- telephone interviews
- unannounced visits with cameras
- collections of confidences and documents, most often with cameras
- communication of information and documents to the authorities.

9. Transmission of documents to the authorities

The CD-ROM of 8000 photos, both Kennemerland police albums as well as several journals and files addresses were sent by MORKHOVEN to many official authorities, including: FBI, Interpol, PJ from Brussels and Aalst, BSR from Turnhout and Aalst, police Dutch (Kennemerland), French PJ (Paris), fonts German (Bundeskriminaliteit), Swiss (Lausanne), Austrian, Portuguese (Funchal), Italian (Pisa) as well as the public prosecutor's office of Pisa.

In April 1999, this same material was sent to most heads of state Europeans, in particular the President of the European Parliament, the Queen of England, the Queen of the Netherlands, the King of the Belgians, the French president, the German president, who have acknowledged receipt (Annex IX).

The MORKHOVEN association received congratulations for his stubbornness and courage from the authorities German, English, French, Dutch, Austrian and many Belgian parliamentarians.

On the Facts show Miscellaneous from RTBF from September 1998, child psychiatrist Jean-Yves HAYEZ commented, in front of the camera, on the vision of unbearable images rape of a baby (annex VI, 1). a child psychiatrist, professor at the University of Utrecht, said he did not never seen such horrible images in his entire career ( appendix V, 99 ).

Out of dismay, parents and associations have sent the non-profit organization numerous photos - several thousand - of missing children in various countries Europeans to carry out research.

MORKHOVEN recently collected, through other channels and on the Internet, thousands of photos and films of a sadistic and pedophilic nature. It is most of this material, currently constituted, that the MORKHOVEN association places in the hands of Mr. the King's Prosecutor of Neufchâteau (appendices I and XX). She is at his disposal to provide him with any information or additional documents.


10. Discredit and prosecution in Belgium against members of the MORKHOVEN non-profit association, and in particular its current president, Marcel VERVLOESEM

Several times, from the beginning of their activities, several members of the MORKHOVEN association have been the subject of various complaints and intimidations, clearly intended to discourage them from continuing their research. Complaints were often filed by people in which the association was interested because of their illicit activities with minors.

Marcel VERVLOESEM recently made the subject of serious accusations in the media. The press has in fact announced that he should soon appear before a criminal court to answer for the rape of nine young boys.

The person concerned contests formally the content of these accusations and emphasizes that it is by the press of February 14, 2001 that he learned that he would have been charged with these facts and dismissed soon before the criminal court. If this is the case, it will have the opportunity to defend himself and assert his rights in a public trial.

MARCEL VERVLOESEM actually heard only once, in 1998, on the basis of complaints of this order – highly suspicious – and has since no longer have any news of this matter. It is therefore incorrect that was recently heard by the Turnhout public prosecutor's office on this subject. He never received any notice of charges neither announcing the settlement of this procedure, nor the slightest summons to appear before a council chamber or a criminal court.

It's September 10, 1998, the next day of the broadcast of the RTBF program Faits Divers, entitled “Pedophile networks”, that the parents of a young boy living in the neighborhood of Marcel VERVLOESEM, file complaint against him for sexual abuse he allegedly committed ten years earlier on their son. However, the first investigation carried out by the Turnhout judicial police would have made it possible to charge for these facts another person.

Marcel VERVLOESEM was also accused of having lured this young boy to him to make him watch pornographic video tapes. However, video cassettes were indeed seized, but they come… from the house where this boy lived with his parents… Marcel VERVLOESEM filed a complaint against these parents for defamation.

From 1993, the screenplay of the complaint was already recorded in a report... Indeed, it appears from a report of May 7, 1993 from the Turnhout public prosecutor's office (PV No. 101017/226 - File No. TU.37.99.100.831/93) that Mrs. Jeanine VS, the mother of the aforementioned boy, who will lodge a complaint against Marcel VERVLOESEM in September 1998, had lodged a complaint five years earlier against Madame Jeanne DM She states in particular that this lady had given her three cassettes pornographic videos for her husband:

“One or two more months late, (Madame) DM hinted to me that in exchanging porn tapes, I, or better my husband, had to do a small favor. I had to make a statement about VERVLOESEM. (…) DM wanted us to declare that a a certain H. had given money to VERVLOESEM. I never understood this request. She also said that she would give us money to testify against VERVLOESEM. (…) DM is trying to get our heads together against VERVLOESEM. I know him only a little. He lives in our neighborhood. We don't want to hear about this case. Often we received phone calls. DM threatened to warn the police because we were in possession of porn tapes. My husband had enough and was forwarding himself these tapes to the floor. DM claimed she had already filed a complaint against us because children would have come to see these porn movies with us. (…) » ( annexe XXI, 11 ).

