Alabama Sets Frightening Precedent on "Personhood" of Fertilized Eggs

Despite repeated attempts to pass state constitutional amendments declaring that a fertilized egg deserves the same protection and rights as any infant, toddler or other person who has been born, the "personhood" movement has had little success in their main goal of ending all abortion, and potentially many forms of contraception as well.

But that hasn't stopped them from trying newer, bolder ways to grant legal rights from the point in which sperm and egg meet, and these new attempts are downright terrifying beyond just the impact on abortion and birth control.

Alabama has long been at the forefront of the personhood movement, with the state Supreme Court ruling that the point of fertilization is the point in which a human exists that deserves all legal rights. The move allowed the courts to prosecute women for "endangering" fetuses by doing illicit drugs while pregnant and even charging them with murder for bad birth outcomes.

Now the state of Alabama is reinforcing its personhood beliefs and this time it is doctors who are in danger. In a recent state Supreme Court ruling the judges have now stated that the state's "Wrongful Death" charges can be brought against a doctor whose patient doesn't carry to term, even if the miscarriage is very early in the pregnancy.

According to Al.com, a woman who miscarried six weeks into the pregnancy has sued her doctor, saying that the obstetrician wrongfully treated her for a likely ectopic pregnancy and that the treatment then caused her to miscarry the embryo that actually had implanted and allegedly was developing in her uterus. Rather than a normal medical malpractice suit, however, the doctor was charged under the "Wrongful Death Act," and Justice Tom Parker, himself a personhood advocate, agreed it was appropriate.

"Today, this Court again reaffirms the principle that unborn children are protected by Alabama's wrongful-death statute from the moment life begins at conception," Parker wrote, according to Al.com. "This has not always been the case in Alabama. Alabama used to deny unborn children who had not yet grown strong enough to survive outside of their mother's womb the protections of Alabama's wrongful-death statute."

If a doctor can be charged with wrongful death when treating a pregnant patient, it is going to make medical professionals far less likely to be willing to work with them, potentially endangering their lives in the case of a medical emergency. With both a pregnant person and an embryo seen as equal patients upon which a doctor could potentially harm, it will become that much more difficult for a practitioner to offer any sort of care to the mother without first worrying about the impact it could have on a developing pregnancy.

This could be even more dangerous when seeking out healthcare during the first trimester, when 20 percent of all pregnancies end in miscarriage already, and where a non-viable pregnancy with little chance of succeeding could later be blamed on a doctor despite he or she not having caused the loss at all.

ObGYNs, emergency room doctors and general practitioners aren't the only ones who need to worry about creeping personhood, either. A new bill being introduced in Missouri is revamping custody rights for embryos created via in vitro fertilization, allowing any one who donated either the eggs or the sperm and is willing to implant the embryos to take custody over any that remain, even if the other party wants them kept frozen indefinitely or even destroyed.

"'One could argue that if you're giving personhood protections to frozen embryos, that would apply to other areas of law," says M'Evie Mead, director of policy and organizing at Planned Parenthood Advocates of Missouri -- an advocacy group," Hannah Levintova of Mother Jones reports. "The provision is also worrisome to groups focused on infertility and assisted reproductive technologies because of the unforeseen consequences it could create for embryos conceived through IVF."

Both new examples are likely to set precedents that no one has ever considered when it comes to prenatal care, medical malpractice, embryo adoptions and more. But with the chance to chisel away at reproductive rights in the process, that appears to be a can of worms that personhood advocates are more than willing to open up.

13 States Have Laws That Will Instantly Criminalize Abortion If Roe v. Wade Is Overturned in Trump's America
The state of reproductive rights in Trump’s America may get even worse.

Donald Trump and Mike Pence have made it very clear they intend to nominate Supreme Court justices devoted to taking away women’s right to abortion should openings on the bench arise. With many states already banning the procedure as much as possible, abortion would instantly be criminalized in 13 states should Roe v. Wade be overturned, according to a new study released by NARAL Pro-Choice America.

