Last year a Republican senator conceded that they contained scenes of "rape and murder" and Secretary of Defense Donald Rumsfeld said they included acts that were "blatantly sadistic."

U.S. District Judge Alvin K. Hellerstein ordered the release of certain pictures in a 50-page decision that said terrorists in Iraq and Afghanistan have proven they "do not need pretexts for their barbarism."

The ACLU has sought the release of 87 photographs and four videotapes taken at the prison as part of an October 2003 lawsuit demanding information on the treatment of detainees in U.S. custody and the transfer of prisoners to countries known to use torture.

Gen. John Abizaid, commander of U.S. Central Command, said Thursday that releasing the photos would hinder his work against terrorism. "When we continue to pick at the wound and show the pictures over and over again it just creates the image--a false image--like this is the sort of stuff that is happening anew, and it's not," Abizaid said.

The judge said, however, that "the freedoms that we champion are as important to our success in Iraq and Afghanistan as the guns and missiles with which our troops are armed."

An ACLU release this afternoon said it was getting 70 photos and three video tapes. It also said that the government is being given 20 days to appeal.

What is shown on the photographs and videos from Abu Ghraib prison that the Pentagon has blocked from release? One clue: Defense Secretary Donald Rumsfeld told Congress last year, after viewing a large cache of unreleased images, "I mean, I looked at them last night, and they're hard to believe." They show acts "that can only be described as blatantly sadistic, cruel and inhumane," he added.

A Republican Senator suggested the same day they contained scenes of "rape and murder." Rumsfeld then commented, "If these are released to the public, obviously it's going to make matters worse."

The photos were among thousands turned over by the key "whistleblower" in the scandal, Specialist Joseph M. Darby. Just a few that were released to the press sparked the Abu Ghraib abuse scandal last year, and the video images are said to be even more shocking.

“Today's historic ruling is a step toward ensuring that our government's leaders are held accountable for the abuse and torture that happened on their watch,” said ACLU Executive Director Anthony D. Romero. “The American public has a right to know what happened in American detention centers, and how our leaders let it occur."

One Pentagon lawyer has argued that they should not be released because they would only add to the humiliation of the prisoners. But the ACLU has said the faces of the victims can easily be "redacted."

To get a sense of what may be shown in these images, one has to go back to press reports from when the Abu Ghraib abuse scandal was still front page news.

This is how CNN reported it on May 8, 2004, in a typical account that day:

"U.S. Defense Secretary Donald Rumsfeld revealed Friday that videos and 'a lot more pictures' exist of the abuse of Iraqis held at Abu Ghraib prison.

"'If these are released to the public, obviously it's going to make matters worse,' Rumsfeld told the Senate Armed Services Committee. 'I mean, I looked at them last night, and they're hard to believe.'

"The embattled defense secretary fielded sharp and skeptical questions from lawmakers as he testified about the growing prisoner abuse scandal. A military report about that abuse describes detainees being threatened, sodomized with a chemical light and forced into sexually humiliating poses.

"Charges have been brought against seven service members, and investigations into events at the prison continue.

"Military investigators have looked into -- or are continuing to investigate -- 35 cases of alleged abuse or deaths of prisoners in detention facilities in the Central Command theater, according to Army Secretary Les Brownlee. Two of those cases were deemed homicides, he said.

"'The American public needs to understand we're talking about rape and murder here. We're not just talking about giving people a humiliating experience,' Republican Sen. Lindsey Graham of South Carolina told reporters after Rumsfeld testified before the Senate Armed Services Committee. 'We're talking about rape and murder -- and some very serious charges.'

"A report by Maj. Gen. Antonio Taguba on the abuse at the prison outside Baghdad says videotapes and photographs show naked detainees, and that groups of men were forced to masturbate while being photographed and videotaped. Taguba also found evidence of a 'male MP guard having sex with a female detainee.'

"Rumsfeld told Congress the unrevealed photos and videos contain acts 'that can only be described as blatantly sadistic, cruel and inhuman.'"

The military later screened some of the images for lawmakers, who said they showed, among other things, attack dogs snarling at cowed prisoners, Iraqi women forced to expose their breasts, and naked prisoners forced to have sex with each other.

