Minnesota Waitress Sues After Police Seize $12,000 'Tip'


Stacy Knutson, a struggling Minnesota waitress and mother of five, says she was searching for a "miracle" to help her family with financial problems.

But that "miracle" quickly came and went after police seized a $12,000 tip that was left at her table. Knutson filed a lawsuit in Clay County District Court stating that the money is rightfully hers. Police argue it is drug money.
Knutson was working at the Fryn' Pan in Moorhead, Minn., when, according to her attorney, Craig Richie, a woman left a to-go box from another restaurant on the table. Knutson followed the woman to her car to return the box to her.
"No I am good, you keep it," the woman said, according to the lawsuit.

Knutson did not know the woman and has not seen her since, Richie said. Knutson thought it was "strange" that the woman told her to keep it but she took it inside. The box felt too heavy to be leftovers, Ritchie said, so she opened it -- only to find bundles of cash wrapped in rubber bands.

"Even though I desperately needed the money as my husband and I have five children, I feel I did the right thing by calling the Moorhead Police," Knutson said in the lawsuit.
Police seized the money and originally told Knutson that if no one claimed it after 60 days, it was hers. She was later told 90 days, Richie said. When 90 days passed, Knutson was still without the $12,000.
Police told Knutson the money was being held as "drug money" and she would receive a $1,000 reward instead, the lawsuit states. Lt. Tory Jacobson of the Moorhead police said he could not disclose much information about the case because it is an ongoing investigation.

"With turning this money over to us, we initiated an investigation to determine whose money this is," Jacobson told ABC News. "The result has been a narcotics investigation."
Police argue that the money had a strong odor of marijuana and therefore falls under a law that allows for forfeiture of the money because it was in the proximity of a controlled substance, the lawsuit states. But there were no drugs in the box and Richie said he believes this law is not being used correctly.

"Because it was in contact with drugs somewhere along the line, it's somehow drug money," Richie said. "This isn't drug money."

A police dog also performed a sniff test on the money and, according to the dog's handler, discovered an odor.

Two of Knutson's co-workers, along with her son Brandon, were at the Fryn' Pan the night she discovered the money. Her co-workers say they did not smell marijuana.

"I know the smell of marijuana," Nickolas Fronning, a line cook at the Fryn' Pan, said in an affidavit. "I can also assure you that there was no smell of marijuana on the bills or coming from the box."

There was nothing suspicious in the restaurant when the money was found, co-workers said. They don't why it was given to Knutson.

"She was just in the right place at the right time," Tracy Johnson, the assistant manager at the Fryn' Pan, told ABC News.

Knutson's family has had a long financial struggle. She has been a waitress at the Fryn' Pan for 18 years.

"We do everything we can to make ends meet, but often times everything is not covered," she said in the lawsuit.

Knutson's financial woes are well-known in her church, Richie said. She believes that perhaps someone from the church gave her the money through this woman but did not want to be identified.

"Somebody knew she really needed the money and she needed to be helped," Richie said.

Jacobson says it is up to the judge to decide who the money rightfully belongs to.

"The police department doesn't have a decision on either side," Jacobson said. "She did the right thing, we credit her with that. It's certainly not the police department against her. We're actually with her."

But Richie said he firmly believes this is not drug money and it rightfully belongs to Knutson.

"The only thing that smells bad about this is that it's unfair," Richie said. "So that's why we're doing something about it."

Government Might Let Big Chicken Inspect Its Own Poo-Covered Poultry

Federal food safety inspectors already have so much to do, why not just hand over the job of watching birds go down an assembly line to factory employees? What could possibly go wrong? A whole lot, say opponents of a current proposal by the Agriculture Department to allow private companies take over inspections at poultry plants.

Some in the agency say such a program would pose a health risk by allowing contaminated meat to reach customers, reports the New York Times. Currently, service inspectors from the Food Safety and Inspection Service are stationed on the line to examine birds for blemishes, feces or visible defects before they go on to be processed and ultimately, delivered up for your consumption at the grocery store.

As for what these newly-freed inspectors would be doing instead, the proposal would send them to spend more time "evaluating the plant's bacteria-testing and other safety programs."

There are those within the agency who don't approve, however, as they say it would put consumers at risk for diseases caused by salmonella.

Apparently this pilot program has already been run in 20 plants since 1998, and it's already had problems. According to affidavits given to the Government Accountability Project, several inspectors at those pilot program plants report being put at the end of the line, making it impossible for them to spot bad birds.

They also reported many incidents of poultry plant employees letting birds with poo or "other substances" pass by, and if the inspectors tried to remove them, they were yelled at.

Of course, Big Chicken is all about this idea.

"The proposed rule is the logical next step in the modernization of poultry inspection," said Tom Super, vice president of communications for the National Chicken Council in Washington.

We're going to go ahead and cross our chicken nugget-loving fingers that this thing doesn't happen. Or possibly just stay away from poultry altogether, for fear of feces.

The first time I heard Joe Floren speak I was standing behind him in an elevator in his law firm’s San Francisco office tower as another lawyer informed him that the subpoena Joe Floren had served the previous day on a colleague of mine had reached her in the hospital, after a difficult delivery of her first child, while she was breastfeeding for the first time.

“Really? That’s beautiful. I love it!” He replied with glee.

Joseph E. Floren, Esq., is a lawyer at Morgan Lewis, the white shoe law firm defending Goldman Sachs against Overstock’s prime broker litigation, and tonight I celebrate the mistake Joe Floren made yesterday. In filing Goldman’s response to Overstock’s motion to vacate the trial court judge’s decision to stay his own decision to unseal various documents related to this litigation (in more straightforward English: the trial court judge decided to unseal some documents while also deciding to delay acting on his decision, but we objected to this delay, and Goldman responded to our objections), Joe Floren screwed the pooch. He filed something containing an attachment he forgot to redact. That attachment is a previous filing of Overstock’s, a filing which contains but a sample of the shenanigans at Goldman and Merrill that has turned up over the course of five years and millions of pages of discovery, but which filing we had redacted when we made it (as good litigants do).

Fortunately for the cause of all that is good and right about America, Joe Floren’s goof came to the attention of a diligent 1st amendment attorney in California named Karl Olson, who represents the Economist, Bloomberg, the New York Times and Wener Publications (owners of Rolling Stone magazine) in their efforts to obtain the documents. Karl Olson provided Joe Floren’s sloppy filing to his clients. Tonight these stories appeared:

It seems to be real enough - it's being widely reported, that's for sure. More from TMZ...

Bill Clinton personally asked his Secret Service detail to introduce him to the 2 porn stars he posed with yesterday at a Monaco gala event -- at least according to the busty ladies themselves.

Tasha Reign and Brooklyn Lee called in to TMZ Live moments ago, claiming they initially approached Bill to take a picture with him at the "Nights in Monaco" gala in Monte Carlo last night -- but Bill's Secret Service guard brushed them off.

We're told Bill then caught the girls out of the corner of his eye -- and ordered the SS to bring the girls back, at which point he posed for the infamous photo.
