Massachusetts Democrats Rep. Ayanna Pressley and Sen. Ed Markey have reintroduced legislation to end qualified immunity, a doctrine that protects government officials from individual liability for violating personal and constitutional rights, as The Hill reported.
The Ending Qualified Immunity Act would restore Americans’ ability to obtain relief when state and local officials, including police officers, violate citizens’ legal and constitutional rights by explicitly stating that the police officers that violate these rights are not protected from civil liability.

Bonavolonta presented Tamer Koheil, of Fitchburg, Massachusetts, with the FBI Director’s Community Leadership Award (DCLA) in recognition of his service to the people of Massachusetts and New Hampshire.
The award was established in 1990 to honor individuals and organizations for their efforts in engaging the community in the areas of education and crime prevention. Every year, the Boston Division of the FBI can select an individual or organization that has gone above and beyond the call to service by making extraordinary contributions to their communities and a significant difference in the lives of others.

WASHINGTON, March 8 —The Federal Bureau of Investigation mailed what some agents considered an “unsavory” tape recording made from an electronic room bug to Coretta King to frighten her husband, the Rev. Dr. Martin Luther King Jr., into halting his criticism of the bureau, according to a former high official of the agency.
The mailing of the tape recording to Mrs. King was part of nearly a decade of “harassment” of the late civil rights leader by the bureau, several former agents and officials say.
One retired agent, Arthur Murtagh, who was attached to the F.B.I.'s Atlanta field office, said the moves against Dr. King were second in size “only to the way they went after Jimmy Hoffa.”
Yet there was never a criminal prosecution of Dr. King and, these former F.B.I. men say, there was a “dubious” national security rationale for what they said were thousands of hours of electronic and physical surveillance. These sources believe that the alleged harassment of Dr. King should be investigated by the Congressional committees on intelligence. Several have written to the Senate Select Committee on Intelligence.
Violation of Regulations
The sending to a private citizen of a tape recording obtained by a national security electronic surveillance is a violation of F.B.I. regulations and was a potential violation of the Federal Communications Act and the Federal Criminal Code.

I was told that the VAERS contractor for CDC and FDA (Oracle had the contract) told the agencies there was a myocarditis adverse event signal in February 2021. This was 2 months after the Pfizer and Moderna vaccines were authorized. (Myocarditis shows up within 4 days of the second shot over 80% of the time, so it is hard to miss the obvious vaccine connection.) This involved people reporting myocarditis to VAERS before there had been any publicity about the connection. I spoke about this on CHD’s Friday Roundtable program with James Lyons-Weiler on May 19. For years, the Los Angeles Sheriff’s Department has had a gang problem. And for just as many years, sheriff after elected sheriff have refused to address this problem. It’s not simply a matter of taking a hands-off approach to discipline. It’s been a matter of flat-out denial from sheriffs that deputies are forming gangs seemingly solely for the purpose of abusing rights of Los Angeles County residents.
The latest sheriff to pretend this problem simply didn’t exist was Alex Villanueva. He pitched himself as a reformer to get elected and then spent his years in office intimidating critics, threatening lawsuits, and otherwise refusing to acknowledge the fact deputies were forming cliques and using this strength-in-numbers solidarity to both inflict violence on citizens and intimidate supervisors who might have wished to discipline them.
Another self-proclaimed reformer was elected last year to the office of sheriff. Robert Luna, the former chief of the Long Beach Police Department took Villanueva’s place. Luna claims he wants to rid the department of its gang problem. So far, he really hasn’t taken many steps to do that, but he has at least reopened the doors to the LASD’s Inspector General, who is now ordering deputies to answer questions about their gang involvement.
Nearly three dozen deputies have been ordered to come in for questioning, show their tattoos and give up the names of any other deputies

Coming up soon, the government faces an expiration data for its Section 702 surveillance powers.
Section 702 allows the NSA to gather content and communications from “upstream” providers. This means the NSA can camp out on international cables to gather every international communications rolling through (often) underwater internet cables.
Far be it from me to suggest what the NSA should or shouldn’t collect. Once you go foreign-facing, you can ignore all the rights Americans are entitled to. Leave it at that and it works. Give the FBI warrantless access? Well, holy shit, now we’re just expected to throw a tailgate party for the ends, celebrating their victory over the means.