In the same period, reporter Seymour Hersh, who helped uncover the scandal, said in a speech before an ACLU convention: "Some of the worse that happened that you don't know about, ok? Videos, there are women there. Some of you may have read they were passing letters, communications out to their men ... . The women were passing messages saying 'Please come and kill me, because of what's happened.'

"Basically what happened is that those women who were arrested with young boys/children in cases that have been recorded. The boys were sodomized with the cameras rolling. The worst about all of them is the soundtrack of the boys shrieking that your government has. They are in total terror it's going to come out."

Judge Hellerstein said today that publication of the photographs will help to answer questions not only about the unlawful conduct of American soldiers, but about “the command structure that failed to exercise discipline over the troops, and the persons in that command structure whose failures in exercising supervision may make them culpable along with the soldiers who were court-martialed for perpetrating the wrongs.”

Old news?

Hmmm. At first I thought this was a reposting of an old story, but I see this is new.

www.jihadunspun.com/inthe...=/home.php

I recall that when the last batch was released, it was asserted that it was the entirety of the photographic/video evidence. The big question is, will the brutal rape of women and children be dismissed as "frat boy hijinks"?

Re: It was a sort of hoax or mistake

Postby NavnDansk » Fri Oct 27, 2006 12:06 pm

an old article did get published. I followed a link from yesterday's ThinkProgress about Rumsfeld and it was a blog that had taken down the story and apologized saying that since it was from AfterDowningStreet they were sure it was accurate but someone fed ADS old information but it is good to keep this order to release the photos which bush defied then I think agreed to do after the election.

Another important thing to remember is the army report that DU spoke about and linked to a few months ago that stated that not only did rumsfeld tailor the tortures to some individual prisoners but that rumsfeld went to gitmo and personally tortured or "interrogated" at least one prisoner.

With all the scandals and material being released pre-election it would be incredibly good if someone would release, at least on the internet, photos and/or vids of the sick nazi rumsfeld performing torture personally.

Someone posted then that the military was releasing a lot of information that reflected badly on the military but they were so desparate to get the American people to act they were doing it to show just how horrific these nazis are.

Please vote.

Re: Judge Orders Release of Abu Ghraib Child Rape Photos

Postby James Redford » Sun Oct 29, 2006 6:42 am

The first post above is simply a copy of the below article, published over a year ago. So far as I know, the U.S. government still refuses to turn over the additional pictures and videos of even far worse tortures that they have (i.e., worse relative to the pictures that have already been released).

"Judge Orders Release of Abu Ghraib Photos," Greg Mitchell, Editor & Publisher, September 29, 2005:

www.editorandpublisher.co...1001218842

A Google News search on *Hellerstein* doesn't turn up any mainstream media articles on any new orders by him for the government to turn over the photographs and videos of torture they possess:

news.google.com/news?num=...&scoring=d

In the below, I provide massive amounts of documentation wherein the U.S. government itself admits it is holding innocent people indefinitely without charges (including U.S. citizens), torturing them, raping them--including homosexually anally raping them--and murdering them, and that the orders to do so came from the highest levels of the U.S. government.

####################

Crushing Children's Testicles: Welcome to the New Freedom

John Choon Yoo ( www.law.berkeley.edu/faculty/yooj/ , www.law.berkeley.edu/facu...?facID=235 ) is a professor of law at the University of California at Berkeley School of Law (Boalt Hall), one of the authors of the Patriot Act, and is one of the main White House legal advisers on the use of torture to President George Bush, Jr. Prof. John Yoo emigrated from South Korea with his parents when he was an infant, and is now married to Elsa Arnett, the daughter of reporter Peter Arnett.

Douglass Cassel ( www.nd.edu/~ndlaw/faculty...assel.html ) is the Lilly Endowment Professor of Law and Director of the Center for Civil and Human Rights at Notre Dame Law School.

The below excerpt is from a debate between Prof. John Yoo and Prof. Doug Cassel on December 1, 2005 in Chicago:

""
Prof. Doug Cassel: If the President deems that he's got to torture somebody, including by crushing the testicles of the person's child, there is no law that can stop him?