The PV acts that pornographic cassettes have been delivered to the Registry of the Criminal Court from Turnhout. The own son of the aforementioned Madame Jeanne DM filed a complaint against Marcel VERVLOESEM. But he would himself the subject of a complaint dated April 5, 1993 from the parents of an 11-year-old girl whom he allegedly abused (file no. TU.37.18.100.734/93 open to the Herentals judicial police ) (Appendix XXI, 11).

This same Jeanne DM, as well that Maria H., had already filed a complaint against Marcel VERVLOESEM in 1992 on the count of fraud and abuse of trust. The appeal level procedure made it possible to revealing false statements by the complainants and Marcel VERVLOESEM was acquitted by the Antwerp Court of Appeal January 30, 1997 (Appendix XXI, 9).

A man named Jan J. also signed a receipt for the sum of 50,000 BEF given to him Madame Jeanne DM to file a complaint against Marcel VERVLOESEM … ( appendix XXI, 12 )

On the initiative of the daily Gazet van Antwerpen, the complaints of the head of pedophilia brought against Marcel VERVLOESEM have been widely publicized in October 1998.

One of his half-brothers, Vic, notably accused him during an interview on 21 October 1998, of raping him for four years. It's necessary knowing that Marcel VERVLOESEM never lived with this half-brother, the existence of which he learned only belatedly. The tensions are explained when we know the history little banality of this fragmented family (Appendix XXI, 1). Vic has it also accused of committing abuse on other children. In the next day's Gazet van Antwerpen, October 22 1998, it was about a young man, Johan D., who accused also Marcel VERVLOESEM for having raped him when he was 15-16 years old.

Johan D. is none other than the companion of Vic. However, these two people would themselves be the subject of denunciations of sexual abuse of minors.

One of Marcel's sisters VERVLOESEM, Maaike, thus declared that Vic was involved in a vice affair with a 12-year-old boy years, with knife threats (Annex XXI, 8). Herentals police and a doctor should have intervened.

Among the complaints filed against Vic and Johan D., figure that of a young girl who says she has beaten and raped by Johan D. This rape allegedly led to a pregnancy, but as a result of the ill-treatment suffered by Johan D., she would have had a miscarriage at Herentals hospital.
The other young people at the origin of the complaints would be in the entourage of Victor V. and Johan D. Under various means of pressure, they would have agreed to testify against Marcel VERVLOESEM.

It is interesting to note that these complaints immediately follow the revelations of the summer of 1998 relating to the Zandvoort network by the non-profit association MORKHOVEN and the media coverage of Marcel VERVLOESEM.

It is clearly these complaints which were publicized on February 14 and 15, 2001, to report the decision to dismiss Marcel VERVLOESEM before the criminal court of Turnhout on charges of rape and sexual abuse of nine young boys. To date, the person concerned has still not received a notice of indictment nor summons to appear before any court.

In November 2000, at the request from the Turnhout public prosecutor's office, Marcel VERVLOESEM was dismissed before the criminal court for “receiving material paedophile” (Appendix XXI, 5). This case does not yet been judged.

pedophile material in question specifically concerns the documents collected in June 1998 by the association MORKHOVEN in the context of the case Zandvoort (Appendix XXI, 6); thousands of photos and many films revealing indecent assault, rape and torture of children, sometimes very young. In many country, families claim to have recognized their child on one of these CD-Roms, the existence of which was particularly well publicized in France during the year 2000 (Appendix VII, L'Humanité, Le Figaro, France 3, Canal +, etc. ).

The MORKHOVEN non-profit organization holds the evidence she sent, notably at the end of 1998 and the beginning 1999, the material in its possession to numerous authorities judicial and police, as well as heads of state Europeans, from whom she received warm congratulations …

11. Other results obtained by the non-profit organization WERKGROEP MORKHOVEN

- Children found after their disappearance

As part of its activities, the MORKHOVEN association was able to find nine missing children alive.