Over time, Weisberg became recognized, both nationally and internationally, as the dean of writers critical of the official version of the JFK assassination known as the Warren Commission Report. Harold Weisberg donated the world's largest accessible private collection of government documents and public records relating to the assassination of President John F. Kennedy to Hood College and the Beneficial-Hodson Library at Hood College, which donated a copy to the National Security Internet Archive.

A few months back, we pointed out how the EFF had discovered that the FBI was extremely arbitrary in how it redacted information on Freedom of Information Act requests. There are specific rules about what should be redacted and what should be allowed. However, the EFF received the same documents from separate requests, and found totally different sections redacted. Not only did this suggest how arbitrary the process was, it also allowed them to see some of what was redacted in the “other” document — and discover that it never should have been redacted.
Now, the EFF is pointing to a recent ruling that shows the FBI apparently feels it’s free to go much further than just arbitrary redacting. In a different case

And for years, the FBI has maddeningly refused to take our harsh criticism into consideration. It has done its own thing, because of course it has. Who could possibly stop it? A mass violators of rights both domestic and foreign isn’t going to stop doing what it likes to do just because these actions are wrong.

Some unfortunate news. AZ Central reported yesterday that James Larkin, who was a free speech pioneer who built an alt-weekly newspaper empire, and then spun out the controversial classifieds ads site Backpage, died by suicide, one week before his latest trial.
While there’s been plenty of discussion about Backpage, related to questions around Section 230, sex trafficking, and a variety of other things, much of the public perception about it is completely misleading. The actual details suggest that the media, prosecutors, and some politicians basically concocted an astoundingly misleading narrative about Larkin (and his partner Michael Lacey) and what they did at Backpage.

Portland Copwatch, originally known as POPSG* was formed as a project of Peace and Justice Works (formerly Portland Peaceworks) in June, 1992. In January, 1992, Portland Police shot a 12-year old boy who had been taken hostage, and in April of that year, Los Angeles erupted in the wake of the Rodney King verdict. Records relating to Loyd Jowers (November 20, 1926– May 20, 2000) who was the owner of Jim’s Grill, a restaurant near the Lorraine Motel in Memphis, Tennessee, where Dr. Martin Luther King Jr. was assassinated on April 4, 1968. In December 1993, Jowers appeared on ABC’s Prime Time Live and related the details of an alleged conspiracy involving the Mafia and the U.S. government to kill King. Jowers said that he hired Memphis police Lieutenant Earl Clark to fire the fatal shot. The existence of such a conspiracy, and Jowers’ involvement, was supported in the verdict of a 1998 court case which was brought against Jowers by the King family. The allegations and the finding of the Memphis jury were later rejected by the United States Department of Justice in 2000.

A gentleman’s agreement with the UK following years of colonialism has given rise to another form of oppression. China took over Hong Kong in 1997, promising to stay out of the day-to-day business of governing Hong Kong for 50 years. Not even halfway through this promised period of relative autonomy, the Chinese government began imposing its will.
Hong Kong residents were understandably unhappy with this development. Protests followed. Every wave of protest was followed swiftly by even more impositions by the Chinese government. In the last couple of years, it’s become apparent the Chinese government is no longer willing to tolerate any form of dissent in Hong Kong, despite its earlier agreement to take a hands-off position on governing Hong Kong until the middle of this century.