The 50-state report points out that 11 states currently have laws on the books criminally banning abortion and two more have near-total criminal bans. That means if Roe is overturned after Trump puts an anti-choice justice on the bench, women seeking abortions in Alabama, Arizona, Arkansas, Delaware, Louisiana, Massachusetts, Michigan, Mississippi, New Mexico, North Dakota, Oklahoma, South Dakota, West Virginia could be criminally punished.

Of course, the downfall of the law guaranteeing women have a right to abortion at least up until viability would drastically jeopardize women in every state’s access to the safe medical procedure, but these 13 states would be even worse. On top of just not being able to go to a clinic to end a pregnancy, women and doctors could literally be fined, go to jail, and/or have a criminal record if they attempt to get or perform the procedure.


“This report paints a grim picture of the current status of reproductive freedom in the United States, and if Donald Trump succeeds in appointing Supreme Court justices who overturn Roe v. Wade, our data shows that women will be even worse off,” NARAL President Ilyse Hogue said. “Seven in 10 Americans believe abortion should be legal and accessible, and reject the anti-choice policies pushed by Donald Trump and anti-choice Republicans in Congress and at the state level. Our mission now is to fight for the America we and a majority of Americans believe in by organizing and mobilizing pro-choice voters and our one million member activists against the extreme agenda being pushed by anti-choice politicians.”

The report also notes that 26 states passed 56 anti-choice measures in 2016, with Louisiana being the worst offender, passing a whopping seven anti-choice laws throughout the year. Among the most popular ways to control women’s bodies and force conservative religious beliefs on the masses last year were restrictions on biomedical research, counseling and referral bans, laws barring abortion providers from participating in public healthcare programs, and TRAP (Targeted Regulation of Abortion Providers) laws.

The state of reproductive rights in Trump’s America may get even worse, so don’t hesitate to give your money to NARAL, Planned Parenthood, and other organizations fighting to protect women’s rights.

W.Va. left with 1 abortion clinic after facility closes

CHARLESTON, W.Va. (AP) - West Virginia women are down to one in-state choice if they want an abortion.

The Charleston Gazette-Mail reports that one of the state's two abortion providers closed its doors in recent days.

Kanawha Surgicenter closed Tuesday, according to a note posted on the door of the Kanawha City clinic.

A woman who answered Dr. Gorli Harish's phone and said she is his wife said the family moved to California two years ago to be closer to their children and grandchildren. She says the doctor had been commuting to Charleston once a month to do procedures and no longer wished to make the regular trips.

With Kanawha Surgicenter's closure, the only other abortion provider in the state is the Women's Health Center, on Charleston's West Side.

What is the Mexico City abortion rule?

President Donald Trump reinstated the Mexico City abortion rules on Monday, which was rescinded by former President Barack Obama exactly eight years ago.

Though Trump has had controversial clashes with Mexico over his border wall policy, this executive order actually has nothing to do with Mexico, despite its name. It’s also not unique to Trump — it’s a policy that gets rescinded or reinstated every time the presidency switches from Democrat to Republican, or vice versa.


Here are a few facts about the Mexico City Policy:

