BOSTON -- Lawyers for a man charged with lying to investigators after the Boston Marathon bombings are asking a federal judge to release him from jail, saying he had nothing to do with the deadly bombings and isn't a flight risk.

Robel Phillipos, 19, of Cambridge, faces a detention hearing Monday in U.S. District Court. Defense attorneys said in court documents filed Saturday that authorities' claim that Phillipos gave them conflicting accounts is "refutable."

"This case is about a frightened and confused 19 year old who was subjected to intense questioning and interrogation, without the benefit of counsel, and in the context of one of the worst attacks against the nation," lawyers Derege Demissie and Susan Church wrote. "The weight of the federal government under such circumstances can have a devastatingly crushing effect on the ability of an adolescent to withstand the enormous pressure and respond rationally."

Phillipos was charged last week with lying to investigators about visiting bombing suspect Dzhokhar Tsarnaev's college dorm room on April 18, three days after the bombings. Two other friends were charged with conspiring to obstruct justice by taking a backpack with fireworks and a laptop from Tsarnaev's dorm room.

Phillipos was at the University of Massachusetts Dartmouth, where all four men had studied, by coincidence on April 18, his lawyers said in the court papers. He had taken a leave of absence in December and hadn't spoken to Tsarnaev or the other two men for more than two months, they said.

"By sheer coincidence and bad luck, he was invited to attend a seminar on campus on April 18," the night the three allegedly went to Tsarnaev's dorm room, according to the documents. "As such, he did not have much to offer the authorities regarding the investigation of the suspect."

To support their request for bail, the lawyers filed affidavits from friends and relatives of Phillipos who described him as a considerate, thoughtful and friendly young man, the son of a single mother who emigrated to the United States from Ethiopia. They said he wasn't a flight risk, noting that he is lifelong resident of Massachusetts and has many relatives there.

Phillipos faces a maximum of eight years behind bars and a $250,000 fine if convicted.

WORCESTER, Mass. — The uncle of Boston Marathon bombing suspect Tamerlan Tsarnaev arrived in Massachusetts on Sunday to arrange for his burial, saying he understands that “no one wants to associate their names with such evil events.”

Ruslan Tsarni, of Montgomery Village, Md., and three of his friends met with the Worcester funeral home director and prepared to wash and shroud Tsarnaev’s body according to Muslim tradition. The 26-year-old died after a gun battle with police on April 19.

Funeral director Peter Stefan said he hasn’t been able to find a cemetery in Massachusetts willing to take the body. He said he plans to ask the city of Cambridge, where Tsarnaev lived, to provide a burial plot, and if Cambridge turns him down, he will seek help from state officials.

Cambridge City Manager Robert Healy said in a statement Sunday there has been no formal application for a burial permit or purchase of a cemetery plot. He said he is urging Tsarnaev’s family and the funeral director who has the body not to request a burial permit for the city-owned Cambridge Cemetery.

Healy says it would not be in the best interest of the city to execute a deed for a plot at Cambridge Cemetery.


The rest of it is here. But the thing that caught my eye was this:

The state medical examiner ruled that Tsarnaev died from gunshot wounds and blunt trauma to his head and torso, and authorities have said his brother ran him over in a chaotic getaway attempt. Stefan said Sunday that the family won’t request that an independent medical examiner perform a second autopsy, but representatives from the family’s legal team might photograph Tsarnaev’s body before it’s washed.


Maybe there's a good reason for it. But it's a readily available commercial service. And it's not so expensive that cost really explains the about-face, under the circumstances. So provisionally, I'd say it sort of makes them look like they're fine when it's all talk. But when it comes to working out the little details like giving their observant son a proper religious burial, that's Uncle Ruslan's problem.

Turned me off. I hope I'm wrong.