The Ninth Circuit appeals court seems to have figured out the best way to “reform” Section 230: by pretending it doesn’t apply to some stuff that the judges there just randomly decide it doesn’t apply to anymore. At least that’s my reading of the recent ruling against YOLO Technologies.
Now, let’s start by making something clear: YOLO Technologies appears to be a horrible company, making a horrible service, run by horrible people. We’ll get more into the details of that below. I completely understand the instinctual desire that YOLO should lose. That said, there are elements of this ruling that could lead to dangerous results for other services that aren’t horrible. And that’s what always worries me.

Clearview’s status as an international pariah really hasn’t changed much over the past few years. It may be generating fewer headlines, but nothing’s really changed about the way it does business.
Clearview has spent years scraping the web, compiling as much personal info as possible to couple with the billions of photos it has collected. It sells all of this to whoever wants to buy it. In the US, this means lots and lots of cop shops. Also, in the US, Clearview has mostly avoided running into a lot of legal trouble, other than a couple of lawsuits stemming from violations of certain states’ privacy laws.
Elsewhere in the world, it’s a different story. It has amassed millions in fines and plenty of orders to exit multiple countries immediately. These orders also mandate the removal of photos and other info gathered from accounts of these countries’ residents.
It doesn’t appear Clearview has complied with many of these orders, much less paid any of the fines. Clearview’s argument has always been that it’s a US company and

2. All agency records created or reviewed in connection with the following FOIA requests: "CRM-3006-97176"; EOUSA-2019-002865; A-2020-01304.
Please note the following history of the agency's failure to task an adequate search in response to similar previous requests: 
A. First, on May 8, 2019, I requested records from the DOJ Criminal Division pertaining to the declination of prosecution by the USAO for the MDGa. (See: https://www.muckrock.com/foi/united-sta ... 898/#comms). DOJ acknowledged receiving this request on May 22, 2019, and assigned it a tracking number of CRM-3006-97176. In its May 22, 2019, acknowledgement letter, DOJ FOIA requested clarification as to the records requested. I provided the requested clarification the same day, indicating that because prosecution was declined, no case number was publicly available. Consequently, on July 5, 2019, DOJ-CRIM concluded my original request was "misdirected" and transferred that request to the Executive Office of United States Attorneys (EOUSA) and informed me it was treating the response as final and the case closed. I did not administratively appeal that determination because it appeared that DOJ-CRIM did not have responsive records, EOUSA did, and that EOUSA would commence a search for these records after it received DOJ-CRIM's intra-agency referral. To the best of my knowledge, I have never received an acknowledgement or individualized tracking number from EOUSA following DOJ-CRIM's July 5, 2019, referral of my May 8, 2019, "misdirected" request to EOUSA.
2. Second, on May 8, 2019, I requested records from the EOUSA (independently from the referral by DOJ-CRIM). That request is available here: https://www.muckrock.com/foi/united-sta ... eys-72899/. On May 16, 2019, EOUSA acknowledged receipt of this request and assigned it tracking number EOUSA-2019-002865. On July 8, 2019, EOUSA informed me that it had conducted a search of the USAO for the Northern District of Georgia and located no responsive records. I replied on July 17, 2019, by pointing out that the USAO MDGa had not been searched. EOUSA provided no response. On June 3, 2020, I administratively appealed the constructive denial of my FOIA request, which EOUSA assigned tracking number A-2020-01304. On July 20, 2020, EOUSA denied the appeal, determining it was untimely, because it was not filed within the 90-day period after EOUSA's July 8, 2019 decision.
Based on the above, a currently-pending referral from DOJ-Crim to EOUSA of my "misdirected" request, which DOJ-CRIM initiated no later than July 5, 2019, remains unacknowledged and pending within EOUSA's FOIA files. I seek records responsive to that referral on an expedited basis, given that DOJ FOIA has failed to properly acknowledged the intra-agency transfer for nearly 3 years.