It requires foreign non-governmental organizations to not provide or promote abortion services if they receive funds from the U.S. government. Specifically, the funds would come from the United States Agency for International Development, and abortion cannot be presented as a “method of family planning.” Promoting abortion services includes work such as counseling for women that includes language on abortions.
The policy was named for Mexico City because it was announced at the United Nations International Conference on Population in that location.
It was signed into law by former President Ronald Reagan and went into effect in 1985.
The policy stayed in effect until 1993, when it was rescinded by former President Bill Clinton. Since then, it has been reinstated by every Republican president and rescinded by every Democratic president within their first few days in office. Obama rescinded it exactly eight years ago, on Jan. 23, 2009.
Obama’s statement when he repealed the policy read, in part, “It is clear that the provisions of the Mexico City Policy are unnecessarily broad and unwarranted under current law, and for the past eight years, they have undermined efforts to promote safe and effective voluntary family planning in developing countries. For these reasons, it is right for us to rescind this policy and restore critical efforts to protect and empower women and promote global economic development.”
The presidents previous to Obama who took actions on the policy signed them on Jan. 22 of their respective years, which is the anniversary of the Roe v. Wade decision. Some noted in 2009 that Obama likely waited a day on purpose due to the anniversary, though Obama never confirmed or denied that.
The order does provide exceptions in cases of rape, incest or life-threatening conditions.
Critics of the policy refer to it as the “Global Gag Rule,” and the U.S. has been unsuccessfully sued over the policy by those who say it limits freedom of speech.
The policy creates legal problems for organizations in certain countries, such as South Africa, where the groups are legally required to inform a woman seeking an abortion of her rights and refer her to a facility that would perform an abortion.

The Netherlands to Start Abortion Fund in Response to Donald Trump’s Global Anti-Choice Efforts

The United States isn’t the only nation with purse strings to pull. Days after Donald Trump signed an executive order banning aid to organizations in developing nations that “offer abortion counseling or if they advocate the right to seek abortion in their countries,” the Dutch Trade and Development Minister Lilianne Ploumen announced plans for an international abortion fund to “fill the gap” the U.S. is leaving worldwide.

From SBS Australia:

“Banning abortions does not result in fewer abortions,” Dutch Trade and Development Minister Lilianne Ploumen said in a statement.

“It leads to more irresponsible practices in back rooms and more maternal deaths.”

The World Health Organisation estimates that 22 million women experience unsafe abortions every year, the vast majority of whom are in developing countries. ... Minister Ploumen said that the Trump administration’s decision risked undermining recent advances in women’s health.

“We must not let this happen,” she said.

“We need to compensate for this financial blow as much as possible, with a broad-based fund - which governments, businesses and civil society organisations can donate to - so that women can remain in control of their own bodies.”

Mother serving 2-week sentence claims prison staff made her give birth on jail floor

WATCH: A Michigan mother alleged she told jail staff she was pregnant and going into labour, but despite her warning she still ended up giving birth inside a jail cell.

A mother in Michigan claims she was forced to deliver her baby on a mat inside of a jail cell after staff refused to call an ambulance.

According to the time stamp on Macomb County Jail’s surveillance video, Jessica Preston gave birth to her son Elijah on March 20, 2016.

“He’s beautiful and amazing, and I wouldn’t trade him for the world, but it is a constant reminder every time I see him, I can remember how awful it was to feel that way, to be treated like you don’t matter, don’t exist,” Preston said to NBC affiliate, WDIV news.
In the footage, it shows a person on a mat surrounded by at least five other people.

Later on in the video, it shows Preston being led out of the prison on a stretcher.

It all began five days before when Preston was pulled over for having a rosary in her rearview mirror which caused “an obstruction of view,” WDIV wrote.

Even though Preston said she wasn’t speeding or “driving recklessly” she was still driving with a suspended license.

A judge set Preston’s bond at $10,000 and order her to serve 14 days in jail.

WDIV claimed Preston was given that sentence not only because of the rosary and driving with a suspended license but because of other past charges, including drug abuse and outstanding warrants.

The judge reportedly believed it would be “in the baby’s and mother’s best interest to be locked up” and expected that if Preston went into labour, she would be taken to hospital.

Instead, Preston gave birth on a mat.

“I’m just in total shock, I can’t believe I just had my son – a month early – on a dirty, jail cell floor,” Preston said to WDIV.
CBS News even reported that Preston asked to be taken to the to the infirmary multiple times, however, staff told her to “stop lying” or else they’d “put another charge” on her.

A doctor, who is an expert in jail medical cases, told WDIV that having a baby inside of a cell can lead to complications.

