We’ve already talked about Montana’s extraordinarily unconstitutional “ban TikTok” bill that raises a huge number of constitutional issues. Lots of individuals and organizations pointed this out to governor Greg Gianforte (who came to office as a former tech exec of an internet company, and was supposed to be someone who understand the internet).
Gianforte has now sent back to the legislature what’s known as an “amendatory veto” that basically is alternative draft language that he would approve if the legislature amends the original bill. In theory, the likely reasoning behind the alternative language was the recognition that the original bill, which called out TikTok by name (including spelling it wrong in the title) would be immediately deemed unconstitutional as a bill of attainder targeting a single company for punishment.
In theory… that’s an improvement. In reality, as pointed out by 1st Amendment lawyer Ari Cohn, Gianforte’s draft language would accidentally ban all social media in the state of Montana, because of bad drafting. As Ari points out, the new draft targets any

We’ve noted repeatedly how Netflix’s password sharing crackdown is a stupid cash grab that alienates and annoys loyal customers, duplicates existing efforts to restrict “freeloaders,” won’t give the company the financial windfall it thinks, and just generally represents how the company has inevitably shifted from innovative disruptor to the kind of tone deaf cable giants it used to criticize.
The plan basically involves charging users an extra $2-$3 a month if it’s found that someone is using your account outside of your home. The problem: Netflix has already been imposing blanket price hikes, and it already limits the number of simultaneously streams per account, forcing users to subscribe to more expensive tiers if they want to expand the limit.

Cops keep letting us know who they really are. They can’t seem to help themselves.
They demand to be viewed as good guys, but far too often, they align themselves with fascists, racists, and opportunistic politicians who align themselves with fascists and racists.
When the latest presidential election delivered a loss to Donald Trump, his supporters chose to embrace the conspiracy theories their main man in office embraced. It was rigged. Votes were stolen. Everyone other than his supporters were wrong, perhaps so wrong they could be arrested.
The opposite was true. While these supporters embraced theories espoused by 4chan users and played the part of the choir being preached to, the rest of the nation moved on. The supporters did not. They raided a federal building and to remove the word “peaceful” from the phrase “peaceful transition of power.”

WASHINGTON, DC — The controversial Internet surveillance tool known as “Carnivore” has been renamed DCS1000, a name devoid of any negative associations, the Federal Bureau of Investigation said Tuesday, Reuters reported.
According to Reuters, Paul Bresson, an FBI spokesman, said, “With upgrades come new names.”
The old name of a flesh-eating predator had conjured up “unfortunate” images for many people, he added.
Carnivore is specialized software installed on an Internet service provider’s network under federal wiretap authority. Used in criminal and national security cases, it is capable of keeping tabs on a suspect’s e-mail, instant messages and Web surfing activities.
Privacy and civil-rights advocates argue that the system violates protections against unreasonable search and seizure in the U.S. Constitution’s Fourth Amendment. Former Attorney General Janet Reno ordered an independent review of its inner workings after a stir in Congress.
The name change was to have been rolled out in conjunction with an internal Justice Department review of Carnivore to be presented to Attorney General John Ashcroft soon, an FBI official said. But the change was leaked to a trade publication, Government Computer News.
“Had it not been called Carnivore, it probably wouldn’t have stirred as much controversy,” Bresson said. He said the new alpha-numeric “doesn’t stand for anything.”
Critics said the FBI was kidding itself if it thought a name change alone would allay fears. They consider the system ripe for abuse largely because of the secrecy surrounding how it scans passing data to find the court-authorized target.
“It’s not the name that worries people,” said David Sobel of the Washington-based Electronic Privacy Information Center. “It’s the way this system works.”
Barry Steinhardt, associate director of the American Civil Liberties Union, added: “If it prowls like a wolf, howls like a wolf and has the voracious appetite of a wolf, it’s still a carnivore.”

The officer worked for the Stoughton Police Department, near Boston, where he first met Birchmore about a decade earlier through the agency’s Explorer post — part of a youth mentorship program run by local departments across the country.
He acknowledged having sex with her when she was 15, according to a court ruling citing the officer’s text messages. That document indicates that his twin brother — also an officer and Explorer mentor — and a third Stoughton officer, a veteran who ran the program, eventually had sex with her, too.
Birchmore’s case is among at least 194 allegations that law enforcement personnel, mostly policemen, have groomed, sexually abused or engaged in inappropriate behavior with Explorers since 1974, an ongoing investigation by The Marshall Project has found. The vast majority of those affected were teenage girls — some as young as 13.

Terrence Brooks Norman (born April 30, 1949) was a Kent State University student allegedly involved in the Kent State shootings.
Norman was a junior at the University when soldiers from the Ohio National Guard killed four students and wounded others during a May 4, 1970 protest. Norman was present at the protest and was photographing the demonstrators for both the campus police and the FBI, a fact that was initially denied by both agencies but later confirmed.
After the shooting, Sylvester Del Corso, the Ohio National Guard’s top general, released a public statement claiming that Norman had admitted firing four shots at the demonstrators in self-defense. He later backed off from that statement.
There were several reasons why Norman was suspected of starting the tragedy:
* Norman was the only person on campus other than a Guardsman known to have been armed with a weapon;
* The Guard continued to insist that a single shot of unknown origin preceded the 13-second volley of gunfire; and
* There had been a previous and never-fully-explained incident on Blanket Hill in which Norman drew his gun and pointed it at students. Norman had scuffled with some fellow students and reportedly drawn his gun before being chased by several men across the campus to the campus police and National Guard. One of his pursuers, graduate student Harold Reid, yelled, “Stop that man! He has a gun.”