FBI whistleblower Sibel Edmonds worked as a translator for the Federal Bureau of Investigation Washington Field Office. Ms. Edmonds’ father is an Iranian Azerbaijani and her mother is Turkish. She lived in Iran and Turkey before coming to the United States as a student in 1988. She is fluent in Turkish Persian, English and Azerbaijani.
Immediately following the 9/11 Terrorist Attacks in 2001, she reported serious cover-ups, security breaches, and intentional blocking of intelligence that had national security implications. She was fired from her job in March of 2002.
Represented by Kohn, Kohn & Colapinto, Ms. Edmonds pursued a successful Freedom of Information Act Case to document the FBI’s retaliation against her, and obtained critical findings from the U.S. Department of Justice Office of Inspector General confirming that the FBI had retaliated against her from reporting misconduct to the proper authorities. Thereafter, KKC represented Ms. Edmonds in her attempt to publish her life story, free from FBI censorship. Jane Turner
Jane Turner was a highly decorated 25-year veteran of the FBI. She won awards for successfully investigating major crimes on the Forth Berthold Indian Reservation in North Dakota. She was described by federal prosecutors as the leading FBI agent solving child crimes in the entire United States. After documenting a seriously botched child sex crime case committed by agents of the FBI, she was removed from her position. 
Jane successfully fought her removal, winning a precedent setting case before the U.S. Court of Appeals for the Seventh Circuit. Her case was tried before federal jury. She was fully vindicated. The jury awarded Ms. Turner the maximum compensatory damages permitted under Title VII. The total recovery, costs, fees, and damages awarded exceeded $1.5 million. After the trial one of the jurors hugged Ms. Turner and told her, “I think you were the very best FBI agent.”
Turner also reported illegal theft by federal officials at the 9/11 World Trade Center crime scene. Her disclosures were backed-up by the DOJ Inspector General, and systemic reforms were approved. She again suffered retaliation, and again won her whistleblower case.

Former Federal Bureau of Investigation Special Agent Jane Turner led efforts to force the FBI to protect child sex crime victims on North Dakota Indian Reservations. In retaliation for exposing FBI failures within its child crime program, the FBI removed Ms. Turner from her position.
Ms. Turner was removed from her position in Minot after she disclosed serious FBI misconduct in its handling of child abuse cases. In one case, Ms. Turner vigorously complained that the FBI had improperly classified the brutal rape of a two year old Native American child as a “motor vehicle accident.” At the trial, government witnesses confirmed that Ms. Turner had successfully “dogged” the case for over one year and forced the government to re-open the prosecution. Her investigation led to a guilty plea by the rapist.
In a September 13, 2005 ruling, the US. Court of Appeals for the 8th Circuit unanimously upheld the right of Turner to obtain monetary damages and a jury trial against the FBI. In a historic victory for all FBI whistleblowers, the Court held that Ms. Turner set forth sufficient facts to justify a trial by a jury. The Court based its decision on evidence of the FBI’s retaliatory transfer of Ms. Turner. The FBI had moved her from an investigatory position in Minot, North Dakota, to a demeaning desk job in Minneapolis.
The FBI justified removing Turner based on her “performance.” But as the Court of Appeals noted, Ms. Turner’s law enforcement abilities were widely praised:
Federal agents, Native American reservation law enforcement personnel, and Assistant United States Attorneys who worked closely with Turner averred that she did not commit the specific procedural errors alleged [by the FBI], that historically her work was outstanding, and that her performance showed no decline during the [relevant time period].
After an almost ten-year battle, on February 5, 2007, she won a unanimous jury verdict in her favor. The jury awarded Ms. Turner the maximum compensatory damages permitted under Title VII. This award was the largest compensatory damage award permitted under the law for federal employees. The total recovery, costs, fees, and damages awarded exceeded $1.5 million.
The Minneapolis Star Tribune covered her trial, and reported the following after the jury vindicated Ms. Turner:
Federal jurors hugged former FBI agent Jane Turner. “I think you were the very best FBI Agent,” juror Mashima Dickens told Turner, who investigated child sex-abuse crimes. “Looking at the way you were treated, I just said you were screwed left and right,” Dickens said, tears rolling down her cheeks.”
Ms. Turner also exposed criminal theft of property at the 9/11 crime scene by a handful of FBI agents. The FBI harshly retaliated against her for reporting these violations to the Department of Justice Inspector General. Ms. Turner’s allegations led to an investigation by the Department of Justice Inspector General. The IG Investigation Report found that there had been misconduct by FBI agents and led to new agency regulations preventing the taking of souvenirs from crime scenes.
After reporting the illegal theft at the World Trade Center 9/11 crime scene Ms. Turner was placed on administrative leave and recommended for removal. She filed a complaint under the Department of Justice FBI Whistleblower Protection Act, and won a second retaliation case. Her notice of removal was rescinded. After 25-years of stellar service on behalf of the American people, Ms. Turner retired from the FBI. She thereafter joined the Board of Directors of the National Whistleblower Center.