- Identification of children

Many children and different abusers are visible and identifiable on the CD-Roms.
To date, various researches could have enabled the identification of nearly twenty children by their families:
a child in the USA (Baltimore)
a child in Germany (Koblenz)
a certain number of children in France (Paris, Lyon, Toulouse, Ardèche ).

It would be possible to perform rigorous analyzes of these photos by comparing, using of a specialized computer program, an element precise, like the ear of the child appearing on the photos with a photo of the supposedly identified child (Carine HUTSEBAUT, Profiling profession, Le Cherche Midi Publisher, 2000 ; appendix VII, Le Figaro, 10/05/2000).

It should be noted that many photos may have been doctored. Thus, in particular, several children's faces featured in the police scrapbook from Kennemerland seem to correspond well to girls who say having been abused. However, when we find the complete photo from which the one in the album is taken, it reveals that the child is decked out in a boy sex. This is the case for various photos whose faces show features of girls, to which one would have " glued" a boy's body.
(See: appendix X, 9 – 11 – 15).

Photo n° 129 of the album Kennemerland police search looks like striking to that of Katrien DC, who disappeared in Antwerp on December 17, 1991 at the age of 15, and whose the body was found six months later, during earthworks in the port of Antwerp. Katrien DC's parents did not wanted to identify this photo. Two of her best friends, and parents of one of them, however formally recognized it (Annex VII, 4).

It will be recalled that the murder file unsolved by Katrien DC had been revived following the testimony of Regina LOUF (known as the witness "X1" of Neufchâteau), who says he attended and had to participate in his killing in a castle from the Antwerp region.

For only reaction, the floor d'Anvers considered that photo 129 rather represented a boy. It turns out, in fact, that on the complete photo, the child does have a male sex ( appendix X, 9 -10 )

This is also the case another small Belgian victim; like many members of her family, she recognized herself in a photo from the album of the Kennemerland Police. On the photo of the CD-Rom, however, it is a boy's body that appears (appendix X, 11-12).

In France, in Annemasse, a young girl, her half-brother and half-sister, complained of sexual abuse committed by several people, some of whom were pedophiles or had many connections in circles pedophiles ( appendix VII, 15 ). On appeal, at least one of the abusers was sentenced. These children were recognized by their family on the Kennemerland album. And there again, the complete photo of the Zandvoort CD-Rom reveals a boy's penis...

It is important to be aware of the easy manipulations possible. They can also wear on eye or hair color, on scars, tattoos, on decorative elements, etc.
Identifications based on photos are of course very delicate, hence the importance of scientific techniques that can be used to this end.

Among the photos in this album, also finds that of a 20-month-old child, who had was spotted by a former collaborator de MORKHOVEN, Gina BERNAER-PARDAENS, as presenting strong similarities with a missing baby in the United States, near of Chicago, in April 1988 (Appendix VII, 1).

Gina BERNAER-PARDAENS sent a CD-Rom of these photos to the CIDE (International Committee for the Dignity of the Child) in Geneva (appendix V, 107). While she felt followed and had been threatened with death several times, Gina BERNAER-PARDAENS contacted the Gendarmerie of Galmaarden on 13 November 1998 to report that she received an anonymous phone call threatening her of a fatal car accident or of being killed of a bullet. On November 15, 1998, two days later, she actually lost his life when his car crashed on a bridge in Halle (appendix V, 106 – 108). The threats of death were recorded in a report (Appendix V, 105). Mr. Georges GLATZ, President of CIDE, wrote to the Federal Office of Police Bern to send them the documents and information that came to send Gina BERNAER to him, asking them to send them to Interpol (Appendix V, 107).