A new lawsuit states the FBI was tracking “unvaccinated” New York City schoolteachers and employees using their fingerprints. The city gathered a list of its employees who refused to get the COVID-19 shots, tagged them with a “problem code,” and flagged them to the FBI with a file that included their fingerprints.

Not only were some of these Americans fired for refusing this shot — many for religious reasons — now their fingerprints are on record at the FBI with a flag. This scarlet flag could make it significantly more difficult to land another job, teaching or otherwise.

The FBI is not the only federal department or agency tracking vaccine status. The Centers for Disease Control and Prevention (CDC) is rolling out four new codes, and you might be tagged with one of them.

These new codes track people regarding their COVID injection status and other vaccines. This even includes a code for tracking conversations about these shots and any “counseling” given “regarding the safety of a vaccine.”

Every cop with a dog swears it can detect all sorts of contraband. Literally swears. In court. On the stand.
But are drug dogs miraculous wonders of law enforcement due to their training? Or is it due to the domesticated dog’s innate desire to please, especially when it knows it will be rewarded for doing the thing? Or is it simply responding to cues delivered by its handler, some of which may be subconscious?
Well, it’s probably a combination of all these things. Training does get dogs to respond to certain scents. But the training also turns them into an extension of their handler. And then the dog wants what the cop wants: a reason to perform a warrantless search. Both handler and dog are rewarded in their own way. The dog gets a treat. And the cop gets to perform a trick that allows the officer to bypass the Fourth Amendment. (There’s a reason cops hate actually scientific testing of officers and drug dogs, because once the pair is separated, tons of false positives and negatives tend to be generated.)
For a long time, courts were mostly receptive to the assertions made by officers handling drug dogs. If they said in court that the dog “alerted,” the court generally couldn’t find

Hell there’s a best selling book and its author making the rounds basically everywhere, insisting that the internet and phones are literally “rewiring” kids minds to be depressed. KING: Suicides by cops under investigation are troubling for several reasons
Oakland, Calif., Officer Brendan O’Brien took his own life last year. In a suicide note, he mentioned a series of officers involved with a sexual misconduct scandal that is now engulfing the entire Oakland Police Department. The police chief and several officers have now resigned over the scandal, and it increasingly appears O’Brien was also having sex with a minor. Not only that, but there was an idea he killed his own wife a year earlier, in a death first ruled suspicious, but then later deemed a suicide.

NIST finalizes post-quantum encryption standards
On Tuesday, the National Institute of Standards and Technology (NIST) published three new encryption algorithms to bolster global cybersecurity efforts against future attacks using quantum technologies. The new standards are designed for general encryption and digital signatures. The algorithms, called FIPS 203, FIPS 204, and FIPS 205, are published to NIST’s post-quantum cryptography (PQC) project website. We all hate data brokers. I mean, those of us who aren’t in law enforcement. Law enforcement tends to love data brokers because they allow investigators to collect a bunch of stuff (including location info) without having to whip up a subpoena or (the horror…) ask a judge to sign off on a warrant.
Nope, to get data from data brokers, all you need is cash. If you can buy, they will sell. And, since privacy laws in the US haven’t really gotten around to dealing with the modern reality of having your data passed around like a joint in a high school parking lot on graduation day, most people have no legal options for recourse.
Most people, that is. In some places, people who’ve already enjoyed plenty of extra rights when they were still employed as law enforcement officers get to enjoy extra rights even though they’re no longer working for the government.

The FBI and DOJ have always felt comfortable going after Islamic extremists. That’s the sort of thing they like to do. They like it so much they’ll radicalize vulnerable people for the sole purpose of locking them up for multiple decades.
A lot of digital ink has been spilled covering the FBI’s success rate in taking down people its operatives and informants have converted into “terrorists.” While this does next to nothing to make the nation more secure, it allows the DOJ and FBI to tout its string of “wins” against people who neither had the mental capacity, funds, or actual desire to do harm to American citizens in the name of Islam.
Going after domestic terrorists is a different story. White nationalists, far right extremists, and actual Nazis have always seemed a bit more difficult to take down. B

You can’t trust cops around your personal info, data, communications, or pretty much anything. Officers have a lot of power and access to plenty of databases filled with personal info. They abuse this power and access frequently.
Here’s some (recent) historical perspective. In July 2024, a female police officer was awarded a $1 million settlement after her fellow officers shared sexual content found on her phone during an internal fraud investigation. In October 2022, a police officer was indicted for using law enforcement database access to seek female targets to hack to obtain sexually explicit photos and videos. In October 2014, a bunch of California Highway Patrol officers were caught sharing explicit photos harvested from the phones of female arrestees. That same year, two cops were caught using law enforcement databases to gather information on women they hoped to strike up romantic relationships with. In 2004, a cop was fired for using database access to spy on his ex-wives. A 2013 investigation uncovered the extremely alarming fact that more than half of M

Way back in the day (1971, to be precise), the Supreme Court created a cause of action to sue federal officers over rights violations. The original case, Bivens v. Six Unknown Named Agents, involved Webster Bivens and the warrantless search of his Brooklyn home by FBN (Federal Bureau of Narcotics — the precursor to the DEA) agents, which was then followed by his warrantless arrest.
With nothing else to go with at that point, the Supreme Court sided with Bivens, creating an implied cause of action that roughly aligned with Section 1983 of the US Code