I was talking about the parents, since they're the ones who said they were getting an independent autopsy. And therefore are also the ones who now look like they were just running their mouths off when they were out there saying it was a set-up, murder, frame-job, etc. So they either shouldn't have piped up or they should have followed through, imo..***

I've been following along with Uncle R. But irrespective of that, he did round up three Islamic male adults willing to bathe and shroud the deceased and get them and himself to Worcester. No matter who his ex-father-in-law is or what his political-cultural affinities are, if he's a human being who's not a total cartoon sociopathic villain, that probably wasn't fun. And it's an essential religious rite.

I bet the three friends are volunteers from a mosque, or something like that. A shortfall of ready, available candidates probably isn't a unique circumstance in non-Islamic countries, one way or another.

Also, how many of the aunts, uncles, parents are lawyers? All of them? I was keenly interested in the mother's statements, until someone must have poisoned her well with fake-blood amputee-actor PR-poison. Either she's so distraught she'd buy up any alt-theory, or she was strategically discrediting herself (forced to, maybe?) with that claim. But, she's no idiot, no poor peasant. The whole family is educated, accomplished, connected, it seems.

I don't really feel entitled to give or withhold that for him or for any of the family, personally.

But I do note that he showed up for his late nephew when nobody else did. Preparing the body for burial is a non-optional Islamic religious rite. Customs may vary, I don't really know. But I believe that family are generally responsible for it.

He also said this:

Tsarni has denounced the acts his nephews are accused of committing and has said they brought shame to the family and the entire Chechen ethnicity. The brothers are ethnic Chechens from Russia who came to the United States about a decade ago with their parents. Both parents returned to Dagestan last year.

“This is another person left all to himself,” he said.


He might be a jerk, toady and fool. And spook, even. But purely evil 100 percent dishonest and manipulative people are pretty rare, even among spooks. He sounds like a person to me. And I don't see what nefarious advantage he could possibly have to gain by burying his nephew. Although I'm open to suggestions, So atm, in this instance, I think he appears to be acting as an uncle and not a fucker,

She didn't strike me as an idiot. But she also actually didn't really strike me as distraught about what happened to her children. Either of them, but especially her living child. If it were me, I would have foregone the press blitz that did nothing for him and concentrated on reaching some accommodation with the law on those Lord and Taylor charges I'd skipped out on so that I could fly to be with my jailed son who was facing the death penalty, asap, on the very first available jet plane. You know. Just in case he might be comforted to know someone who loved him was in the vicinity.***

Don't know her, can't judge her, and my heart goes out to her regardless. But that was odd.

D'oh. Posted the quote and not the bit where I said:

Spook advantages. Money, advancement, money, protection, money, being allowed to stay alive, money, not having the embarrassing photos sent to the press, money, money, money, that kind of thing. Quite right. That was my very first thought. The corpse has been in spook custody for a full fortnight. It was then sent to the wrong (!) funeral parlour, due to a "mix-up" (sic). And this after every other outrageous lie, slimy insinuation and entirely unsubstantiated accusation these two brothers have been subjected to by spooks and spook-toadies of all descriptions (nearly all of them speaking under cover of anonymity) since one of them was allegedly shot and battered to death and the other allegedly delivered alive-but-heavily-wounded into spook custody, where he allegedly became incredibly loquacious and freely self-incriminating despite allegedly not being able to speak.

That is just an appalling thing to say in more ways than I can list. Shame on you. And you talk so airily as if "the law" (i.e., the United States police, immigration and intelligence apparatus) were a set of perfectly reasonable chaps the "9/11conspiracy-theorist"-and-possibly-shoplifting Russian Muslim mother of two alleged terrorists could easily or even possibly "reach some accommodation with", while she accuses that very apparatus of having murdered her sons.

It's not enough that she loses her two sons. No, no. She also has to have her style of grieving disparaged, she has to be criticised for addressing a press conference in which she decries her sons' treatment and demands to see evidence of their guilt, and now she even gets told she should have made more of an effort to placate the combined fucking forces of the multibillion-dollar US spook system so that she can insist (with all the power at her disposal!) on a second fucking autopsy.