II. LEGAL BODY OF THIS PLAINTE

1. This is part of in the spirit of the decision of the Council of the Union of May 29, 2000 relating to the fight against pedophilia on the Internet ( 2000/375/AI ), from which it appears in particular that the Council: “ whereas human trafficking and exploitation child sexual abuse constitute a serious violation of fundamental human rights of the human person and in particular of human dignity,

aware that the exploitation child sexual abuse as well as the production, processing, possession and dissemination of child pornography material may represent a significant form of international organized crime the scale of which constitutes a subject of further concern increasingly within the European Union,

convinced that respect for the integrity physical and mental health of children and the protection of victims of exploitation sex are of paramount importance and must be at the heart of the concerns of the European Union,
( … )
with the aim of preventing and combating the exploitation child sexual abuse and, in particular, the production, processing, dissemination and possession of child pornography on the Internet,

DECIDE :
Article 1er

2. As part of the decision No. 276/1999/EC of the European Parliament and of the Council
(…), the Member States shall take the necessary measures to encourage Internet users to report law enforcement authorities, directly or indirectly, cases of alleged dissemination of child pornography on the Internet, if they find such material there. (…)

3. Member States shall ensure that law enforcement authorities react quickly when they receive information on alleged cases of production, processing, dissemination and possession of pornographic material. (…)

Article 6

4. The Council assesses the extent to which Member States respect the obligations incumbent upon them under the joint action 97/154/AI, as well as the effectiveness of the proposed measures in this action. (…)

Article 8

The measures provided for by the this decision are implemented by the Member States members
no later than December 31, 2000.” (Appendix III, 1).


2. The offenses referred to herein are expressly prohibited by the Convention on the Rights of the Child, adopted in New York on November 20, 1989 (Moniteur Belge of 5 September 1991), approved by the Belgian law of 25 November 1991 (Belgian Monitor of January 17, 1992):

Article 34: The States Parties undertake to protect the child against all forms of exploitation sexual abuse and sexual violence. To this end, States take into account particular all appropriate measures at the national level, bilateral and multilateral to prevent:

- that children are not forced to engage in illegal sexual activity ;
- that children are not exploited for prostitution or other illegal sexual practices;
- that children are not exploited for the purposes of production performances or material of a pornographic nature.

Article 35: States Parties shall all appropriate national, bilateral measures and multilateral to prevent kidnapping, the sale or trafficking of children for any purpose and in any form whatsoever.

Article 36: States Parties shall protect the child against all forms of harmful exploitation any aspect of their well-being.

Article 37: States Parties shall ensure that has :
(a) no child shall be subjected to torture or to punishment or cruel, inhuman or degrading treatment. (…)”

In Belgium, were voted on November 28, 2000 the law relating to criminal protection minors and the law relating to computer crime (Moniteur Belge of 02/03/2001).


3. As set out above, this complaint relates to the following offenses under Belgian law:
* indecent assault, rape, violence, threats, torture, committed on the person of minors,
* kidnapping of minors,
* corruption and prostitution of minors,
* publication and distribution on all media, in particular via the Internet, photographs, films and texts, of a pornographic nature, of a to reveal the identity of victims of these offenses,
* publication and distribution, particularly by telecommunications (Internet), offers of services of a sexual nature, having a direct or indirect profit-making purpose, reporting services offered by minors or declared persons such,
* human trafficking and child pornography,
* in general, all offenses referred to in Articles 372 to 385 of the Penal Code,
* acts of torture referred to in the law of 9 June 1999 (Moniteur Belgian of October 28, 1999, 40677),
* articles 342 bis and 342 ter of the penal code inserted by the law of 10 January 1999 relating to criminal organizations ( Belgian Official Gazette of February 26, 1999). III. COMPETENCE

As regards, essentially, of material used on the Internet, it is impossible to determine the place where the offenses are committed, the nationality unidentified victims and those of abusers, producers, broadcasters or users.

According to the principle of competence universal, as provided in particular by Article 10 ter of the preliminary title of the criminal investigation code, the Belgian courts are recognized as having jurisdiction universal in this regard.

This is also what emerges of Article 1, 1, of the decision of the Council of the Union European aforementioned.

Starting from the absence of competence specific territorial jurisdiction for detected offenses on the Internet, on the one hand, and the referral to the district judicial office of Neufchâteau in certain kidnapping cases, rapes and murders of children, on the other hand, it seems logical and consistent with the principles of good justice, with a view to the search for truth, to entrust this complaint and documents attached to the Prosecutor of the King of Neufchâteau.

IV. INTEREST

Pursuant to Article 3 of the statutes of WERKGROEP MORKHOVEN NATIONAAL vzw, said association aims to investigate missing persons, to take the defense of people who are victims of discrimination or injustice, in the broadest sense, by any means whatsoever. In particular, it can lodge complaints or take legal action to this effect.

MORKHOVEN asbl thanks you kindly keep their council informed of the consequences of this.