“It opens the risk to infections, whether it’s the baby, or it’s the mother,” Dr. Frank McGeorge said to WDIV. “There’s always the risk that there could be some difficult breathing. Maybe the baby has some kind of congenital problem…we don’t know.”

After Preston gave birth to Elijah and both were taken to hospital, Preston had to return to jail two and a half days later to serve out her remaining sentence while the baby went home with his father.

“It was horrible being separated from my baby. I wasn’t able to breastfeed, and he was so tiny, he was so little when he was first born…it was agonizing,” Preston told WDIV.
Even though Elijah was born a month early and weighed less than five pounds, he’s reportedly in good condition.

Preston said she’s sharing her story in hopes that every inmate, no matter why they’re incarcerated, gets proper treatment during a medical emergency.

WDIV wrote Sheriff Anthony Wickersham believed “his jail staff was 100 per cent correct in how they handled the case.”

Oklahoma Republican stands by calling pregnant women ‘hosts’

OKLAHOMA CITY — A Republican lawmaker from southeast Oklahoma who described a pregnant woman as a “host” is standing by his use of the term, saying his intent was not to offend anyone.

State Rep. Justin Humphrey of Lane said Monday he didn’t know of a better term to describe a pregnant woman and apologized to anyone who took offense.

Humphrey used the term while discussing his bill that would require women seeking an abortion to first obtain the written informed consent of the father. The bill is scheduled for a hearing Tuesday in a House committee.

State Rep. Emily Virgin described Humphrey’s comment as “incredibly disrespectful.”

Oklahoma has passed some of the strictest anti-abortion bills in the country, although at least five have been struck down by the courts in recent years.

Trump Tells Planned Parenthood Its Funding Can Stay if Abortion Goes

The White House, concerned about the possible political repercussions of the Republican effort to defund Planned Parenthood, has proposed preserving federal payments to the group if it discontinues providing abortions.

The proposal, which was never made formally, has been rejected as an impossibility by officials at Planned Parenthood, which receives about $500 million annually in federal funding. That money helps pay for women’s health services the organization provides, not for abortion services.

“Let’s be clear: Federal funds already do not pay for abortions,” Dawn Laguens, the executive vice president of the Planned Parenthood Federation of America, said on Monday. “Offering money to Planned Parenthood to abandon our patients and our values is not a deal that we will ever accept. Providing critical health care services for millions of American women is nonnegotiable.”

But the outreach to allies of Planned Parenthood is a glimpse of the internal struggle inside a White House torn between trying to satisfy the conservative base that elected President Trump and responding to the views of his daughter Ivanka Trump, who urged her father to tread carefully on the Planned Parenthood issue during the Republican primary contest.

Ms. Trump has no formal role in the administration, but as an informal adviser she has made women’s issues a focus. She has had a mixed record of success in the administration’s early days, but during the campaign, she was able to nudge Mr. Trump toward a nuanced view of Planned Parenthood’s work.

Mr. Trump confirmed the discussions in a statement on Monday to The New York Times.

“As I said throughout the campaign, I am pro-life and I am deeply committed to investing in women’s health and plan to significantly increase federal funding in support of nonabortion services such as cancer screenings,” he said. “Polling shows the majority of Americans oppose public funding for abortion, even those who identify as pro-choice. There is an opportunity for organizations to continue the important work they do in support of women’s health, while not providing abortion services.”

Indeed, Mr. Trump made similar statements as a candidate, putting him at odds with other Republicans in a primary race characterized by conservative views.

In private discussions with people close to Planned Parenthood, White House officials have suggested that there could even be an increase in federal earmarks if the work related to abortion ends.

At various points during the campaign, Mr. Trump spoke favorably of the work of Planned Parenthood, even while saying he would support withdrawing its funding if abortions continued.

“Millions and millions of women — cervical cancer, breast cancer — are helped by Planned Parenthood,” he said in February 2016 at a debate hosted by CNN. “I would defund it because I’m pro-life, but millions of women are helped by Planned Parenthood.”

