Keeping the Light Lit: Michael Ratner (1943-2016)

Michael Ratner, according to CCR's board chair Katherine Franke, "was among the most visionary lawyers of our generation, holding the U.S. government accountable when it went to war illegally, tortured its citizens, withheld state secrets, limited the rights of a free press, persecuted political dissidents and in countless other contexts. There has hardly been a progressive social movement in the last 45 years that Michael hasn’t been part of, contributing his phenomenally creative and cutting edge legal mind. All of us who treasure freedom and oppose oppressive state violence owe a debt of gratitude to Michael Ratner." (Photo: CCR)
Dear CCR Community,

It is with a very heavy heart that we write to tell you of a great loss to our family. On Wednesday, we lost one of the great social justice warriors of our time, Michael Ratner. In July 2015, Michael fell ill. But he fought his illness in the same manner as he did all of the injustices he encountered for the last half century; with clarity, tenacity, good cheer, the support of his loving family and friends, and hope for the best possible outcome against the odds. Sadly, this was one fight that he wasn’t able to win. We send our deepest condolences to his family and to all of those who knew and loved him.

Family members say Michael was born with the “empathy gene,” which made him a wonderful and loyal friend. While a law student at Columbia University in 1968 this empathy and compassion helped him find his political focus during student protests against the Vietnam War. While participating in a building occupation on campus Michael was pushed to the ground and beaten by the police. Seeing his bloodied classmates who were, like him, standing up for what’s right, he decided he would always stand on the side of the oppressed and against the oppressor. A law student was pushed down; a radical rose up. In his words, “[E]vents like this created the activists of the generation and I never looked back; I declared that I was going to spend my life on the side of justice and non-violence.” And this is exactly what Michael did until his last breath.

After law school Michael was drawn to the Center for Constitutional Rights; it would be his political home for over 40 years. He started as a staff attorney on the same day as another lost CCR hero, Rhonda Copelon, who along with other CCR colleagues, built gender work into the Center’s portfolio in the early 1970s. Through the years, Michael came to embrace international law as a key tool for the Center through the counsel of Rhonda and former CCR Vice President, Peter Weiss. This work, along with Michael’s tenacity and spirit remain the defining features of CCR 50 years after it was founded.

Michael was the organizational bridge between the work of CCR’s founders, from whom he learned how to litigate boldly and work with social movements, and our current generation of lawyers and advocates. He was a mentor and inspiration to generations of law students and lawyers who have come through CCR. Twenty-four years ago, the Center’s current Executive Director, Vince Warren, was one of these students. He shared his thoughts upon first meeting Michael as a CCR Ella Baker Intern:

“He lived the vision for how a radical people’s lawyer could almost literally shift the world for the most precarious in our society, by shifting the ground under the most powerful. But what really shifted, was me. Hearing his stories of representing clients and political movements from every corner of the globe, I came to see how I could use my law degree for something extraordinary and eternal. It was my honor to have later served with him on CCR’s Board and to work in partnership as the Executive Director of the organization we both cherished.”

In accepting the Center’s Relentless Radical Award in 2012, Michael explained why he chose to spend his career in partnership with CCR: “I believed then and I still believe today, that it is the place that will change the world. I am as excited to walk into the Center today as I was that first day. And I still believe it is the place that will change the world.”

Jules Lobel, CCR’s Board President and frequent CCR co-counsel with Michael, shared “Michael was the moral and political compass for me and CCR. He was the spirit of the Center: his approach to litigation and working with communities, his fortitude in waging long running campaigns, and the values he held dear. These will outlive him and continue to impact CCR’s work for generations.”

Michael had the vision to see things on the horizon—things that others barely glimpsed, often dismissed, or were convinced simply didn’t exist. From his work at CCR challenging US imperialism and oppression through policies of brutal militarism from Central America, Iraq and at home, Michael stood for peaceful conflict resolution and accountability for the inevitable abuse that accompanies the use of force. He never shied away from a fight, no matter the odds; indeed, it is likely he specifically selected the cases with the longest odds. After all, those involved in these cases were most in need of solidarity, support and a legal ally. This was obvious in the years he spent dedicated to exposing conditions facing Palestinians in Gaza and the West Bank and advocating for adherence to international law and recognition of their human rights.

Katherine Franke, CCR’s Board Chair, reflects on the legacy that Michael has left us with:

Michael’s special gift was his ability to turn an urgent problem into a meaningful, hard-hitting lawsuit. He sometimes won in court, but he always won in the court of public opinion; even if it took

It's been suggested to you before to begin your own RI blog. While I feel the stuff you post is important to document and archive together, the manner in which you construct your postings makes them so unappealing to my eye to read that I pass them by. It would be sensible for you to gather all your material together and categorize it for easy access via a menu in your own blog where people interested enough will follow. Imho.

I thought I was seeing things (which I probably am) but yeah this has already been topicified, as it were. I second/third the above comments. It would be helpful if you would format your posts/comments in a way that lends to ease of wanting to even look at it let alone read. Just a little criticism and I feel bad for doing so, but yeah. Do that.

Also don't, if you can, data dump 15 different articles and links in the same post. Also, make your titles to OPs a little more pertinent. We all have quirks, so don't worry. If you would do the above I would most definitely click on what you bring to the table way more often. It's just a matter of format, for me, fruh and I think some/most others of the skeleton crew assembled. Don't make us have to skip over what you wish to share because I am quite sure most of it is worth considering.