Prof. John Yoo: No treaty.

Prof. Cassel: And also no law by Congress. That's what you wrote in the August 2002 memo.

Prof. Yoo: I think it depends on why the President thinks he needs to do that.
""

You can listen to the above exchange on the below audio clip:

rwor.org/downloads/file_i...orture.mp3 (317,712 bytes)

The below audio clip is a longer recording which includes the above exchange:

rwor.org/audio/yoo%20excerpt.mp3

See also:

"John Yoo Argues Pres. George Bush Has Legal Power to Torture Children," Philip Watts, Revolution Newspaper (revcom.us):

rwor.org/johnyoo/index.html

##########

Since H.R. 3162, i.e., the "USA Patriot Act," was passed into law on October 26, 2001 without the Congress or Senate even being allowed to read it before voting on it, the police can now secretly search your house and take whatever they want from it without having to tell you about it until they issue you a warrant up to six months later (see Sec. 213). Also, the legal definition of "domestic terrorism" was changed to include any "acts dangerous to human life that are a violation of the criminal laws of the United States or of any State" (see Sec. 802)--which could quite literally be jaywalking.

Indeed, smoking a joint could quite literally be domestic terrorism as defined under this law, since the U.S. government considers such drug use to be dangerous to human life, and since it is illegal after all. But such an act is supposed to only qualify if it "appear[s] to be intended to influence the policy of a Government by intimidation or coercion." So smoking a joint would only be an act of "domestic terrorism" if the U.S. Government thinks a person is doing it as a protest against their drug laws--the clause for "intimidation" already applies, otherwise the U.S. government would have no law against it.

And since P.L. 107-40 (September 18, 2001) was enacted and Bush, Jr. signed the November 13, 2001 Presidential Military Order, *habeas corpus* has been done away with as U.S. citizens can now be held indefinitely and in secret on the mere suspicion that they are in some way involved in "terrorism" (which can now be virtually anything--see the above redefined definition of "domestic terrorism") without even being charged; they can be tried by a secret military tribunal where they will not have the right to cross-examine their accusers; and they can be executed in secret. (Of which color-of-law precedents that totally eviscerate the legal rights of U.S. citizens have now been further strengthened by the recent "Military Commissions Act of 2006," i.e., Senate Bill S. 3930 and House Bill H.R. 6054; said Bill also retroactively attempts to get the U.S. government out from under the Geneva Conventions.) Indeed, U.S. citizens have already been held for years without any charges even having been filed against them (such as José Padilla and Yaser Esam Hamdi), and the U.S. government says that it can keep U.S. citizens that way indefinitely.

So it's not surprising to find that the U.S. government has been torturing innocent people, including U.S. citizens. This includes U.S. soldiers torturing people in U.S. custody to death.

"Pakistan: U.S. Citizens Tortured, Held Illegally--FBI Participated in Interrogations Despite Apparent Knowledge of Torture, Abduction," Human Rights Watch, May 24, 2005:

hrw.org/english/docs/2005...t11005.htm

"Exclusive: Secret Memo--Send to Be Tortured," Michael Isikoff, Newsweek, August 8, 2005 issue:

www.msnbc.msn.com/id/8769.../newsweek/

"Outsourcing Torture: The secret history of America's 'extraordinary rendition' program," Jane Mayer, The New Yorker, Issue of February 14, 2005, posted February 7, 2005:

www.newyorker.com/fact/co...14fa_fact6

"CIA kidnapped terror suspects in the EU: lawmaker," Reuters, April 26, 2006:

www.google.com/search?q=c...3D11968389

go.reuters.com/newsArticl...D=11968389

"Bush admits the CIA runs secret prisons," Deb Riechmann, Associated Press (AP), September 6, 2006:

news.yahoo.com/s/ap/20060...pr_wh/bush

Khalid El-Masri, an innocent German citizen, was abducted from Macedonia and held by the U.S. military without charges from January 23 to May 28, 2004, during which time he was anally sodomized and tortured by the U.S. military.