Marjorie Dannenfelser, the president of the Susan B. Anthony List, which supports anti-abortion candidates, said Mr. Trump was living up to his campaign promise.

“We’re not used to that in politics,” she said. She added that she had no problem with the deal because her issue with Planned Parenthood is with its abortion work.

Until 2011, when he announced he opposed abortion rights, Mr. Trump had supported legal measures allowing abortions.

Congressional Republicans have said they will soon move legislation to strip all federal funds from Planned Parenthood, and a provision for doing that was included in the House Republican bill to replace the Affordable Care Act released on Monday night.

Senator Kirsten E. Gillibrand, Democrat of New York, suggested that Mr. Trump had authorized the proposal because he wanted to be able to claim that he had made an offer to Planned Parenthood and that officials with the group were not being reasonable.

“The Trump administration needs to stop playing political games that would put access to the full range of safe reproductive care at risk, or they will get the fight of their lives,” Ms. Gillibrand said.

Diane Max, a major donor to Planned Parenthood, called the offer “an absurd play” and said Mr. Trump had been “sympathetic to a woman’s right to choose until it was politically unpopular” for him.

A May text message conversation with a photo of a penis and professor John Schindler's name atop it was circulated on Twitter early Monday. It was unclear who sent it and who posted it.

A blogger sent a complaint to the War College's administration. The college's president, Rear Adm. Walter E. "Ted" Carter Jr., ordered an investigation. A college spokeswoman said investigators would look into whether the photo could have been falsified.

Mr Schindler refused to discuss the photo by telephone on Monday, citing legal reasons. He has deleted his Twitter account.

Mr Schindler is a professor of national security affairs and a former National Security Agency intelligence analyst. He has been critical of leaker Edward Snowden and others and frequently engaged in heated exchanges with critics on Twitter.

Former Law Student: Gorsuch Told Class That Women 'Manipulate' Maternal Leave

Neil Gorsuch once told a law school class that women frequently abuse maternity leave policies, according to a letter written by Jennifer Sisk, a former student of Gorsuch's at the University of Colorado Law School, that was sent to the Senate Judiciary Committee Friday night.

As Sisk explains in the letter, published Sunday night by National Employment Lawyers Association and the National Women's Law Center, the incident took place during a legal ethics class. The students were discussing a hypothetical situation in which a female student is applying to jobs at law firms to pay off student debt, and intends to start a family with her husband.

Sisk wrote: "He interrupted our class discussion to ask students how many of us knew women who used their companies for maternity benefits, who used their companies to—in order to have a baby and then leave right away." After only a few students raised their hands, Sisk recalls Gorsuch saying, "Come on, guys. All of your hands should be up. Many women do this."

Law professors, as NPR pointed out in an interview with Sisk, frequently ask provocative questions in the course of teaching, but Sisk was adamant that Gorsuch's prodding of the class to raise more hands was out of the bounds of the usual challenges professors posed to students during the course of her law school career.

Another student, Will Hauptman, disputed Sisk's interpretation of the events, writing in a separate letter to the judiciary committee that "Although Judge Gorsuch did discuss some of the topics mentioned in the letter, he did not do so in the manner described." He did not dispute that Gorsuch made the comments, only that the discussion, "reflected his desire to make us aware of them, not any animus against a career or group."

According to Sisk, the discussion was specifically directed toward women: "He kept bringing it back to that this was women taking advantage of their companies, that this was a woman's issue, a woman's problem with having children and disadvantaging their companies by doing that."

Sisk brought her concerns to school officials who said they would speak to Gorsuch about his comments, though she did not follow up to see if the discussion had occurred. She told NPR she sent the letter "so that the proper questions could be asked during his confirmation hearings," but also said that, despite the fact that he doesn't support the Family Medical Leave Act, and values corporations above people, "He’s still better than the rest of the choices.”