FBI Director James Comey,

Your recent statements and actions in the Apple vs FBI case have made it clear: you’ve lost touch with reality in your misguided crusade against basic encryption technology. You repeatedly stated, under oath, that the FBI had no alternatives other than forcing Apple to build a backdoor into the San Bernardino iPhone, a claim that technology and security experts quickly disproved. If your statements to Congress were not outright lies, they imply that you are deeply ignorant of basic technology. In this modern age, that’s unacceptable for someone in your position. But the FBI’s very public mishandling of the Apple case is just the latest example of your dangerous lack of judgment and regard for civil liberties. The media may not mention it, but we remember that you authorized Bush’s massive, illegal domestic surveillance program; that you approved torture techniques like waterboarding; that you moved effortlessly from the DOJ to defense contractors and hedge fund boards and now to the FBI. We’re afraid that after all these years unchecked, you’ve lost sight of what’s good for American Democracy.

Director Comey, you’re off the rails and your extreme behavior is putting lives in danger.

We all know that the Apple v. FBI case was about more than just one iPhone. When pushed, you admitted as much yourself. This was just your latest of many attempts to circumvent the constitution in the name of fighting terrorism. But the worst part is that your quest against encryption is not only an attack on our civil liberties, it’s an attack on our all of our security and public safety. Encryption protects our hospitals, airports, and power plants. Your obsession with demonizing basic security technology could seriously harm our national security.

We’re not the only people who are concerned for you. Current and former NSA directors have spoken out against you. NSA Director Adm. Mike Rogers has called the FBI’s campaign against encryption a “waste of time.” Rogers believes that end-to-end encryption is foundational to this country’s future.

When even the NSA thinks you’re spying too hard, it’s time to resign.

You’ve been pursuing this destructive path for a long time. As Deputy Attorney General under President Bush, you helped invent the illegal mass surveillance of all Americans, in part by forcing the secret Foreign Intelligence Surveillance Court to rubber stamp a dramatically expanded (and illegal) reading of surveillance law, creating and subsequently upholding the NSA’s warrantless eavesdropping program.

Perhaps the most upsetting part of it all is that while the FBI under your leadership has committed itself to dangerous and illegal activities, you have refrained from doing a critical part of your job: investigating crimes committed by the politically powerful. Instead of prosecuting banks, you literally work for them. You haven't even read the infamous torture report, which details flagrantly illegal activity by the government and even the FBI.

Why haven’t you investigated torture? Perhaps because you authorized “enhanced interrogation techniques” like waterboarding, or maybe because you personally pushed forward a case in which an American citizen was imprisoned and and tortured on American soil for years without a trial.

We’ve written to you today because enough is enough.

You’re hurting your own reputation, but you’re also hurting us. You’ve lost sight of what’s important, and what so many people love and value about America. If you continue as FBI Director, we believe you will do irrevocable harm to our country. We implore you to resign.

gave a presentation on his 9/11 documentary Incontrovertible.

Review of deHaven-Smith book
Ken Freeland offered his review of the Lance deHaven-Smith book
Conspiracy Theory in America. It was agreed that teleconference would
hold a future discussion on the book.

Claim of ‘shadow’ in Citgo video
Wayne Coste gave a presentation on why he thinks Citgo gas station
security video shows the shadow of a plane that he contends hit the
Pentagon.

From book on Boston bombing
Craig McKee and Sheila Casey gave an overview of their chapters in the
new book And Nobody Died in Boston, Either.

Announcements
* Dave Slesinger said his had a successful leafleting campaign at
Northwestern University in Chicago, the home campus of Zdenek Bazant,
an academic and ardent supporter of the official story. He says he
gave out 900 business cards and his website, bazantmisconduct.com,
received more than 40,000 hits the first 10 days. He also asked if
others would be interested in more college outreach initiatives.
* Barbara Honegger reminded the teleconference that she is running in
the 20^th Congressional District in California, and that she raised
the subject of 9/11 in several recent candidates meetings. Anyone
wishing to donate can send a check to Barbara Honegger with 'Campaign
donation' in the re line, and mail it to Box 2198, Carmel Valley, Ca.
93924. Donations of $200 or more have to be reported with the name of
the donor.

An employee at Best Buy's nationwide computer repair center served as
a paid FBI informant who for years tipped off agents to illicit
material found on customers' hard drives, according to the lawyer for
a Newport Beach doctor facing child pornography charges as a result of
information from the employee.

Federal authorities deny they directed the man to actively look for
illegal activity. But the attorney alleges the FBI essentially used
the employee to perform warrantless searches on electronics that
passed through the massive maintenance facility outside Louisville,
Ky., where technicians known as Geek Squad agents work on devices from

Olga Cortez was getting out of the shower and preparing for bed when
she heard a loud banging outside. It was 9.30pm on 7 December, and the
Oakland, California, mother saw a man she did not recognize furiously
pounding on her front door.

“Open the fucking door,” he screamed, according to Cortez’s account.
“Let me in!”

When her husband Nemesio cracked open the door to ask him to leave,
the man, who smelled strongly of alcohol, allegedly kicked him in the
stomach and grabbed Olga, who was wearing a bathrobe and fell to the
ground – exposing her body. Another man came running out of their
backyard and appeared to point a gun at the wife.

Their daughters, ages 11 and 13, stood in the doorway crying.

The traumatizing incident, outlined in a claim to the city, got worse
when the Oakland police department (OPD) showed up. The officer wanted
