Katherine Jackson temporarily loses custody of Michael Jackson's children, judge names TJ Jackson as temporary guardian
The judge temporarily suspended Katherine Jackson as the children's guardian because she is in Arizona and hadn't spoken with them in several days.

A judge suspended Katherine Jackson's guardianship of Michael Jackson's three kids Wednesday, handing the reins to a grandson who voiced concerns about her 10-day disappearance and possible sinister forces at play.

Tito Jackson's 34-year-old son TJ Jackson was granted temporary guardianship during an emergency hearing that followed just hours after what he called a "strange" call from the matriarch Tuesday night.

"I've never heard my grandmother talk like that. In every way. The sound of her voice, the pauses. Asked simple questions, she wasn't sure. Some of her words seemed a little slurred. The choice of her vocabulary. I've never heard her used those words in the past," TJ said in the morning court session, getting choked up.

His lawyer Charles Shultz jumped in to explain the call was so "strange," TJ worried either she was reading a script or "maybe she was speaking in code."

Outside court, TJ said his only concern was for Michael's kids.

"All I want to say are three words: Always kids first," TJ said before sheriff's deputies escorted him out a private courthouse exit.

Asked by the Daily News if he was concerned about his grandmother's welfare and wanted her home immediately, he replied, "That too, of course."

"He was very close to his uncle (Michael), and when his uncle died, he felt compelled to always be there for his kids. That's why he did this, and when his grandmother comes back, he's going to step right aside," Shultz told The News.

"His desire is to have his grandmother reunited with him and the kids and for his grandmother to resume acting as the guardian of the kids and to continue being involved in their lives. That's all he's ever wanted," Shultz said.

Asked if he believed Katherine was on her way home Wednesday, as Randy Jackson told ABC's "Good Morning American," Shultz said he was hopeful but not convinced.

"We've heard before that she's on her way home. She was due back last Sunday," he said.

Lawyers for Katherine Jackson, TJ and the kids told Judge Mitchell L. Beckloff that Katherine has been missing from her California home since July 15 with almost non-existent communication, compromising her ability to care for Paris, 14, Prince Michael, 15, and Blanket, 11.

"I've been at the house since Saturday off and on, and I have reason to believe that Mrs. Jackson is being held against her will," Katherine's lawyer Sandra Ribera said in court.

Judge Beckloff granted TJ's request for temporary guardianship saying there is no evidence Katherine had done anything wrong and that he would restore her role after she returned.

"The allegation is she's being prevented from communicating with the kids by a third party," Beckloff said. "Katherine Jackson is unable to act based on the acts of third parties.this is not a move by (TJ) Jackson to oust Mrs. Jackson from her position."

Beckloff ordered that the children not be removed from state without court order and gave 48 hours for TJ's lawyer to send notice to Diana Ross, the back-up guardian named in Michael's will, and Debbie Rowe, the biological mother of Michael's two eldest kids.

The children's court-appointed lawyer Margaret Lodise said she spoke with the children and that the two oldest supported TJ's move.

Lodise said she did not ask the youngest son, 11-year-old Blanket, for his views.

Another Katherine Jackson attorney, Perry Sanders Jr., told Beckloff that he met with Michael's siblings Jermaine and Janet in Tucson, Arizona, last night.

He said he visited the spa at which Katherine was allegedly being treated but did not see the 82-year-old in person.

Jermaine previously said Katherine was at the spa on doctor's orders, recuperating from a mini stroke and stress-related ailments.

Sanders said he believed his presence at the spa prompted Katherine's move to a room with a phone, paving the way for her call to her grandkids Tuesday night.

After the hearing, Sanders said he received word that Katherine was returning Wednesday to Los Angeles. He said he would seek her reinstatement as guardian after speaking with her and fight any move to have her permanently replaced.

The temporary custody change followed two days after a bizarre confrontation involving Jermaine, Randy, Janet and the King of Pop's kids at Katherine's house in Calabasas Monday afternoon.

Ribera said Michael's siblings "stormed" the estate and tried to snatch the kids' cell phones.

Surveillance video appeared to show Janet reaching for Paris' cell phone, and an unnamed source told TMZ that Janet slapped Paris and called her a "spoiled little bitch" in a heated exchange.

Randy told GMA Wednesday that his mom was heading back to Los Angeles and that nobody slapped Paris. He said the siblings went to the house on a "peace mission" to let the kids know they could visit their grandma at any time.

Michael's siblings Randy, Janet, Jermaine, Rebbie and Tito recently signed a letter claiming Michael's will is a fraud and that his estate executors should step down.

The executors responded saying the claim was false and defamatory, and Tito released a statement Tuesday saying he no longer supported the letter.