"After being forced to leave the FBI, my career is over, my salary is gone and I am forced to sell personal belongings, including a car and my home," Doucette said. FBI spokesman Nestor Michnyak said that because of Doucette's pending lawsuit against the agency, the FBI could not comment on her testimony.

Can Police Departments Be Trusted to Release Their Own Misconduct Records? Apparently Not.

In January 2023, the mayor of the Village of Chester, in Orange County, received an anonymous letter from a village police officer about the police chief.
The letter said that, starting in 2020, Chief Timothy McGuire, then a sergeant in the department, repeatedly met a woman he was in a sexual relationship with at the police station. McGuire would brag about his affair, the letter alleged — and he would recruit his police underlings to help him hide it. When the woman was at the station, McGuire would instruct the officers to leave; he would tell them when they could return.
McGuire also met the woman at remote locations throughout Chester after telling officers not to patrol in those areas, the letter stated. At least once, McGuire allegedly met the woman in his police vehicle.
The officer described McGuire’s behavior as “immoral, unethical, and illegal.” The mayor acted quickly, tapping a village lawyer to launch a formal investigation.
But 10 months later, after the lawyer drafted his initial investigation report, the Village of Chester Police Department claimed that it didn’t exist.
In November 2023, New York Focus and MuckRock filed a public records request with the village for all disciplinary records and misconduct complaints against police department staff, as well as misconduct records shared with prosecutors since 2018. McGuire personally responded to the request. “There are no records,” he wrote in an email.

This is just what I needed to read after a post-election hell week or two. The city of Los Angeles has gone past exhaustion to vindictive irritation after being sued by the same cops it employs because it (legally) handed over photos and names of LAPD officers to journalist Ben Camacho. Ben Camacho then shared those with activist group, Stop LAPD Spying Coalition, which added those to its searchable database of local law enforcement officers.
At first, the city played ball. It went to bat for the LAPD and claimed Camacho and Stop LAPD Spying had no right to publish the information they’d obtained legally via public records requests. Then the LAPD’s union sued the city, not only claiming the city

In his current federal obstruction-of-justice trial, former Maryland
state senator Clarence M. Mitchell III has filed an affidavit from a
former FBI informant that could give credence to what many people
thought were self-serving, paranoid even, expressions from black elected
officials. According to the affidavit, signed by Hirsch Friedman, 45, a former
FBI informant in Atlanta, the FBI had an "unofficial policy" in the late
1970s and early 1980s to investigate "without probable cause prominent
elected and appointed black officials in major metropolitan areas
throughout the United States."
Friedman, now an Atlanta lawyer and businessman, said the policy was
called Fruehmenschen, a German word that translates roughly to
"primitive man or early man," and was based on "the assumption by the
FBI that black officials were intellectually and socially incapable of
governing major governmental organizations and institutions."

I’ve been doing this for more than 10 years and I can assure I have yet to read a DOJ civil rights investigation report that has concluded everything looks pretty OK at this cop shop. Every — and I mean every — DOJ investigation is followed by a report that can be accurately described as “scathing.” And that’s often an understatement.
That’s how the Associated Press describes this report [PDF], which was released earlier this month by the Department of Justice.
